PLAYFORGE ATHLETICS — TENNIS PROGRAM
PARTICIPATION WAIVER AND RELEASE OF LIABILITY
READ CAREFULLY. THIS IS A LEGAL DOCUMENT.
By registering for or participating in PlayForge Athletics LLC tennis programs, I, the undersigned, agree to the following. I am signing either as the parent or legal guardian of a minor participant, or as an adult participant signing on my own behalf. In this document, "Participant" means the person receiving instruction, and "I" means the person signing.
**1. Assumption of Risk**
I understand that participation in tennis instruction and athletic development involves physical activity that may result in injury. These risks include, but are not limited to: sprains, strains, and fractures; overuse injuries such as tennis elbow, and wrist, shoulder, or rotator cuff injuries; muscle pulls and tears; slips, trips, and falls on the court surface; being struck by a tennis ball or racquet; eye injuries; collisions with other participants, net posts, fencing, or equipment; dehydration, sunburn, and heat-related illness during outdoor or warm-weather play; and other serious bodily harm, including concussion.
I knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, including those that may arise from the ordinary negligence of PlayForge Athletics LLC, a Texas limited liability company, together with its owners, members, managers, officers, employees, independent contractors, volunteers, affiliates, and agents (collectively, the "Released Parties").
**2. Waiver and Release of Liability**
In consideration of the Participant's participation, I, on behalf of myself, the Participant, and our heirs, executors, and assigns, voluntarily release, waive, and discharge the Released Parties from any and all claims, demands, or causes of action arising from or related to participation in PlayForge Athletics LLC tennis programs.
THIS RELEASE EXPRESSLY INCLUDES ANY AND ALL CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
This release does not apply to claims arising from gross negligence, intentional misconduct, or willful acts by the Released Parties.
**3. Medical Authorization**
In the event of an injury or medical emergency, I authorize PlayForge Athletics LLC staff to provide or obtain emergency medical treatment for the Participant. I understand that I am solely responsible for any associated medical costs.
**4. Indemnification**
I agree to indemnify and hold harmless the Released Parties from any claims, demands, or legal actions brought by or on behalf of the Participant, or by third parties, arising out of or related to participation in the program.
**5. Media Release**
PlayForge Athletics LLC may photograph or video participants during activities for use in promotional materials, including websites, social media, and flyers. By signing below, I grant permission for the Participant's image or likeness to be used without compensation or further notice.
If you do not consent, you must submit a written opt-out by email to PlayForgeAthletics@gmail.com with the Participant's full name. Verbal opt-outs or checkbox selections alone are not valid.
**6. Acknowledgment of Minor Waiver Limits**
Where the Participant is under 18 years of age, I understand that the enforceability of this waiver as it applies to claims by or on behalf of the minor Participant may be subject to judicial review under Texas law. This section does not apply where the Participant is an adult signing on their own behalf.
**7. Physical Condition and Participation**
I certify that the Participant is physically able to participate in tennis and athletic activities and that I have disclosed any known medical conditions, injuries, or limitations, including any prior elbow, shoulder, wrist, knee, or ankle injuries relevant to racquet sports. I understand that PlayForge Athletics LLC does not evaluate medical fitness and relies on my representations.
**8. Rules and Conduct**
I understand that participants are expected to follow all instructions and remain within designated training and court areas. I understand that PlayForge Athletics LLC may suspend or remove the Participant from an activity or session if staff determines, in their sole discretion, that participation presents a safety risk or a disruptive behavior issue. Any financial consequence of a removal, or of ending the coaching relationship, is addressed in the Terms and Conditions referenced in Section 9.
**9. Business Terms**
Pricing, lesson scheduling, cancellation and rescheduling, no-show charges, packages, refunds and credits, and payment, including keeping a card on file for automatic charges, are governed by the PlayForge Athletics Terms and Conditions published at www.playforgeathletics.com/terms.html. I confirm that I have read those Terms and agree to them, and I understand that they may be updated from time to time, with the current version always available at that address.
**10. Severability**
If any portion of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
**11. Governing Law**
This waiver shall be governed by the laws of the State of Texas, and any legal action shall be brought exclusively in the state or federal courts located in Galveston County, Texas.
**12. Acknowledgment and Signature**
I certify that I am either the parent or legal guardian of the Participant, or the adult Participant signing on my own behalf, and that I have read and understand this agreement in full.
