Enrollment Terms, Parent Consent, and Liability Agreement
Please read carefully before enrolling your child in any program offered by the Abigail Ruth Sung Foundation.
1. Program Participation and Release of Liability
In consideration for my child’s participation in programs offered by the Abigail Ruth Sung Foundation ("Foundation") at:
14400 NE Bel-Red Road, Bellevue, WA 98007, including Suite 109-B and other affiliated instructional spaces within the facility,
I acknowledge that participation in educational, artistic, musical, recreational, STEM, and enrichment activities may involve certain inherent risks.
To the fullest extent permitted by law, I voluntarily assume all risks associated with my child’s participation and hereby release, waive, discharge, and hold harmless the Abigail Ruth Sung Foundation, its directors, officers, employees, instructors, volunteers, contractors, affiliates, and participants from any claims, liabilities, demands, damages, losses, or causes of action arising out of or relating to participation in Foundation programs, except where prohibited by applicable law.
This release shall be binding upon me, my child, our heirs, legal representatives, successors, and assigns.
2. Student Conduct and Withdrawal Policy
All students are expected to follow program rules, instructor directions, and standards of respectful conduct at all times.
The Foundation reserves the right to dismiss any participant without refund if behavior substantially disrupts the learning environment or poses a risk to the safety and well-being of others.
Grounds for Withdrawal or Dismissal
A participant may be withdrawn or dismissed for reasons including, but not limited to:
A. Persistent Failure to Participate
A student who consistently demonstrates minimal engagement or responsiveness to instruction despite reasonable support and repeated prompts may be subject to withdrawal. Examples include repeatedly failing to follow basic classroom directions such as bringing required materials, taking a seat, or participating in assigned activities.
B. Disruptive Behavior
Behavior that significantly interferes with instruction or the learning experience of other participants, including but not limited to:
• Excessive shouting, screaming, or verbal interruptions
• Running or leaving designated instructional areas without permission
• Throwing objects
• Repeatedly talking over instructors or classmates
• Intentionally disrupting lessons or activities
• Excessive noise-making or misuse of instruments, equipment, or materials
Parents or guardians of students with learning, behavioral, developmental, or medical considerations are encouraged to discuss appropriate accommodations and support strategies with Foundation staff before enrollment.
C. Serious Misconduct
Immediate dismissal may occur for any of the following:
• Physical aggression or abuse toward others
• Verbal harassment, bullying, threats, or intimidation
• Use of profane or abusive language directed at others
• Damage to Foundation property or another person's property
• Unsanitary or unsafe conduct
• Possession, use, sharing, or encouragement of prohibited or illegal substances
• Any conduct deemed by program staff to endanger the safety, welfare, or learning environment of participants
All significant incidents may be documented in an internal incident report.
The Foundation reserves sole discretion in determining whether conduct warrants disciplinary action, suspension, or dismissal.
3. Medical Authorization and Emergency Treatment
In the event of illness, injury, or a medical emergency involving my child during participation in Foundation programs, I authorize the Abigail Ruth Sung Foundation and its representatives to seek emergency medical treatment deemed necessary.
I further authorize licensed physicians, emergency personnel, hospitals, and medical providers to administer examinations, diagnostic procedures, medical treatment, anesthesia, surgery, and other necessary care if I cannot be reached in a timely manner.
I understand that I am responsible for any medical expenses incurred on behalf of my child.
4. Communication Consent
By enrolling in Foundation programs, I consent to receive communications from the Abigail Ruth Sung Foundation by email, phone call, and/or text message regarding:
• Enrollment and registration updates
• Program schedules and availability
• Program announcements and events
• Administrative notices
• Educational opportunities and related program information
I may withdraw this consent at any time by providing written notice to Foundation administration.
5. Photo, Video, and Media Release
By enrolling in Foundation programs, I grant permission for photographs, video recordings, audio recordings, and other media featuring my child to be used by the Abigail Ruth Sung Foundation for educational, informational, promotional, website, publication, and social media purposes.
No compensation shall be provided for such use.
Parents or guardians may revoke this consent at any time by providing written notice to Foundation administration. Revocation shall apply only to future use and cannot be applied retroactively to previously published materials.
6. Program Calendar, Closures, and Missed Sessions
Program schedules and operating dates vary by program and will be published separately by the Foundation.
Program participation fees, membership fees, registration fees, and other applicable program fees remain unchanged during scheduled holidays, closures, or breaks.
No refunds, credits, make-up sessions, or prorated adjustments will be provided for:
• Scheduled closures
• Participant absences
• Missed sessions
• Voluntary non-attendance
Unless otherwise required by law or expressly stated in writing by the Foundation.
7. Enrollment Cancellation and Termination
Participation in Foundation programs does not constitute a fixed-term contractual commitment.
Parents or guardians wishing to withdraw a participant must provide a minimum of one (1) week's written notice prior to the intended withdrawal date.
Program participation fees, membership fees, registration fees, and other applicable program fees remain due through the end of the notice period.
The Abigail Ruth Sung Foundation reserves the right to terminate enrollment immediately for policy violations, misconduct, safety concerns, or other circumstances that materially interfere with program operations or participant welfare.
Acknowledgment
By registering my child for any program offered by the Abigail Ruth Sung Foundation, I acknowledge that I have carefully read, understood, and voluntarily agree to all terms, conditions, waivers, authorizations, and policies contained in this Enrollment Terms, Parent Consent, and Liability Agreement.
