Customer certifies that the weatherization improvements, upgrades, and/or repairs from the Eligible Measures List have been completed by the Contractor. Customer certifies that the weatherization improvements, upgrades, and/or repairs are in substantial compliance with the terms of the Customer Agreement between Customer and Contractor.

Customer understands and agrees that the installed weatherization improvements, upgrades, and/or repairs at the property are eligible for incentive funding through the Public Utility District No 1. of Pend Oreille County (the "District") Income Qualified Energy Efficiency Program and authorizes the District to process any applicable Program incentive.

Customer understands and agrees that any incentive payment is subject to the program requirements and the availability of Bonneville Power Administration ("BPA") funding, and District approval is not guaranteed. In the event that an incentive payment is not approved or available through BPA, Customer remains solely responsible to Contractor for payment of the work performed.

Customer understands that the installed weatherization improvements, upgrades, and/or repairs and the property may have required modifications to the property that may have included electrical, plumbing, and structural work, which may have included penetrations and alterations necessary for the installations. Customer accepts such modifications (if any).

IN CONNECTION WITH THE WORK PERFORMED AT THE CUSTOMER'S PROPERTY AND ANY ASSOCIATED PROGRAM INCENTIVE, CUSTOMER AGREES TO RELEASE AND HOLD HARMLESS THE DISTRICT FOR ANY CLAIM ARISING FROM THE CONTRACTOR'S WORK. CUSTOMER AGREES ANY AND ALL CLAIMS FOR ISSUES ARISING FROM THE WORK SHALL BE PURSUED SOLELY AGAINST THE CONTRACTOR AND NOT AGAINST THE DISTRICT.
