SERVICE AGREEMENT
Terms & Conditions:
1. DEFINITION
The parties referred to in this Agreement shall be defined as follows:
1.I.Company, Us, We: The Company, as operator of the mobile bar, makes the certain Services on it, available to customers. Athena Mobile Bar, Company, Us, We, Our, Ours and other first person pronouns will refer to the Company, as well as all employees and affiliates of the Company.
1.II. You, the Customer, the Client: You as the client will be referred to throughout this Agreement with second-person pronouns such as You, Your, Yours, or as Client.
1.III. Parties: Collectively, the parties to this Agreement (the Company and You) will be reffered to as Parties.
1.IV. Shall be subject to all the policies and procedures of the Athena Mobile Bar. This mean the client is covered and must abide by all the terms and conditions imposed by Athena Mobile Bar whether or not the Client is informed about it.
2. AGE RESTRICTION
2.I. You must be at least Eighteen (18) years of age to avail our services.
2.II. The Company assumes no responsibility or liability for any misrepresentation of Client's age.
3. PRODUCT PACKAGES & SERVICES
3.I. Athena Mobile Bar offering a wide range of drink options: A mobile bar can serve a variety of drinks, including cocktails, beer, wine, and non-alcoholic options, catering to the preferences of all guests.
3.II. Hours - 3 hours service with 2 hours alloted time for setup.
3.III. Exceed/Extend - Exceeding to 3 hours service or additional/extending hours will be charged depend on the packages pax.
50 PAX - PHP 1,500
100 PAX - PHP 3,000
150 PAX - PHP 5,500
200 PAX - PHP 7,000
250PAX - PHP 9,500
Note: We are allowed to extend maximum 2 hours only
3.IV. Both Parties shall agree that Mobile Bar use will only be allowed for a minimum of two (2) hours and maximum of five (5) hours only to avoid drunkenness. The Client will also have to be fully responsible for the behavior of any of their drunk guest.
3.V. Transportation - Free transportation within Metro Manila only! outside the mentioned Area will be charged depend on the given location.

3.VII. Add-Ons - We have other products that can be added to an existing Packages with additional Fee/Charged.

Note: Shall agree that all add-ons must be officially requested via email of the said items complete with the clients’ signature there on. All add-ons must be made not less than seven (7) days before the booked event date. However, should the client wish to add item less than seven (7) days before the event., a Ten percent (10%) surcharge will be added to every additional requested item. Strictly, no official add-ons request with payment, no processing of add-ons.
4. EQUIPMENT DAMAGE POLICY
Damage to equipment beyond normal usage will be subject to a fee:
Glassware:
a. Broken Shot Glass - Php30
b. Broken Big Glasses – Php150
Liquor Bottles:
a. Broken Bottle - Php350
Bar Material:
a. Kiosk - Php10,000
b. Roman Column - Php3,600 each
c. Backdrop - Php15,000
Note: Shall be shouldering the actual repair cost of any damaged part(s) of the Mobile Bar, the Chateau or any part of the entire equipment and materials, in the event that the damages(s).
5. TERMS OF PAYMENT:
5.I. 20% Up-front fee is required to blocking off of the preferred date and time. Payment for the completion of the 50% of the total package availed three (3) days before the booked event. Failure to pay this amount would mean automatic forfeiture of all the reservation fees made and forfeiture of the event date reserved. In short, the reserved slot may be given already to the other interested clients without even notifying the booked client about it. We are accepting payments via meet up, online banking or E-wallets.

5.II. The remaining 50% balance is due upon the arrival of our team at the said event date. Client required to make full payment before/during the event.
6. RESCHEDULE/POSTPONEMENT/CANCELLATION POLICY
Our Policy:
Appointment cancellation will result in a cancellation fee. The amount of the fee will be equal to the up- front fee, non-refundable and non-transferrable. In case of event postponement/reschedule, the client must inform "Athena Mobile Bar" at least Ten (10) days before the scheduled event, can no longer entertained if notice or advice was given less than Ten (10) days before the actual event date. Therefore, the client can no longer refund the booked services or exchange them other items, or products and services.
It must be noted that if and when the Client suddenly cancels their appointment, all payments made to Athena Mobile Bar remain non-refundable and non-transferrable and cannot be exchanged for any items or services as stipulated in this contract.
Should there be any cancellation made for whatever reason including but not limited to personal reasons, death of parties force majeure, fortuitous events, or acts of God, or due to war, civil disturbances, riots, mutiny, social unrest, governmental order or directive or for any reasons whatsoever, all paid amount is automatically forfeited. Therefore, it cannot be refunded or transferred to anyone else at all. Strictly, the said amount cannot be exchanged for any item or consumed by any products and services.
7. LIABILITY
7.I. Athena Mobile Bar, will set 2 hours alloted time and coordinator assure that bar attendants have access to the event facility at least 60 minutes before the event starts to allow us to set up and prepare the products.
7.II. Client must provided meal for the bar attendants of Athena Mobile Bar.
7.IV. Athena Mobile Bar, shall not liable for any accidents or injuries that may occur during the event. The client is responsible for ensuring that all guests adhere to safety regulations and have to be fully responsible for the behavior of any of their drunk guest. Should there be any violation on this, the Client will be held solely, legally, and fully responsible for the misconduct of any his/her guest, and any other untoward consequences and damages whatsoever brought about by such sessions and/or illegal activities.
7.III. Athena Mobile Bar, shall not liable for any other fees of the Client(s) to the venue or event place, such as time violation, damages, exceeding of using the venue, corkage fees and etc. In principle, the Client agrees to shoulder all the penalties and charges imposed by event place and company should there be any violation of the above-mentioned guidelines by any of their guests and supplier.
8. Digital Negatives, Prints & Copyright
All images and copyrights are the property of Beyond the Athena Mobile Bar Photography by ("Photographer"). In exchange for services provided, Photographer retains the exclusive right to copy, edit and distribute any/all images created under this agreement, to the general public, for any reason, including but not limited to: advertising, marketing, sales, print competitions, educational seminars, and monetary gain. The mediums for display could include newspapers, magazines, books, television, and the internet, but are not limited to only those mediums. The Photographer retains these rights even if image files are turned over to the Client. The RAW/unedited images remain sole property of Photographer and will never be given or sold.
The Copyright Act protects photographers by giving the creator of the photograph the exclusive rights to copy, edit and distribute the image by sale or transfer. These exclusive rights make it illegal to copy, scan, edit or share photographic prints and digital media without the photographer’s permission. Violators of this Federal Law will be subject to its civil and criminal penalties.
The images that are being provided to you are licensed to you for any reason personal, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. Photographer may revoke this license at any time and for any reason. Photographer retains all copyrights to the images and derivative works thereof.
If you are posting any of the digital files to social media (Facebook, Twitter, Pinterest, Instagram etc.) OR if you share or use any digital files from either Facebook or my website, you may not alter the image in any way (no words or filters added) and you must give credit to Athena Mobile Bar.

ACKNOWLEDGEMENT OF AGREEMENT
General Provision:
I. Retention of Records and Confidentiality - The Company (Athena Mobile Bar) shall be entitled to retain the copies of all applicable documents, policies, and other information provided by the Client. In addition, the Company (Athena Mobile Bar) shall maintain in strict confidence except when required by law, during the term of and after the termination of this agreement, the information obtained during the documentation in the audit reports. Both Parties, shall obtained written consent from the client or the Company for disclosing information to a third party. Where required by law to release confidential information to a third party, the Company "Athena Mobile Bar" and the Client will, unless regulated by law, notify the Client or the Company concerned of the information provided.
