LIABILITY WAIVER AND RELEASE OF CLAIMS
Arizona Dirt Kings Off-Roading Participant Agreement

This Liability Waiver and Release of Claims (“Agreement”) is entered into between the undersigned participant (“Participant”) and Arizona Dirt Kings, its owners, members, officers, employees, volunteers, sponsors, event organizers, and affiliated partners (“Released Parties”).

1. Assumption of Risk
I, the undersigned Participant, acknowledge that participating in off-roading events and related activities involves inherent risks, including but not limited to: vehicle accidents, collisions, rollovers, equipment failure, terrain hazards, personal injury, death, or property damage. I understand and voluntarily accept all risks associated with participation.

2. Release of Liability
In consideration for being permitted to participate in any Arizona Dirt Kings event, I hereby release, waive, discharge, and covenant not to sue Arizona Dirt Kings, or any of the Released Parties from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained while participating in the event, whether caused by negligence or otherwise.

3. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or costs (including attorney’s fees) incurred due to my participation in the event.

4. Responsibility for Personal Property
I acknowledge that I am solely responsible for my vehicle, equipment, and personal property. Arizona Dirt Kings, is not responsible for any theft, loss, or damage.

5. Medical Treatment
I authorize Arizona Dirt Kings, to secure emergency medical treatment on my behalf if deemed necessary. I understand and agree that I am responsible for all medical costs incurred.

6. Photo/Video Release & Consent
I understand that photographs, videos, and other media may be taken during the event for promotional, marketing, and social media purposes. I hereby grant Arizona Dirt Kings, and its affiliates the right to use my name, image, likeness, and voice in all forms and media, without compensation, for lawful promotional purposes, including but not limited to social media, advertisements, event recaps, and website content.

If I do not wish to be included in photos/videos, I understand it is my responsibility to notify Arizona Dirt Kings, in writing prior to the event.

7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona. Any legal action related to this Agreement shall be brought exclusively in the courts of Maricopa County, Arizona.

8. Severability
If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Acknowledgment of Understanding
I have read this Agreement in its entirety. I fully understand its terms and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Agreement freely and voluntarily and intend by my signature to completely and unconditionally release Arizona Dirt Kings, from all liability.

IF PARTICIPANT IS UNDER 18 YEARS OF AGE:
I am the parent or legal guardian of the minor named below. I have read and understand this waiver, and I voluntarily agree to its terms on behalf of my minor child. I consent to their participation in Arizona Dirt Kings events and agree to be bound by all terms of this Agreement.
