  • Negus In Nature, a 501(c)(3) nonprofit organization (“NIN”), hosts outdoor programs and community experiences designed to foster connection, confidence, and wellness through nature-based activities. Participation in these programs is voluntary and involves inherent risks. This document affects your legal rights. Please read it carefully before signing.


    1. Acknowledgment of Risk
    I understand that participation in any outdoor activity—such as hiking, swimming, climbing, kayaking, camping, yoga, cycling, snow sports, or other adventure experiences organized by Negus in Nature—carries inherent risks. These risks include, but are not limited to, accidents, falls, environmental hazards, unpredictable weather, equipment failure, wildlife encounters, transportation incidents, and other circumstances that may result in serious injury, illness, permanent disability, property loss, or death.

    I acknowledge that Negus in Nature cannot eliminate these risks, even with reasonable care, and that participation is undertaken voluntarily and at my own risk.


    2. Health and Fitness Certification
    By signing below, I affirm that:

    I am in good health and physically able to safely participate in outdoor activities of this nature.
    I have disclosed any relevant medical conditions, allergies, or physical limitations to the Negus in Nature leadership team prior to participation.
    If I am pregnant, post-surgical, or under medical supervision, I have consulted my physician and received clearance to participate.
    I understand that I am responsible for monitoring my own well-being during all activities and will immediately stop participating and inform an instructor or leader if I experience pain, distress, or discomfort.

    3. Assumption of Risk
    I knowingly and freely assume all risks, both known and unknown, associated with my participation in Negus in Nature activities. I accept full responsibility for my own safety, health, and personal belongings while participating in or traveling to and from any Negus in Nature event.


    4. Release and Waiver of Liability
    In consideration of being allowed to participate in any Negus in Nature program, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby voluntarily release, discharge, and hold harmless Negus in Nature (a 501(c)(3) nonprofit organization), its directors, officers, employees, contractors, volunteers, sponsors, and partners (“Released Parties”) from any and all claims, demands, or causes of action, whether known or unknown, arising out of or related to any injury, loss, or damage I may sustain as a result of participation in Negus in Nature activities—whether caused by negligence or otherwise—to the fullest extent permitted by law.


    5. Indemnification
    I agree to indemnify, defend, and hold harmless Negus in Nature and all Released Parties from any claims, actions, damages, costs, or expenses (including attorney’s fees) arising from my participation or the participation of any minor for whom I am responsible.


    6. Media Release
    I grant Negus in Nature the irrevocable right to use photographs, video, and other media taken during activities that include my image, likeness, or voice for nonprofit educational, promotional, or fundraising purposes, in any medium, without compensation. I waive any right to inspect or approve the final materials.


    7. Severability
    I agree that if any portion of this agreement is found to be invalid or unenforceable, the remaining sections shall continue in full legal force and effect.


    8. Acknowledgment of Understanding
    I have carefully read this Liability Waiver & Release Agreement and fully understand its terms. I acknowledge that I am giving up substantial legal rights, including the right to sue Negus in Nature or any of its representatives. I sign this document freely and voluntarily, intending it to be a complete and unconditional release of all liability to the greatest extent allowed by law.

     

  • Negus in Nature, a 501(c)(3) nonprofit organization (“NIN”), documents its programs and events through photography, video, and other forms of digital media to share our mission of building community and connection through nature.


    1. Authorization and Consent
    I hereby grant Negus in Nature permission to record my likeness, image, voice, and/or performance on any form of media, including but not limited to photographs, video, or audio recordings (“Media”).

    I authorize Negus in Nature to use, reproduce, edit, adapt, publish, or distribute this Media for lawful nonprofit purposes—such as marketing, educational outreach, storytelling, or social media communications (e.g., Instagram, Facebook, YouTube, X/Twitter, website, newsletters, and promotional materials)—without payment or other consideration.


    2. Rights and Ownership
    I understand that:

    All Media created by or for Negus in Nature is the property of Negus in Nature.
    I waive any right to inspect or approve the finished product in which my likeness appears.
    I waive any right to royalties, compensation, or ownership claims arising from the use of such Media.

    3. Release of Liability
    I hereby hold harmless and release Negus in Nature, its directors, officers, employees, volunteers, contractors, and partners from any and all claims, demands, or causes of action—known or unknown—arising out of or related to the use of my image, likeness, or voice. This includes, but is not limited to, claims of defamation, invasion of privacy, or misrepresentation.


    4. Duration of Consent
    This release is perpetual, meaning it remains in effect indefinitely unless revoked in writing. Any revocation applies only to future uses and does not affect materials already produced or published.


    5. Acknowledgment
    I have read and fully understand this Photo/Video Release Form. I am signing freely, without expectation of compensation, and acknowledge that I am at least 18 years of age.
    If under 18, my parent or legal guardian has read and approved this agreement below.
