Rooted Markets

Please read the following General Release and Waiver Liability

Waiver and Release:

1. I participate in the 2024/2025 Rooted Markets events, including but not limited to the Lakeway Nights Market and Treaty Oak Night Market, at my own risk and hereby release and forever discharge all claims against Rooted Markets, Lakeway Nights Market, Treaty Oak Night Market, Renée Roberts, RJ Productions, Lohman's Partners, Ltd, the Lohman's Crossing Center ("LCC"), Treaty Oak Distilling Co., High Basin Brands, the Treaty Oak Distilling premises ("TOD"), including all officers, employees, volunteers, agents and representatives (hereinafter collectively "Released Parties") from any liability arising from these events or the use of LCC or TOD premises for those purposes. I further agree to hold the above parties harmless from any accident, incident, injury, death or damage arising from my use of LCC or TOD premises during an event, except only to the extent caused by the sole negligence or intentional misconduct of any of the released parties.
2. Acknowledgment and Assumption of Risk: I acknowledge that in the course of the Rooted Markets events, including but not limited to the Lakeway Nights Market and Treaty Oak Night Market, I or my agents or representatives may cause injury, death, property damage or other harm to third parties. I accept and voluntarily incur all risks of any such injuries, damages, or harm which arise during the Rooted Markets events, except only to the extent caused by the sole negligence or intentional misconduct of the Released Parties.
3. Indemnification and Hold Harmless: I agree to indemnify and hold the Released Parties from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys' fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits brought against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from the Rooted Markets events, including but not limited to the Lakeway Nights Market and Treaty Oak Night Market, except only to the extent caused by the sole negligence or intentional misconduct of any of the Released Parties.
4. Insurance: The Vendor agrees to have his/her certificate of insurance coverage and it is necessary for every week of attendance to the Rooted Markets events, including but not limited to the Lakeway Nights Market and Treaty Oak Night Market.
5. In the event that my tent or any part of my booth causes damage elsewhere, I will be responsible for those damages. I understand parking is available at the designated vendor parking. Parking information will be provided prior to market.
6. I understand there are NO REFUNDS if I cancel or no show. Once my participation date or dates are confirmed and payment is processed they are immutable. ***If Rooted Markets cancels for any reason, and I have made a payment, they will move that payment to the next week I am scheduled.

Other: I agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Texas. I also agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
