Thank you for choosing me to support you in your trademark journey. Please take a moment to read through how this process works before submitting your form.
Step 1: Trademark Research & Consultation
To begin, there is a $50 research fee required to start your trademark application. This fee covers comprehensive research on the name you wish to trademark, including checking for potential conflicts with existing trademarks and assessing availability for registration.
Once you've submitted your trademark questionnaire and paid the research fee, I’ll conduct the research and schedule a consultation with you. During our consultation, I will review the findings with you and provide guidance on whether your name is clear to move forward with filing.
Note: This application covers one (1) trademark only. If you are filing both the word mark and the design (art/logo) version of the same trademark, there will be an additional $125 fee. If the trademarks are for different names, a new application must be submitted for each.
Step 2: Trademark Filing Options
After the consultation and research is complete, if you choose to move forward with filing:
$250 – Preparation & Filing Only: This includes the preparation of your trademark application and filing with the U.S. Patent and Trademark Office (USPTO). I will keep an eye on any actions that may impact your trademark and update you accordingly. Your $50 research fee will be credited, if you wish to move forward.
Step 3: Office Action Policy
If I identify conflicts in your search results and you choose to move forward anyway, and later receive an Office Action because of those conflicts, there will be a $500 fee to have me respond to that notice.
However, if my search showed no conflicts and you still receive an Office Action, I will draft and file your response at no additional charge.
Step 4. Client Responsibilities
You agree to:
- Provide accurate and complete information during this process
- Respond to emails and requests in a timely manner
- Understand that success in the trademark process is not guaranteed
Step 5: Communication and Updates
All updates will be sent to the email address you provide. You are responsible for checking your email regularly to avoid missing deadlines or important notices from the USPTO.
Step 6: Agreement & Disclaimer
By proceeding with this process, you will be required to sign an agreement that acknowledges I am not a licensed attorney or lawyer. I do not provide legal advice. My role is to assist you in properly preparing and filing your trademark application based on experience and information.
