  • CLP Compliance

If you sell candles, wax melts, diffusers, or other home fragrance products, it is essential to comply with the Classification, Labelling, and Packaging (CLP) Regulations. These regulations ensure that products containing hazardous substances are correctly labelled to protect consumer safety. Compliance includes providing clear hazard information, warnings, and instructions on your product labels.

As a trader, you are responsible for ensuring that your products meet these requirements before they are sold. Non-compliance can result in legal consequences and safety risks for customers.

  • Cosmetic Products Compliance (Skincare, haircare, perfumes, bathbombs soaps etc)

In Northern Ireland, the sale of cosmetic products (e.g., skincare, haircare, perfumes, soaps) is governed by EU Regulation (EC) No 1223/2009 and the Cosmetic Products Enforcement Regulations 2013. These regulations ensure that all cosmetic products sold on the UK and EU markets meet strict safety, labelling, and manufacturing standards.

If you make cosmetic products, you are responsible for ensuring compliance with these regulations, including safety assessments, appropriate labelling, and registration on the UK or EU Cosmetic Products Notification Portal. For resellers, it is essential to confirm that the products you sell have been produced and labelled in accordance with these regulations by the original manufacturer.

  • Toys and Products with Play Value Compliance

    Clarification for Traders

Under the Toys (Safety) Regulations 2011, toys are defined as "any product or material designed or clearly intended (whether or not exclusively) for use in play by children under 14 years of age."
Products with "play value" include items not explicitly marketed as toys but are likely to be used in play by children.

    Important Requirements

All toys must comply with the Toys (Safety) Regulations 2011 and carry the appropriate UKCA or CE marking on the product or packaging.
Labelling must include: The name and address of the manufacturer or responsible business.
Appropriate warnings and instructions for use where applicable.
If you are the maker you must retain testing paperwork and other compliance documents in their records, as they may be requested by authorities such as Trading Standards.

  • Copyright and Trademark Compliance

All traders are required to ensure that the products they sell comply with copyright and intellectual property (IP) laws. This includes ensuring that the designs, logos, and branding used on products are not infringing on the rights of others. Copyright infringement and trademark violations can harm small businesses, damage reputations, and result in legal consequences.

    Definition of Copyright Infringement
Copyright infringement occurs when someone uses another person’s original work without permission or proper licensing. This applies to artwork, logos, music, writing, and other creative works.

    Definition of Trademark Infringement
Trademark infringement involves the unauthorised use of a registered trademark (e.g., brand logos, slogans, or symbols) that is likely to cause confusion about the source of the goods.

    Examples of Non-Compliance

Recreating and selling items featuring trademarked characters or logos without permission (e.g., cartoon characters, sports teams).
Printing unauthorised designs or characters on clothing, accessories, or printed goods.
Selling counterfeit or pirated goods, including branded merchandise.

For more detailed information about copyright and intellectual property infringement, please refer to our blog post HERE:
