Contract Policies - please read all of the following carefully before signing the document
This agreement is between the client listed above and Arieonna Abeling Photography LLC:
Deposit and Payment
The non-refundable retainer covers photographer's appointment time, talent, editing, use of studio prop collection & wardrobe as well as venue arrangements, reservations, etc. if applicable. A signed copy of this agreement along with your session fee is required to reserve your session date in my calendar.
Non-refundable retainer is 75% of the total session cost
The remaining balance for the client's digital images are due the day of and by completion of the client's scheduled session. Payments can be paid in cash, check, or Venmo. By law, New York State sales tax will be applied and a processing fee may be added if applicable to your payment method. If final payment is not received, the photographer will not edit or deliver the images. Late payments are subject to a $75 late fee.
Cancellation
Should the client decide to cancel their session, the retainer paid in order to hold their session date is NON-REFUNDABLE for any reason including but not limited to illness, scheduling conflicts of the client, etc. If the client wishes to reschedule the session and the photographer has room in her calendar to do so, the client will be required to pay a $100 rescheduling fee due to the cancellation in order to reserve a new date within the photographer's calendar. Note - a reschedule may not be possible in cases including but not limited to mini sessions and venue reserved photography sessions (ex. Mini Sessions at the Glasshouse).
In the case of inclement weather, it is the photographer's discretion if an outdoor session must be cancelled or rescheduled. Photographer will communicate with the client within 24 hours of the scheduled session time if there is a possibility of rescheduling due to poor weather, and the final decision on rescheduling will occur no less than 4 hours before the session start time. An opportunity to rebook for the next available date and transfer the session fee to that new date will be given.
Late Arrivals
Any client that is arriving to the session late may have the amount of time late deducted from the time allotted for the session. Please be mindful of this when booking your session and provide yourself with plenty of time taking into consideration traffic, delays, etc. It is recommended that clients should aim to arrive at least 10 minutes before their scheduled session to avoid running late. If client is arriving past their scheduled session time, a rescheduling fee at the photographers discretion may be required/applied.
Safety
The studio is not infant/toddler proofed therefore children cannot be left unattended in the studio. Please do not bring any children not being photographed to the session with you. Infant/toddler sessions require parent assistance for safety, so please, no other siblings unless this is discussed and approved by the photographer before completing this form. Any props, decor, studio property damaged by the client/children/etc. will be billed to the client for the full cost of the item including shipping that is damaged if not repairable. Whether or not the item can be fixed is at the photographers discretion. Please do not allow your children to play on, with, or near props during the session without consent from the photographer.
Pets
Due to allergies and newborn safety, no pets (unless agreed upon in advance) are allowed within the studio. For venue or on location photo sessions, it will be up to the venue and their policies whether or not pets are welcome to attend the session. Please do not bring a pet without discussing with the photographer first. Venue's require the photographer to sign a contract and bringing your pet with you without discussing this first may result in a breach of contract preventing the photographer from using the location or venue in the future.
Editing/Retouching
All images are edited and retouched before being presented. Raw files will not be provided. Basic retouching includes removing blemishes, brightening teeth, smoothing skin, or possibly removing simple distractions in the scene. The photographer may perform additional artistic compositing or advanced retouching requests at an additional charge.
Copyright
Please note that taking photos or videos by clients during sessions is prohibited. The photographer owns copyright on all images created and shall have the right to make reproductions for, including but not limited to, marketing materials, portfolio entries, video content, sample products, magazine submissions, and use, or for display within or on the photographer's website and/or studio.
It is understood that any duplication or alteration of any images by the client is strictly prohibited.
Social Media
The client may (and is encouraged to!) share the photographer's social media posts through sharing and tagging. All sneak peek posts on social media are not formatted for printing, and are copyright protected. Printing of stolen screenshots is not permitted, as they are a very low quality and not an accurate representation of the photographer's actual work. Any editing of any images by the client is not permitted per copyright law (such as cropping and applying filters).
Archive
Client agrees to download and backup all digital files immediately after receiving any digital file orders. After 90 days, all images are subject to be removed from the photographer's hard drive, except as needed for the photographer's promotional purposes, at the photographer's sole discretion. Photographer is not responsible for loss or damage to the client's digital files due to the client's loss.
Happiness Clause
During every session, the photographer will encourage natural interaction between family members to capture the most authentic smiles, laughter, and expressions. The photographer will not be held responsible for shots not taken due to uncooperative subjects.
Legal
If the photographer is unable to deliver photographs due to technological malfunctions, including but not limited to camera and processing, liability shall be limited. The signing client is the parent or legal guardian of any minor(s) named above and has the legal right and authority to execute the model release stipulations named in this contract on behalf of the minor.
