Springfield Amenity Center Rental Contract
Please read the following contract completely. It is your responsibility as the Renter to understand all of the rental rules and guidelines outlined in this contract. If you have any questions about this contract, contact the springfield@kuester.com.
Rental Rules:
- Amenity Center alarm is armed at 11:45 PM, all owners and guests must leave the facility prior to this time. Please note this alarm is monitored and will automatically dispatch Fort Mill PD.
- The Lessee must ensure the Amenity Center is secured and locked prior to departing. Failure to follow the locking procedures will result in an immediate $100 fee.
- The Lessee must be a current Springfield property owner or a tenant with an approval letter from the owner.
- The Lessee must be present for the duration of any function for which he/she is renting the facility.
- The Lessee assumes the responsibility of the property of Lessee, members, dependents, guests, and invitees. The Lessee acknowledges that the property of members, dependents, guests, and invitees will not be insured against loss or damage, nor will there be any insurance coverage for any damage caused to the Community Association facilities by Lessee, members, dependents, guests and invitees. The Lessee agrees to indemnify and hold Lessor, and its officers, directors and members, completely harmless against and from any and all damages, causes of action and costs, including attorney’s fees, incurred by Lessor, and its officers, directors and members, for personal injury and damage to property arising out of the use of the Community Association facilities by Lessee and Lessee’s invitees.
- The sale of alcoholic beverages upon any portion of the premises of Lessor is strictly forbidden. If Lessee desires to serve alcoholic beverages to Lessee’s guests at a function without charge, Lessee shall be solely responsible for supplying, handling, dispensing and removing the same at the completion of the function and for complying with all laws, ordinances and, regulations regarding the serving and consumption of alcoholic beverages.
- Any food trucks must be approved by the Board prior to any event.
- The Lessee assumes responsibility for the conduct of members, dependents, guests and, invitees at the function.
- Music is not permitted at the pavilion past 9 pm Sunday - Thursday, on Friday - Sat music is not permitted past 11 pm
- Use of the facility by individuals under the age of 16 requires parental supervision for the duration of any function for which the Lessee is renting the facility.
- An inspection of the facility will be made by a staff member to determine that the facility was returned to its original condition the morning immediately following the function. If this is deemed not to be returned to its original condition the lessee’s deposit check may be forfeited.
- No nails or push pins of any kind should be used on the walls.
- Smoking is not permitted in the facility.
- Any person renting the facility must be current on their Assessments.
- Pool Rentals: Hiring of additional lifeguard(s) is required to rent the pool. Please see the Springfield POA Pool Information for contracting with AquaTech. Be advised that during poolside rentals, residents may still have access to the regular pool hours. For after-hours poolside events, after hours lifeguard fees will apply.
- Any questions or concerns in regard to the amenity should be directed Kuester Management via springfield@kuester.com.
- Please note that the fitness area will remain open for all residents during your event and homeowners may enter the side entrance of the amenity center to access this area.
- Rentals are a first come first serve basis.
- No political or business-related activities may be conducted at the Amenity Center, this includes campaign meetings, campaign events, or campaign activities on behalf of or in support of any particular candidate for public office or any particular political party. This rule shall not prohibit the use of the Common Area by a duly elected public official whose constituents include the residents of Springfield solely for the purposes of meeting and communicating with his or her constituents in the course of carrying out the responsibilities of such official’s current public office, but no campaign literature, signs, posters, banners or similar items may be placed, posted, displayed, or distributed on the Common Area and no campaign speeches or other campaign activities shall be engaged in during such meeting.
Cleanup Requirements:
- All furniture that is moved in preparation for your event must be placed back to its original location. This is to include the outside pavilion area.
- Wipe off and return all furnishings to their original location.
- Wipe all kitchen surfaces, including appliances and countertops.
- Remove all leftover food, drinks and any other items brought to the facility for use during the event. All event decorations must be completely removed, without exception. Any items not removed at the end of the rental period will be disposed, and funds may be deducted from the security deposit for such disposal.
- The amenity center/pavilion area is to be swept after your event (broom is located in the kitchen area) and be left in the condition it was found.
- Empty all trashcans, and replace the liners. Garbage and refuse must be deposited in the trash cans located in the parking lot.
Check restrooms for proper flushing.
Fees:
- The Lessee agrees to inspect and clean all areas used during the rental to ensure it is in the same or better condition as it was upon arrival. Failure to clean all the areas as necessary will incur a minimum fee of $125 for every hour of cleaning required if cleaning is not deemed to be adequate after the Lessee's event.
- The Lessee must ensure the Amenity Center is secured and locked prior to departing. Failure to follow the locking procedures and to leave the Amenity Center unsecured will result in an immediate $100 fee.
- Cleaning, violations, and damages will be charged to the HOA account without hearing and will have 15 days to be pay before late fees and interest begin to accrue. Renter understands the additional fees will be charged to their account and will be deducted from the next payment received for association assessments.
