  • SERVICE AGREEMENT

    This Agreement is entered into by The Addie Condominiums (“Association”) and the customer whose name is shown on the first page of this Application (“Customer”).

    By making application for water service, Customer represents that it is duly authorized to request water service for such service address and to make the agreements set forth in this Service Agreement. Customer’s acceptance of service constitutes Customer’s agreement to the following terms and conditions:

    1. The Customer shall be responsible for payment of all applicable rates, fees, and charges due for water service in accordance with the tariff of the Travis County Water Control Improvement District # 10 (the “Utility), as amended from time to time (a copy of the tariff can be found on the Utility’s website here or requested through our office). Payments must be received by 4:30 p.m. on the due date. A late fee will added to the account balance after the due date.

    2. Customer agrees to comply with the Utility’s rules and policies governing water service as well as any rules set forth in the Community Manual or Declaration (defined below), as adopted and amended from time to time.

    3. In the event of nonpayment of water service, service may be discontinued and a reconnect fee and service call(s) fee(s) charged when the account becomes delinquent. A Customer’s obligation to make timely payments for service rendered is not released or diminished because a water bill(s) was/were not received.

    4. The Customer shall install, maintain and repair, at his own expense, all private water service lines from the foundation of the house or building to the main water line. Customer shall maintain the service line in good operating condition and clear of obstruction, defects or blockage. Customer acknowledges and agrees that water service lines exclusively serving Customer’s Unit are a part of the Unit, as more particularly described in the Declaration of Condominium Regime for The Addie Condominiums, recorded or to be recorded in the Official Public Records of Travis County, Texas, and as amended from time to time (the “Declaration”).

    5. After service commences in the name of the Customer, such service shall be deemed to continue until the Association is notified by its billing agent, Si Environmental, LLC, or by the Utility that service should be discontinued. Rates and charges will continue to accrue to Customer’s account until such notice is given and may result in collection activity to recover unpaid amounts against Customer or termination of service for nonpayment.

    6. By executing this Agreement and receiving water service, Customer acknowledges and agrees that it is subject to all terms and conditions of water service as set forth in the Utility’s tariff and the Association’s rules and regulations, and policies, all as amended from time to time. Customer further acknowledges and agrees that such terms and conditions shall constitute a contract between the Association and Customer, and may be enforced as such.

    7. Each service connection is for the sole use of the Customer and is to serve service to only one (1) Unit. Extension of pipe or pipes from one Unit to another, to share or resell service to any other persons, dwellings, business, and/or property, is prohibited.

    8. The Association and/or Utility shall have access to water facilities and equipment located upon the Customer’s property at all times for any purpose connected with its operations, and upon discontinuance of service, the Association and/or Utility shall have the right to remove its equipment from the Customer’s property (if any). The Association, Utility, or their designees may trim landscaping, clear debris, or otherwise ensure clear access to its facilities.

    9. In accordance with the Declaration, the Customer has granted access to the Association and the Utility via access easements for the purpose of installing, maintaining and operating such pipes, lines, meters, valves, and any other equipment which may be deemed necessary for the provision of water service to the Customer’s Unit or to future customers. The Customer agrees not to interfere with the Association’s or Utility’s employees in the discharge of their duties. The Customer will not permit anyone except Association employees or Utility employees to tamper with or interfere with any of the water equipment installed on the Customer’s premises.

    10. The Customer acknowledges and agrees that water service is provided by the Utility and will be submetered by the Association and billed to the Customer based on the Customer’s monthly consumption multiplied by the average cost per gallon. The average cost per gallon shall be determined from the amount billed to the Association by the Utility, which average cost shall not include charges for water to common areas. The Customer further acknowledges and agrees that the Association has appointed Si Environmental, LLC (the “Billing Agent”), to act on its behalf to bill Customer for water service.

    THE CUSTOMER HEREBY AGREES TO WAIVE, RELEASE, AND HOLD THE ASSOCIATION AND THE BILLING AGENT HARMLESS FROM ANY CLAIMS, DAMAGES OR SERVICE INTERRUPTIONS RESULTING FROM WATER LINE BREAKS, INCLUDING WITHOUT LIMITATION, DAMAGES TO PERSONS OR PROPERTY, DIRECT DAMAGES, SPECIAL DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, OR LOSS OF PROFIT OR REVENUE.

    If the Customer fails to comply with the terms of this Service Agreement, the Association and/or Utility may, at their option, terminate service. Any expense associated with the enforcement of this Service Agreement shall be billed to the Customer.

    CUSTOMER ACKNOWLEDGES THAT THE ASSOCIATION MAY CONTRACT WITH A THIRD PARTY TO BILL AND COLLECT RATES, FEES AND CHARGES DUE FOR WATER SERVICE FURNISHED BY THE UTILITY, AND CUSTOMER HEREBY AGREES THAT IT WAIVES, RELEASES AND WILL HOLD HARMLESS THAT THIRD PARTY FROM ANY LIABILITY, COSTS, CLAIMS AND DAMAGES IN ANY WAY RELATED TO THE PROVISION OF THE WATER SERVICE BY THE UTILITY TO THE CUSTOMER’S UNIT OR TO THE ADDIE CONDOMINIUMS.
    ANY DISPUTES RELATING TO THE COMPUTATION OF THE CUSTOMER’S BILL FOR WATER SERVICE OR FOR THE ACCURACY OF ANY SUBMETERING DEVICE WILL BE BETWEEN THE CUSTOMER AND THE ASSOCIATION.

    For informational purposes, the average monthly bills for water service during a calendar year and the highest and lowest bills for water service during a calendar year are available upon request by sending an email to atx.customerservice@sienviro.com

    Water service at The Addie Condominiums is subject to the submetering rules promulgated by the Public Utility Commission of Texas, as amended from time to time. A copy of the current rules A copy of the current rules may be found here on the Commission's website, or you may request a copy from our office.

    Unless prevented by an event of force majeure, the Billing Agent will cause the Customer’s submeter to be read monthly on or about the 3rd of each month. Each monthly bill will be produced and mailed on or about the 6th of every month, and each bill for water service is due not later than 16 days after the date of the bill.
    If a leak occurs in a Customer’s Unit, the Customer is solely responsible for repairing that leak and for any water discharged as a result of that leak. If a leak occurs in a Common Area, the Association will cause the leak to be repaired within 3 days (absent an event of force majeure).

    The Customer has the right to receive information from the Association, the Billing Agent, and/or the Utility to verify its bill. Please send any requests for information in writing to atx.customerservice@sienviro.com
