Scope Of Work: Hypnosis, Hypnotherapy, and/or Life Coaching Services

You are retaining me to provide hypnosis, hypnotherapy, and life coaching services. Hypnosis, hypnotherapy, and life coaching are different from counseling, psychotherapy, or psychoanalysis and do not deal with the diagnosis or treatment of emotional problems. Since hypnosis, hypnotherapy, and life coaching do not constitute a medical consultation or treatment, health insurance does not apply. Hypnosis, hypnotherapy, and life coaching may be used individually or in conjunction.

Creating Ideal Conditions For Your Sessions - Part 1

You are hiring me as your hypnotist, hypnotherapist, and life coach because you want to make significant changes in your life. Sometimes, these changes will happen quickly, sometimes not. We will collaborate and work through the other side when the going gets tough. As your consultant, you have my word that I am 100% committed to you getting the changes you want. 

To help you get the most out of your sessions, I recommend you do the following: 

If you are doing your appointment via Zoom, please sit in a quiet space, free of background distractions and noise, in a place where you can have complete privacy. Please do not schedule sessions when you are driving, walking around, in public places with a lot of noise, or in charge of supervising children. 

Creating Ideal Conditions For Your Sessions - part 2

I have a sound machine outside my office if you are making your appointment in person. This is to provide you with a more confidential experience and minimize other noises outside my office. My office is usually around 65 degrees, so please bring a sweater. I do have blankets in the event you forget. Blankets are washed after use. If we do a session using the wireless headsets, your headset will be cleaned with alcohol swabs and covered with ear protectors before use.

If you bring someone with you, they will be asked to sit in the lobby unless their presence is necessary. If you must bring your children, please make sure they have a way to entertain themselves (book, smartphone, game, etc for your session so as not to disturb the other tenants in the building.

One of my main goals is to provide a safe and comfortable space for you to grow and thrive. Please let me know immediately if I ever do or say anything that upsets you or doesn't feel right. This session is all about getting results for you!

Scheduling, Rescheduling, and Session Forfeiture - Part 1

If you are doing more than one session, waiting extended periods between sessions minimizes the benefits of coaching. To maintain momentum and get the most benefit from our time together, please schedule all of your sessions beforehand.

I recommend that you schedule one session per week or every other week. If you have planned events that prevent this schedule, such as a vacation, please schedule as close to that interval as possible.

Scheduling, Rescheduling, and Session Forfeiture - Part 2

I also understand that rescheduling may be necessary from time to time. We can do that if something arises and we must reschedule a particular appointment. Please note that 48-HOUR NOTICE IS REQUIRED TO RESCHEDULE. If a 48-hour notice is given, I will do my best to reschedule you for the same week as the original appointment.

If less than 48-hour notice is given, the session will be forfeited, meaning it will still be counted as if you had the session. It will NOT be rescheduled. However, because I understand "life" happens, you are allowed to have one (1) "session reschedule" if there are extenuating circumstances.

Scheduling, Rescheduling, and Session Forfeiture - Part 3

If you are late to your session, I will begin attempting to reach you after 10 minutes. If, after 20 minutes, you are not on the call, I will reach out by text or email to remind you of your session. Please reply to the email or text me at 941-228-0230 to let me know when you can join the call to start your session. We will work together for the remaining minutes of our scheduled session. Unfortunately, I cannot extend session times to accommodate late shows.

If you have yet to contact me within 30 minutes after the session has begun, the session will be forfeited. I will continue to reach out to make contact so that we can deal with any difficulty you are having and confirm your next session.

Acceptance of this Agreement - Part 1

By signing this contract, you agree to the following: 

I am of legal age and understand you are entering into a cooperative relationship of your own free will.

You are participating in hypnosis and hypnotherapy by your choice and because you want to be here.

You understand that you are not a patient but a co-operator in your hypnosis experience.

Acceptance of this Agreement - Part 2

By signing this contract, you agree to the following: 

You accept 100% responsibility for your emotional, mental, physical, and spiritual well-being before, during, and after sessions. Should you instruct others on the techniques shared in your sessions, you will ask them to take the same responsibility for themselves.

You understand that transformation is a process. It can take time. You did not get to be who you are in 90 minutes, so it may take longer than 90 minutes for Traci to assist you in making the desired changes in your behaviors and habits.

You understand that if you are being treated for Depression, Anxiety, Insomnia, PTSD, Mental Illness, or any other psychologically diagnosed condition by a licensed healing arts professional, you can not receive Hypnosis or Hypnotherapy without a written prescription or referral from the licensed healing arts professional treating your condition, per Florida Statute 485.

You will continue to take all of your medications as prescribed and remain under the care of your physicianor therapist for any medical, emotional, or mental condition for which you are currently being treated or believe you may need treatment.

Acceptance of this Agreement - Part 3

By signing this contract, you agree to the following: 

You agree that you will not use the techniques learned in your sessions to solve a problem where your common sense would tell you it is inappropriate.

You agree to allow Traci Kanaan / Wings Hypnosis, LLC, to audio and video record your sessions. These recordings are for your personal, ongoing use ONLY and are made with your pre-approval and knowledge. Wings Hypnosis, LLC retains ALL copyrights of these recordings.

You agree not to change, alter, reproduce, manufacture, or sell these recordings in any way, shape, or form without express written consent from Traci A. Kanaan.

You understand that your entire identity will NEVER be disclosed without your permission if the issues Traci addresses during private sessions are shared with others in a general way to educate others about these techniques.

Acceptance of this Agreement - Part 4

By signing this contract, you agree to the following: 

You understand that Traci Kanaan is a Certified Hypnotist and Certified Hypnotherapist. She is NOT a medical doctor, nutritionist, licensed social worker, mental health counselor, or other medical professional. You acknowledge that she has no formal training in these fields and does not portray herself as such.

You understand that Hypnosis or Hypnotherapy are legal, stand-alone professions and not licensed healing arts modalities in Florida.

You, being of legal age or with a parental signature if under 18 years of age, your heirs, executors, administrators, and assignees, do now release and discharge Wings Hypnosis, LLC and Traci Kanaan from all claims of damages, copyrights, demands, or actions whatsoever in any manner arising from or growing out of your cooperative participation.

You understand that if you are not feeling well for your in-person appointment, you are to reschedule or change to an online one.

Acceptance of this Agreement - Part 5

No Guarantees

I (Traci Kanaan) will provide my best advice, resources, and skills in your sessions. I cannot guarantee the outcome of your results as you apply them to your situation, and my comments about the outcome are expressions of opinion only. I make no guarantees other than that the services described in "Scope Of Work" shall be provided to you. In signing this Agreement, you agree to take 100% responsibility for all outcomes and results based on your decision to implement my suggestions, whether in whole or in part or not at all.

Refund Policy

The consulting fee is non-refundable, including unused sessions. You have up to 6 months from the date of purchase to use your sessions. Any sessions not used within six months are subject to a contract renewal fee of $100 if renewed within six months of expiration. Sessions not used within 12 months are forfeited.

If, for some reason, you are just not able to continue consulting and have unused sessions that you will not be able to use for yourself, I do allow sessions to be transferred to someone of your choice if you are amenable to the following conditions:

• The recipient is willing to have a 60-minute evaluation conversation on the phone (Discovery Session).
• The recipient is someone whose issues/challenges fall under my scope of work.
• The recipient or you pays a $150 transfer fee to cover my administration and processing time.

Refund In The Event Of My Death Or Disability

In the event of my death or disaster that prevents me from continuing our consulting work, you will receive a prorated refund for the remaining sessions purchased six months before my death. Any unused sessions purchased more than six months before my death will be forfeited, and no refunds will be given.

Confidentiality

I AM COMMITTED TO YOUR PRIVACY. Information revealed during consulting sessions (verbally, in recorded calls, or written format) will remain confidential unless disclosure is required by law. 

These disclosure conditions include any reasonable suspicion of child, dependent, or elder abuse when you are in danger to others or when you are likely to harm yourself unless protective measures are taken. If there is ever a time when your emotional status is an issue in a legal proceeding (i.e., child custody evaluation, worker's compensation claim, etc a judge may subpoena your records and my testimony if they determine the issues demand it. In most legal proceedings, however, I can prevent providing others with information about our session work.

Public Disclosure

Neither party may disclose the terms of this Agreement. Neither party shall make any formal or informal public statement, press release, or other announcements regarding the existence or terms of this Agreement without the other party's prior written approval. 

Non-Disparagement

You agree that, during and after our contracted time together, you will refrain from making any statements or comments of a defamatory or disparaging nature to any third party regarding me, Traci A. Kanaan, Wings Hypnosis, LLC, or any of my policies, services, or products.

Independent Contractor Status

This Agreement shall not render me (or my company) an employee, partner, agent of, or joint venturer for any purpose. I will remain open to conducting similar consulting work with other clients, and I hold myself (and my company) out to the public to be a separate business entity.

Limitation Of Liability

In no event shall either party have any liability to the other party for any lost profits, loss of use, business interruption, costs of procurement of substitute goods or services, or for any indirect, special, incidental, multiple, exemplary, punitive, or consequential damages however caused and, whether in contract, tort or under any other theory of liability, whether or not the party has been advised of the possibility of such damage. In no event shall a party's liability exceed the fees paid under this Agreement, whether in contract, tort, or under any other theory of liability.

Sovereignty Of This Agreement

This Agreement constitutes the entire Agreement between the parties and supersedes all prior and contemporaneous agreements, representations, and understandings of the parties. No supplement, modification, or amendment of this Agreement shall be binding unless executed in writing by all the parties. No waiver of any of the provisions of this Agreement shall be deemed or shall constitute a waiver of any other provision. 

Severability

If any term, provision, covenant, or condition of this Agreement is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.

This Agreement Has Not Been Altered

You agree that you have not tweaked or altered the original Client Agreement before signing.

I acknowledge that I have read the above agreement, understand it completely, and agree to the terms and conditions of this contract.
