Copyright Information and Infringement Penalties* This field is required.
It is understood by Client(s) that Photography by Tammy KC (Tammy Mallett) will retain all Copyrights to images taken. No one is not allowed to infringe upon copyright protection. Infringement includes, but not limited to editing, duplicating, and promoting products, persons, companies. No one and no company is allowed to do any of the above without proper permissions and proper licensing from Photography by Tammy KC. This includes, but is not limited to Client(s), family, friends, venues, or other companies. These images are for personal use only for Client(s) only and are not to be used commercially in any manner. If images are to be used for commercial reasons, clients must tell the company to contact photographer at tammymallett@icloud.com. If at any point, copyright infringement occurs, including but not limited to editing, duplicating, using commercially with no permission, etc, any and all parties participating in the infringement will be penalized. The penalties are $5000 per image, per incident. Client is allowed to make reproductions of images for their own personal use only. Prior to entering any photos into photo contests, written permission must be obtained by Photography by Tammy KC. You may post any of your photos on Social Media outlets including but not limited to Facebook, Instagram, Reddit; However a link to Photography by Tammy KC's website or facebook page is required. You may not re- edit or have another photographer edit the digital images without Photography by Tammy KC's written permission.

Session Information* This field is required.
This contract, dated today, is for services and products related to a photography session (hereafter “session” or “the session”) to take place at the above time and Photography by Tammy KC studio. Photographer and Client are to arrive for the session on time and ready for the session. If Client is late, the time lost will not be made up at the end of the session, nor will the session be refunded in part or in full. If client is 30 minutes or more late for a full hour session or half of the session time, the session will be cancelled and Photographer will leave (unless otherwise agreed upon via text or email). A refund will not be issued and a make-up session will not take place unless client pays for another session. Hair and Make Up are NOT included in your CELEBRATE YOU Boudoir Session. You are responsible for your hair and make and any outfits that you would like to be photographed in for your session. Photography by Tammy KC offers an array of services and such services may have pricing changes at any moment, without notification, unless this contract is signed by Client(s). Photographer and Client have discussed pricing for above stated session and all dues must be paid prior to session. In order to book a session, the retainer fee, a non-refundable fee, of $25- $50 of session fee must be paid. If contract is not signed and the retainer fee has not been paid, then your session is not booked. Photography by Tammy KC has the right to sell the time and date to another client if deposit and contract have not been received. . Clients must pay remainder of fee prior to session. Photography by Tammy KC accepts cash or PayPal. Checks are only accepted by repeat clients. In the event that a check is returned or "bounced" the client is responsible for a $100 return fee plus the amount of the check. If all session fees are not received then no photos will be edited, posted on social media, or delivered until full payment is received.

Deposit for Session Booking* This field is required.
It is of upmost importance for client to make his/herself and any other persons involved in session available for session date and time. The Retainer Fee is not refundable under any circumstance if client wants or needs to cancel. The Retainer Fee will be kept for liquidated damages or at Photographer's determination, session may be rescheduled.

Client Communication* This field is required.
Client understands that he/she/they are responsible for speaking with Photographer for this session. Other parties may pay, but this contract is between Photographer and above Clients. Session, Ordering Appointment, and Contract will only be discussed with Client(s).

Fees* This field is required.
Client(s) is responsible for Deposit and Session Fee. Client may choose to purchase additional photos besides the amount promised in their package at the fee discussed by Photographer. Cash and PayPal accepted forms of payment.

Service Provided* This field is required.
It is understood by Client(s) that Photographer will provide a photography service. This service will be done as artistically desired by Photographer. It is understood that Photographer is not under any obligation to edit, pose, or bring or add props for the gallery or session to Clients liking. Client is hiring Photographer for her style. This style includes, but not limited to editing, posing, the use of (or lack of) props. Photographer will strive to present photos in a workman-like manner but is not required to cater to specific aesthetic preferences of Client. Photographer does not guarantee any specific pose or location will be captured and/or in the gallery.

What does the Photographer guarantee with your session?* This field is required.Please choose one:
For a One hour Session: Clients will receive Photographer's time and talent, a minimum of twenty hi-res images in a private online gallery to download within 7 days of photo session date, and a print release.
For a 30 Minute Session: Client will receive 5-10 hi-res images for a 30 minute session, and a print release. As agreed to at booking.

Digital Format* This field is required.
Client(s) will receive images in hi-res JPEG format. Client will not receive RAW or unedited Files under any circumstances.
No actual prints are included in this session. You will download to your computer.

Processing Time* This field is required.
Once your session is completed, Photographer will edit images from your session. This may take up to seven days from date of session or advertised time.

Print Release* This field is required.
A print release will be given to Client to print at their choice of lab. Client releases photographer from any quality issues with any consumer lab. Client will need to speak to the lab they used with any issues. You may also choose to have your images printed at a discounted price from the professional lab through your private gallery. You may also purchase other products such as mugs, blankets, and albums via your private gallery.

Limit of Liability* This field is required.
Although extreme care will be taken with the images and photographs taken, the Photographer limits any liability for loss. Damage or failure to deliver pictures for any reason would result in the return of deposit/retainers. Client acknowledges and understands the the Photographer can not guarantee that any specific photo will be taken. The Photographer will make every effort to accommodate Client's wishes and acknowledges that there is a reasonable expectation of professional quality consistent with the Photographer's work. The Photographer can not be held liable for factors over which they have no control which may affect the quality of the images, such as Client lateness and photogenicity. Additionally, the Photographer can not be responsible for the effects of the subjects' physical appearance including body position, facial expressions, blinking, or outfits. If a client wears prescription glasses, there may be glare or reflections in the lens that is not able to be fixed. If a client wears transition lenses, it is suggested that the client takes off the glasses. Photographer is not responsible for fixing glare, reflections, or the darkening of lenses due to transition lenses. The Photographer has the right to refuse to produce any image that could violate libel or copyright laws, or in the course of it's production could cause or contribute to bodily injury, death, equipment damage, or destruction. The Photographer will remain professional at all times. This is a BOUDOIR CELEBRATE YOU session for ONE female. You are welcome to bring one female friend with you to the session for support.

Rescheduling, Rescheduling Fees for Sessions and Ordering Appointments* This field is required.
Photography by Tammy KC allows for one (1) reschedule for session only at no additional cost. A Rescheduling Fee of 25% of session fee is due prior to each new reschedule after the first reschedule. Reschedule must be done prior to 72 hours before session.

Photographer Reschedule* This field is required.
Photographer is not responsible for cancellations or reschedules due to weather, Covid, sickness, or other issues beyond her control. In case Photographer is unable to photograph session for any reason beyond her control, Photographer will contact Client(s) as soon as possible for rescheduling. If Client is not willing to reschedule, Client will not receive refund of retainer fee.

Client Responsibility and Photographer's Right to Withdrawal.
It is client's responsibility to read the contract fully, to understand it, and to follow. Clients are required to make sure all parties involved (whether directly or indirectly) are to follow the rules outlined in the contract.

Right of Withdrawl
Right of withdrawal: Photography by Tammy reserves the right to withdrawal upon delivery of new information, changes to agreed circumstances, or other factors such as non-cooperation, changes in location, facilities or available times, missed appointments, late payments, etc. if withdrawal is initiated, all monies excluding the deposit will be refunded.

Data Loss Prior to Delivery* This field is required.
In case of Data Loss via SD Card prior to delivery of gallery: In this situation, Photography by Tammy KC will refund all fees paid or will schedule a session at no cost to client.

Data Loss AFTER Delivery* This field is required.
Data Loss post delivery of images: Once images have been delivered to client, Photography by Tammy KC is not responsible for data loss. Clients are responsible for downloading images in a timely manner, typically 30 days unless stated elsewhere and are responsible for storing images in at least two safe places such as online storage and an external hard-drive.

Image Archival* This field is required.
Images will be archived after 90 days. This does not guarantee safe archival If client loses images after the 90 days, Client is responsible for paying to have images released from the archives. This fee is $50 per occurrence.

Prints and Products* This field is required.
Photographer will not be held responsible for any digital images, prints or products after the Product Delivery Contract has been signed.

Reshoots* This field is required.
Reshoots will be at the discretion of the Photographer and if Photographer denies a reshoot and refund for original session will not be given.

Safe Sessions* This field is required.
Every effort from Photography by Tammy KC will be made to ensure a safe session. However, each session has it's own possibility for scary or dangerous situations. (For example, this can include the possibility of being robbed, injured or an outdoor session will always run the risk coming upon venomous insects and reptiles.) These situations are beyond Photographer's control. Every individual involved in the session must always keep safety in mind and must be self aware of his/her surroundings.

Boudoir Session
It is Client's sole responsibility to tell Photographer that he or she is not comfortable with a pose, nudity, or both. The session will not stop, but Photographer will move onto a different pose and/or allow Client to dress as he/she feels comfortable. Photographer will not be held responsible or accountable if client does not tell Photographer of his or her discomfort with a pose or with nudity. If at any time, Client wants to stop session due to mental, emotional, or physical discomfort, Photographer will not issue a refund.

Respect and Dignity* This field is required.
The Client(s) agree to undertake best efforts to ensure the Photographer and the photographer’s staff are treated with respect and dignity and that the Photographer is provided with a safe working environment. Should an issue arise, the Photographer will make reasonable effort to handle the matter. If the situation is not remedied in a reasonable amount of time, the Photographer retains the right to cancel the remainder of the event. Safe working environment issues include, but are not limited to, any instances of sexual harassment, violence, threats, or other similar behavior that would lead a reasonable person to feel unsafe in such an environment. In the event of such cancellation, the Client(s) will not be entitled to any refund.

Release of Responsibility / Agreement to hold Photographer harmless* This field is required.
It is understood that Photography by Tammy KC shall not be held responsible for anything that is outside her control. The following is included, but not limited to situations beyond Photographer's control: Acts of God, Illegal Acts, Data Loss.

Sickness & Fever
In order to protect clients and her own family, Photography by Tammy needs you and all parties well at your session. If you, your family, or anyone that you have been around in the last 72-96 hours has had the stomach virus, a fever of 99.9 or more, Covid exposure or positive test within last 10 days, the Flu, Mumps, Measles, Chickenpox, Hand, Foot, and Mouth, or any other contagious illness, please notify Photography by Tammy immediately to reschedule. I work with a lot of newborns and infants and their immune system isn't fully-developed and they aren't allowed the vaccinations that could save their life yet. I do not want to spread any illness to the infants, other clients, or my own family. If Photography by Tammy KC attends a session where it is believed that any party is sick or has a contagious illness, Tammy has the right the stop the session and leave. As long as Client is upfront and forthcoming about illness, Photography by Tammy will reschedule session.

Model Release.

At Photography by Tammy KC, we care about your privacy. You have the right to choose which images can or cannot be placed online. The model release will allow Photography by Tammy KC to place images from this session on Facebook, Instagram and other Social Media Outlets, as well as Websites and the general world wide web. With CELEBRATE YOU sessions, you will be given a PRIVATE online viewing of your gallery where you can pick a minimum of 3-5 images for Photography by Tammy KC to use in her private group and for the less revealing images to be on her website, IG, and FB Page. You do have the right to decide to not allow any of the images on the public sites but to still be posted in the PRIVATE SECRET CELEBRATE YOU facebook group page.

Photos/Videos taken by Client or Client's GuestMost photographers do not allow any photos or videos to be taken by cell phones or any other camera or video during their session. At this time, Photography by Tammy KC WILL allow this - however copies must be given to Photography by Tammy KC via email or text of all images and videos and NONE can be posted on social media with out text or email permission from Photography by Tammy KC.

Legal and Binding Contract* This field is required.
