PORTRAIT SESSION AGREEMENT & POLICIES: RETAINER: I understand that my session with Tania Gutti Photography is not confirmed until the retainer is paid, this fee is non-refundable and the total balance must be paid prior to, or on the day of the photo session/event.Client acknowledges and agrees that the retainer amount is non-refundable (“Retainer”), so as to fairly compensate the Photographer for committing his/her time to provide the services and declining other potential projects or clients. The CLIENT must fulfill all outstanding fees by the specified due dates. Photography, videography services and deliverables, such as proofing galleries, digital images, sneak peeks, videos, products, and professional prints, will only be provided upon full payment. Any payments made after the due date will be subject to a late fee of 10% based on the outstanding balance. Weather cancellations will be made at the photographers discretions. CLIENT will be notified via email 24-48 hours in advance if the session needs to be rescheduled due to weather conditions, including but not limited to rain, wind, snow, etc. LATE ARRIVAL: If CLIENT is late to her session scheduled time slot, timewill not be extended or rescheduled. Refunds are not available for sessions cut short or entirely missed due to CLIENT'S late arrival.*

VIDEOGRAPHY SERVICES AGREEMENT. Tania Gutti and/or TG Films will provide a minimum of 4 hours video coverage and a 45 min of HD edited film in mp4 format, delivered via email no later than 4 weeks after the event. Other changes to the final video can be made, but there will be a charge per hour to do so. Edits to the final video, which were not discussed with us ahead of time, are billed at a rate of $15 per hour. CLIENT ARCHIVAL OF IMAGES: Once Tania Gutti Photography delivers the final JPEGs/MP4 to CLIENTS, CLIENT accepts all responsibility for archiving and protecting their images and/or videos. Tania Gutti Photography does not permanently archive image files.*

MODEL RELEASE: I have read and agree to the following statement: I commission Tania Gutti Photography, the photographer, to photograph myself and/or my spouse and/or underage children. I hereby grant and understand that Tania Gutti Photography may use my images/videos (but not limited too) social media/advertisement etc., and there will be no compensation to the above. The Photographer retains the copyright to all photos, videos and images produced. The Client hereby grants to the Photographer and assigns, the irrevocable and unrestricted right to use and publish photographs/videos of the Event, its guests, and attendees, for editorial, advertising, social media, portfolio samples, wall displays, videos, stock, marketing and any other purposes.*

DIGITAL IMAGES/RAW IMAGES: Tania Gutti Photography does guarantee the total of images included with the portrait package booked in CLIENT'S final portfolio, and 35 digital images per hour for events. If extra images are available they must be purchased separately. Under no circumstances Tania Gutti Photography will release RAW images to the CLIENT. Tania Gutti Photography selects the best representation of the image's taken at the event/associated sessions for the CLIENT portfolio, and all other images are deleted during the culling process; therefore, no additional images can or will be released. **

COPYRIGHT: As a client of Tania Gutti Photography, I acknowledge and understand that the images are taken by either Tania Gutti and/or Natalie Lopez. A limited PRINT RELEASE is supplied with the purchase of my session, along with high resolution digital files. No camera and or mobile phones allowed during studio or outdoor sessions. Only photographer, videographer, second shooter or assistants are able to capture and record images during the photo shoots. By choosing "I Agree" I will honor the above statement.*

MODEL CALL /FREE SESSION: Participation as a model in Tania Gutti Photography session or workshop includes a free session and four fully edited digital images (shot and edited either by Tania Gutti, Natalie Lopez and/or her workshop students) downloadable online via Dropbox.*

EXCLUSIVITY: Tania Gutti Photography, and/or Natalie Lopez will be exclusively photographing and filming for Client's photoshoot or event. If necessary, assistants to such videographer shall attend the Event. Tania Gutti Photography reserves the right to decline outdoor videotaping in the event of inclement weather. Client is responsible for providing an alternate nearby indoor location in the event of inclement weather..*

LIMITATIONS ON LIGHT: Tania Gutti Photography is primarily a natural light photographer. CLIENT acknowledge that if any part of the photography session occurs at a time or in a location where there is an absence of natural light, Tania Gutti photography will have to use artificial light sources, and the images will look different than the natural light images CLIENT have seen in Tania Gutti Photography portfolio. Accordingly, CLIENT acknowledges that the images shall not be subject to rejection on the basis of taste, aesthetic criteria, or personal appearance.*

The CLIENT is responsible for their own safety, the safety of those who accompany them, and the safety of each minor child accompanying them. Client agrees to retain custody and control of each child at all times during the session to avoid injury. On behalf of themselves and such children, CLIENT releases Tania Gutti Photography and or Natalie Lopez from all claims and liabilities.*

By signing (draw your signature) below I certify By this waiver, I assume any risk, and take full responsibility and waive any claims of personal injury, or damage to personal property associated with and/or activities and events organized by Tania Gutti Photography and/or Natalie Lopez . That I am at least 18 years of age. I have read this portrait agreement/waiver/contract and fully understand the contents thereof. I agree that I have the legal authority to grant these permissions and accept all responsibility for such.*
