    Pass it! Driving Academy
  • Pass It Driving Academy – Terms and Conditions for Driving Lessons (Intensive Courses).

    Introduction These terms and conditions govern the provision of weekly driving lessons by Pass It Driving Academy (the “Instructor”) to the student (the “Student”). By booking or attending lessons, the Student agrees to be bound by these terms. If anything is unclear, please ask for clarification before signing.

     
    General Conduct
    - The Instructor will be courteous, professional, and punctual, and the training car will be well maintained, clean, and tidy (weather permitting).
    - The car will be fitted with dual controls and is fully insured for driving tuition.
    Smoking is not permitted in the training car, and lesson time will not be used for other business without the Student’s explicit permission.

    Qualifications
    - The Instructor is legally authorised to provide driving tuition in the UK by the DVSA (Driver and Vehicle Standards Agency). 

    Course Materials
    - When you purchase any course, the Instructor may suggest external resources that may benefit your learning. Access to these resources is optional and not charged as part of the course.

    Driving Licence and Eye Check
    - The Student must hold a current, valid driving licence (provisional or full) and present it on or before the first lesson.
    - The Student must be able to read a number plate at 20 metres (about 67 feet) with prescribed visual aids (glasses or contact lenses, as needed). If corrective lenses are required, they must be worn on every lesson.
    - Licence verification: We may request the Student to provide a DVLA share code (licence check code) to verify that licence details are current and legitimate. The code may be used solely for verification purposes to enable the Student to participate in driving tuition. Data will be handled in accordance with data protection requirements. If you choose not to provide the code, we may request alternative verification or discuss acceptable alternatives. 

    Safety, Comfort, and Wellbeing
    - Safety is a shared responsibility. Wear suitable footwear and clothing.
    - The Student should give full attention to the driving task. If anything distracts you, inform the Instructor so it can be addressed.
    - If you feel uncomfortable or unsafe, tell the Instructor. The Instructor will respond calmly and provide guidance.
    - In an emergency, the Instructor may override student control (e.g., using dual controls) to avoid an incident and will explain as soon as it is safe.
    - The Instructor will communicate calmly and professionally at all times and will not shout, use sarcasm, or engage in inappropriate behaviour.
    - Inform the Instructor of any medications or conditions that may affect driving ability.

    Driving Under the Influence
    - The Instructor reserves the right to cancel any lesson if the student is suspected of being under the influence of drugs, legal highs, or alcohol. If this occurs, the applicable training fee may be forfeited.

    Intensive Courses – Scheduling, Attendance, and Cancellations
    Definition: An intensive course is a fixed block of hours delivered in a condensed timeframe.
    - Scheduling: An agreed timetable for the intensive course will be set in writing. Scheduling for lessons is managed using the Total Drive scheduling system, and the Student will be able to view the full timetable and any updates via the Total Drive app. Any changes must be agreed by both parties and will be visible to the Student in the app.
    - Attendance and punctuality: Students are expected to attend as scheduled. Repeated lateness may reduce the lesson time and could lead to termination of the course.
    - Cancellations and rescheduling: Cancellations or postponements within 48 hours of a booked session may incur charges. If you cancel earlier, refunds may be available per the refunds policy below. If the Instructor cancels, alternate arrangements will be offered.
    - Rest and safety: Intensive courses should incorporate appropriate rest periods between sessions to ensure safety and effective learning.
    - Completion and extensions: The course ends when the agreed hours are delivered. If you require more hours beyond the original package, additional hours may be purchased at the prevailing rate.

    Punctuality

    - Being punctual is in the Student’s best interest. All appointments are recorded in the Total Drive app.

    - I typically wait up to 15 minutes for a late Student before the lesson is considered abandoned and the fee may be due in full, unless alternative arrangements are agreed. If I am delayed, we will make up time where possible.
    - If persistent lateness occurs, we may discuss adjustments or termination of the current package.

    Payments
    - Deposit: A deposit of 50% of the course fee is required to secure the intensive course and dates.
    - Balance: The remaining balance is due according to the payment schedule stated at booking (commonly one week before the course starts).
    - Refunds and admin fees: If you cancel after payment, deposits may be non-refundable. Cancellations within 48 hours of a session may incur a full session charge. If a refund is due, an admin fee (e.g., £20) may apply.
    - Assessment session: If an assessment is required, it is payable upfront. If cancelled within 48 hours, the full cost may be charged; earlier cancellation may entitle a refund minus the admin fee.
    - Statutory rights: This agreement does not affect your statutory rights.

    The Driving Test

    - Booking: Driving tests must be booked by the Student via the GOV.UK website. The Instructor should be informed of test dates and times as soon as known.
    - Test priority: Driving tests take priority over regular lessons. Lessons may be postponed to accommodate a test.
    - Vehicle use for the test: The Instructor reserves the right to withhold the training vehicle for the test if the Student’s driving is deemed unsafe. Repeated unsafe behaviour may result in test failure.
    - Test cancellations: Follow DVSA requirements for changing tests. The Instructor is not liable for DVSA test cancellations. The Student should be ready to adjust plans as needed.

    Complaints
    - If a Student has a complaint, they should raise it with the Instructor in the first instance. If unresolved, the Student may contact info@passitdrivingacademy.co.uk for further assistance.

    Your Statutory Rights
    - Nothing in these terms reduces your statutory rights relating to faulty goods or services. For concerns about statutory rights, contact your local Trading Standards or Citizens Advice Bureau.

    Data Protection
    - Personal data will be processed in accordance with the UK GDPR and Pass It Driving Academy’s privacy policy. See the privacy policy for details.

  • GDPR PRIVACY NOTICE

    UK GDPR came into force on 31st December 2020 with an Act of Parliament.


    This privacy notice has been produced to help you understand why I, your Pass It! Driving Academy instructor, require to obtain/store your personal information, how it will be used, who it might be shared with and how long it might be kept. The notice will also remind you of the rights you have under the General Data Protection Regulations (GDPR). Where the information is not necessary to deliver the services you require from me it maybe necessary for me to obtain your consent to either collect such information in the first place or use it for other purposes than you would legitimately expect. Below is a list of the personal Information I may collect and how it will be used.


    1. With your consent, I may need to keep your credit/debit card details for the purpose of receiving payment from you for my services or products. This information will be stored in a secure manner to ensure your Personal Data rights are not breached until such time as you cease to use my services or expressly require me to erase/destroy such information if sooner. In either case the information will be disposed of in a secure manner.


    2. I will need to keep written and secure digital records of all payments made, lesson appointments booked and lessons delivered for the purpose of maintaining accurate accounting records as is legally required of me for 6 years. At that point the accounts records and any supporting personal information will be disposed of in a secure manner. This information will be held in my paper-based / digital diary, my paper based student record systems, my accounts and potentially digitally on the Pass It! Driving academy systems.


    3. I will require your name, address, email address, telephone number(s), date of birth, and provisional driving licence details for the purposes of: Providing my services as a Pass It! Driving Academy instructor so that I may contact you, give in legitimate pursuit of this role until my services are no longer required by you. Such information will be recorded in my paper-based student record systems and potentially on the Pass It! Driving Academy systems. Booking either a Theory or Driving Test on your behalf. Providing you with promotional offers in relation to my business with your expressed permission until you otherwise remove such consent. Maintaining accurate accounts records as is legally required of me for a period of 6 years.

    4. Our cars maybe fitted with dash cams (front and/or rear). This will continuously record footage externally and audio internally on a loop and overwrite unless the instructor saves a clip. If the instructor saves a clip they will notify you and you will be able to request a copy in writing. This is mainly for purposes of insurance and protection of our students and instructors.


    5. I will hold records of your test failures and passes noting where the driving faults occurred on your test report in my paper-based student record systems so that I can monitor my own personal performance in this regard.


    6. With your consent, upon passing the driving test I would like to take a photograph of you and a written review for the purposes of promoting my services as a Pass It! Driving Academy instructor and for the promotion of the Pass It! Driving Academy brand name as a whole on various secure digital platforms and written media with your expressed permission until you otherwise remove such consent. Please note on social media Pass It! Driving Academy cannot prevent this review/ photo from being shared or copied by others but Pass It! Driving Academy would quickly delete all copies on such platforms under our control if you request so.

    Any personal information not disposed of as stated above will be securely destroyed following 6 years from being received unless you have consented to enable me to retain it for longer.

    If you want to make a complaint about the way I or Pass It! Driving Academy have processed/used your personal information, you can contact the Information Commissioner’s Office ICO, as the statutory body in the UK which oversees data protection law by visiting www.ico.org.uk/concerns.
