If yes, Shannon Cothren Photography has the right to move your session up to 4 weeks after a negative Covid19 test is received. Please be mindful that Shannon Cothren works with many adults and children/newborns and takes as much precaution as possible to protect her clients and her family from any illness. Shannon Cothren Photography Session Terms & Conditions Agreement: This is a binding contract between the person(s) whose name(s) appear on this agreement form (“Client”) and Shannon Cothren Photography for services of a photography session. Session will be fulfilled as described in this document to the best of Photographer’s abilities and concludes the understanding of both parties. Any modifications must be made in writing, signed by both parties, and attached to the original agreement. Client will be held responsible for any legal fees or collection costs incurred by Photographer in relation to the enforcement of this contract. In the event that any portion of this Agreement is found to be invalid or unenforceable, the remainder of the contract will remain valid and enforceable. Should one or both parties fail to enforce any portion of this Agreement it will not constitute a waiver of any other portion of this Agreement.* This field is required.By choosing agree you are agreeing with the term directly above. Session Fees, Payment, and Photo Delivery: Client agrees to pay photographer a retainer at the time of booking to secure their appointment date and time. This is a 50% non-refundable retainer fee that goes toward client's session to insure the clients time and date stay available to the paying client only. The nonrefundable retainer is NOT refundable under any circumstances. The remaining balance of the session fee is due in full on the same day of the session. The session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and digital images (amount depending on session type chosen) to be stored through ShootProof.com. Additional editing is available at an additional expense to be determined by photographer. Additional prints or digital images may be available for purchase. Final galleries are to be downloaded by the client no later than 3 weeks after delivery date. All final galleries will be taken down from ShootProof.com 3 weeks after final delivery and a re-uploading fee of $35 will be required for client to have 2 additional weeks to access their final gallery. All final galleries are deleted from Shannon Cothren Photography's digital business storage after 1 year. Images will not be processed and/or prints will not be ordered until payment in full is received. PayPal, Cash, Venmo, and Cashapp are acceptable forms of payment. The client will receive their proofing gallery within 6-14 business days after their session is completed. After client has chosen their favorite images and has shared their favorites with Shannon Cothren, the client will receive their final, fully edited gallery to download approximately 14 business days after selecting their favorites. Rescheduling: The client(s) has 3 months to schedule their photography session. If the session is not scheduled within 3 months of the nonrefundable retainer payment, a new nonrefundable retainer payment will be issued before any further scheduling. The client(s) is allowed 3 re-scheduled appointments. If after the 3rd re-scheduled appointment the client still has not proceeded with their session, Shannon Cothren Photography is given the right to re-issue an additional nonrefundable retainer to continue to reschedule client(s) appointment. * This field is required.By choosing agree you are agreeing with the term directly above. Re-Shoots, Refunds, and Cancellations: Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds (after session has already been photographed) will not be given for poor choices of clothing, make-up, facial expressions, hair, cooperation of participants, or by not following the recommendations of the photographer. **There is no guarantee of sleepy poses for newborn sessions that are scheduled for after the 5-14 day old period.** The session fee is not refundable in any circumstances. Print fees are not refundable once prints have been ordered. In the event that the client cancels their session before the session date, the nonrefundable retainer will not be refunded. If the client has paid in full and decides to cancel, 50% of the entire session fee will be refunded immediately and the previously scheduled session will be void.* This field is required.By choosing agree you are agreeing with the term directly above. Damage of Photographers Property: The client is 100% responsible for replacing any professional equipment, props, or backdrops that are damaged by the client, client's child, participant in session, or personal pet during their photography session. Payment for replacement of a prop or any photography gear that was damaged will need to be paid immediately or said client will be banned from any further photography sessions with Shannon Cothren Photography and legal action will be taken.* This field is required.By choosing agree you are agreeing with the term directly above. Printing, Image Copyright, and Penalty: Shannon Cothren Photography retains all copyrights to all images created during client’s session. A modified print release is included with all packages. Shannon Cothren Photography does NOT allow printing through Walmart Photo Labs or Drug store labs including Walgreens or the like). The printing labs that are allowed are as followed: Nations Photo Lab, Mpix.com, Millers Photo Lab. If you have a lab that you'd like to request to use, please discuss it with Shannon Cothren before printing. Digital files should only be printed for personal use. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s permission. It is illegal to steal (screen shot) any image created by Shannon Cothren Photography without permission. This applies to "sneak peek" images, images posted in an online proofing gallery, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file. Digital images and prints purchased from Shannon Cothren Photography can only be used for personal use and not for commercial, political, or any for-profit uses. A separate commercial release can be purchased if the images need to be used for anything other than personal use. Limitation of Liability: Extreme care will be taken with respect to exposure, transportation, and processing of photographs; including using professional grade equipment. In the unlikely event of the client’s photographs being lost, stolen, or destroyed for reasons within or beyond Photographer's control, Photographer’s liability is limited to the return of all payments received. The limit of liability shall not exceed the contract price. Shannon Cothren Photography is not responsible for the damage of portrait prints or discs after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt. Shannon Cothren Photography is not responsible for any injuries inflicted upon any participating parties during any scheduled photography session. *Shannon Cothren Photography will not be held liable for known or unknown children's allergic reactions from cake smash portrait sessions in which the child being photographed is eating cake made by a local bakery. Client(s) are responsible for their children and for themselves and release Shannon Cothren, the photographer of Shannon Cothren Photography, from any claims against their person or her business.* This field is required.By choosing agree you are agreeing with the term directly above. Limitations of Liability: Client health release, Shannon Cothren Photography is not responsible for any and all illness or pre-existing illness (including Coronavirus) contracted by participating parties before, during, or after the photography session within Shannon Cothren Photography's in-home studio or during/after an outdoor photography session. Model Release: I (client(s) named above) hereby give to Shannon Cothren Photography the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which he/she may be included with others: a) To copyright the same in Shannon Cothren Photography’s name or any other name that he/she may select; b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising (social media; IE Facebook or Instagram) and trade, and; I hereby release and discharge Shannon Cothren Photography from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.* This field is required.By choosing agree you are agreeing with the term directly above.
