Disclaimer: Release of Liability for Food Vendors at Otero College Event
This Disclaimer ("Disclaimer") is entered into by and between Otero College ("College") and the undersigned food vendor ("Vendor"). In consideration of Vendor's participation in providing food and/or beverages at the Otero College event, the parties agree as follows:
Assumption of Risks: Vendor acknowledges and understands that the consumption of food and beverages involves inherent risks, including but not limited to the possibility of foodborne illnesses or allergic reactions. Vendor acknowledges that event attendees may have various dietary restrictions or allergies.
Compliance with Laws: Vendor agrees to comply with all applicable federal, state, and local laws, regulations, and guidelines relating to food safety, sanitation, and labeling. Vendor further agrees to maintain any necessary permits, licenses, and approvals required for food service.
Allergy Awareness: Vendor acknowledges its responsibility to inform event attendees about the ingredients and potential allergens in its food and beverages. Vendor agrees to make reasonable efforts to accommodate dietary restrictions and allergies but acknowledges that cross-contamination or other factors may still occur.
Release of Liability: Vendor releases and discharges Otero College, its officers, employees, agents, and representatives from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses, whether at law or in equity, arising out of or in connection with any illness, injury, or allergic reaction experienced by event attendees as a result of consuming Vendor's food or beverages.
Insurance: Vendor acknowledges and agrees that it is solely responsible for maintaining adequate liability insurance coverage to protect against any claims, liabilities, or losses arising out of its participation at the event.
By participating as a food vendor at the Otero College event and signing below, Vendor acknowledges that it has carefully read and fully understands this Disclaimer and voluntarily agrees to its terms and conditions.
