1.1 A Flash In Time Photography holds all rights to each image. Every image is copyrighted and may only be reproduced with permission. Producing images without permission is a violation of copyright and this contract.
1.2 Editing the photos in any way and removing the watermark is not allowed under no circumstances! If you do remove the watermark or edit the images in any way shape or form it will be considered a violation to copyright and this contract.
2. MODEL RELEASE
2.1 A Flash In Time Photography reserves the right to use images from your session for advertisement, display, and publication.
3.1 The Client will recieve their edited photos in 1-2 weeks via digital download and/or USB drive (If purchased). USB drives are $5.00 extra for studio pick up/local pick up or $10.00 shipped.
3.2 The Client is responsible for making their own backup of images. A Flash In Time Photography will make every attempt to keep copies of images but does not guarantee it.
3.3 A Flash In Time Photography has a general estimate of 10-15 edited images per 30 minute session and 20-25 edited images per 1 hour session. This is not a guarantee, only a estimate. If the photoshoot goes smoothly with cooperation and staying on topic you will almost always get the estimated amount of photos. A Flash In Time Photography is not held liable for lack of images due to poor cooperation or clients getting off topic.
3.4 Again, A Flash In Time Photography is not held liable for lack of cooperation on the client's part. It is not A Flash In Time Photography's fault if the images do not turn out or if there is a lack in quantity due to client(s) not cooperating. There will be no refunds or discounts for this matter as it is not in our control.
3.5 Images posted on social media must show the watermark or proper credit needs to be given in the caption of the image with A Flash In Time Photography tagged.
3.6 Under no circumstances will RAW images files be able to view or be given to the client.
4.1 The Client is responsible for bringing any props they would like to use during the session. There are times A Flash In Time Photography will bring props to a session if discussed.
4.2 If A Flash In Time Photography has to purchase a prop for you we will discuss that with you and you will be responsible for paying for the cost of the props up front. Please be aware this does not grant you rights to the props after the photo shoot. All props even ones you were charged for are property of A Flash In Time Photography.
5. OUTFIT CHANGES
5.1 If you would like to change outfits please be aware that the time it takes to change outfits goes towards the total amount of session time.
5.2 If outfit changes is something you would like during your session please make that known when booking your session, extra time may be added for outfit changes for an additonal charge of $25 for an extra 30 minutes or $45 for an extra hour. This must be done prior to your session, perferably at the time of booking.
5.3 Outfit changes may be done without adding extra time but as mentioned above, the time it takes to change outfits does go into your session time and it is not A Flash In Time Photography's fault if you have a lack in quantity of images due to time being taken up by outfit changes.
6. MULTIPLE LOCATIONS
6.1 If you would like more than one location for your session, the time it takes traveling to and from each location does go into the total amount of session time. If there are any fees for a location, the client is responsible for paying for the photographer's fee.
6.2 If multiple locations is something you would like during your session please make that known when booking your session, extra time may be added for multiple locations for an additonal charge of $25 for a extra 30 minutes and $45 for a extra hour. This must be done prior to your session, perferably at the time of booking.
6.3 Multiple locations may be chose without adding extra time but as mentioned above, the time it takes to travel to and from each location does go into your session time and it is not A Flash In Time Photography's fault if you have a lack in quantity of images due to time being taken up by traveling from one location to another.
6.4 A Flash In Time Photography does give the clients the option to choose the location. In the event the client chooses the location and its private property, no trespassing, etc. Please make sure you get written permission to take photos at said location. In the event where permission wasn't granted and we get fined, arrested, etc. for being on private property the client agrees to pay for all fees following the issue as it was not A Flash In Time Photography's choice of location.
6.5 I will not choose a location for you that I do not have permission to shoot pictures on. Every location I suggest is usually a public place and if not I always make sure to get permission from owners prior to your session.
7.1 We do offer printing through a professional photo lab for our clients although it is ultimately up to the client where they choose to print their photos. We strongly advise against using any local pharmacy/grocery store for printing as their quality lacks greatly and the colors may be off. In the event a client chooses to use a local store for printing and their images don't turn out as they were hoping, A Flash In Time Photography is not held liable or responsible for this. No discounts, refunds, or favors will be issued as this was the clients decision to print where advised not to.

8. SESSION TIMES & RETAINER FEE
8.1 Session times are on a strict time basis. However long of a session you purchase is what you get. Under certain circumstances A Flash In Time Photography will allow the session to go over the end time but the client will be charged for the extra time at the rate of $2.00 per minute. The overage charges are due within 24 hours of your session. Failure to pay overage charges will result in interest fees at $5 per day and the images will not be released to you until you pay the overage charges. Please make sure to book enough time so we can capture all the images you would like.
8.2 A Flash In Time Photography requires a $20 non refundable retainer fee to be paid on day of signing before securing the booking date. This retainer fee secures your Photoshoot date & time. The date and time remains available to any client until the retainer is paid. Once the retainer is paid I turn down all other commissions for said date and time. The remaining balance will be due on the day of the photoshoot. We gladly accept cash, Facebook Pay, Paypal, & all major credit/debit cards. Please be aware that all card transactions do require a 2.75% transaction fee. No checks will be accepted.
8.3 The retainer is non refundable no matter the circumstances!
9. RESCHEDULING, NO SHOWS, & CANCELATIONS
9.1 No rescheduling!! If you need to reschedule please be aware you will have to pay a new retainer of $20 and a $20 rescheduling fee for a future date and time if you would still like photos done.
9.2 If you do not show or cancel completely the retainer will be forfeited.
9.3 If you are 10 minutes (or less) late to your session the end time does not change. Please be on time and ready to take photos at the start time of your session. A Flash In Time Photography is not held liable for lost time because the client didn't show up on time.
9.4 If you are more than 10 minutes late A Flash In Time Photography will not take the photos on that said day and time and the retainer is forfeited and you must pay a fee of $20 If you would like to reschedule along with a new $20 retainer for a new session. A Flash In Time Photography is not held liable for the client not showing up on time. Under some circumstances A Flash In Time Photography will still agree to do the photos if we are able to depending on time but there will be a $20 fee per every 10 minutes late. Please be advised this is not a guarentee and A Flash In Time Photography has every right to deny the photoshoot without explaination.
9.5 If you do not show up at all to your session the retainer is forfeited and you will pay a fee of $20 along with a new $20 retainer for a new session if you would like to book again.
9.6 In the event something tragic happens or an illness occurs, A Flash In Time Photography will contact you within 24 hours to reschedule, there will be no fee for this. In my 5 years of professionally doing photography I've never had to reschedule and I always strive to make it on time to every single session.
10.1 If the weather is non permitting A Flash In Time Photography will contact you and discuss options for rescheduling. You do have the option to keep the session even if the weather is non permitting but A Flash In Time Photography does hold the right to cancel the session (even during) due to the weather being a threat to equipment or if it's not possible to shoot in. Please be advised that if you choose to keep your session during a day with non permitting weather that the photos may not turn out exactly as you may have hoped (lack of sun, cloudy, etc) and A Flash In Time Photography is not held liable for that if you chose to keep your session. If A Flash In Time Photography does cancel the session during the shoot because the weather is too much you will still owe the full balance and there will be no refunds as we tried to reschedule but the client decided to proceed and that is out of our hands.
10.2 There are no fees for rescheduling due to non permitting weather. As long as A Flash In Time Photography agrees the weather is non permitting.
11.1 If any photos by A Flash In Time Photography are used for any type of publication (online marketing, magazine, modeling, clothing, basically anyway that earns the client profit) A Flash In Time Photography is to recieve 15% of all sales.
