I acknowledge the contagious nature of COVID-19 and that the CDC and many other public health authorities recommend practicing social distancing. I further acknowledge that the City of Brentwood cannot guarantee that I, my family, guests, and/or vendors will not become infected with COVID-19. I understand that the risk of becoming exposed to and/or infected by COVID-19 may result from the actions, omissions, or negligence of myself, my guests, and others, including, but not limited to, City staff. I voluntarily seek services provided by the City of Brentwood and acknowledge that I am increasing the risk of exposure of myself, guests, family, and/or vendors. Notwithstanding the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to hold my event and rent the City facility. I will follow the applicable laws and guidelines during the event and my time on the premises.

I further agree that I understand the risks and accept sole responsibility for any injury to myself or members of my group or event, including, but not limited to, personal injury, disability, and death, illness, damage, loss, claim, liability, or expense, of any kind, that they or I may experience or incur in connection with participation in my event reservation or rental taking place at the City of Brentwood facility. I hereby release, covenant not to sue, discharge, and hold harmless the City, its employees, officers, agents, and representatives, of and from any claims related to COVID-19, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I further agree to indemnify and hold harmless the City of Brentwood and its employees, officers, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in or attendance at my event. I agree that this Waiver of Liability shall be governed by and constructed in accordance with Tennessee law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Waiver of Liability as a whole. This Waiver remains in effect until the state of Tennessee lifts all COVID-19 related mandates. IN SIGNING THIS WAIVER, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Wavier of Liability and Indemnification Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen(18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.
