a. Membership level is a commitment, and refunds are not applicable unless proof of re-location out of state or over 75 miles from club
b. This membership level is automatically renewed unless 30 days in person written notice is provided.

When joining the club (BARC), all membership levels will require a credit card to be put on file. The card will not be charged unless dues are not received before the 1st of each month. The club charges late fees and return fees for accounts that cannot be processed due to insufficient funds or change of account status.

*Hold Policies and Procedures

Month to Month Members- Payment for 1st and Last month membership is due at time of application. If you cancel your month-to-month membership and rejoins in less than 12 months, there will be a $79 membership activation fee. (30-day notice in person written cancellation)

6 Month Semi-Annual Members- Member(s) can put (1) hold not to exceed 1 month. Hold must be done in person with 30 days written notice.

12 Month Annual Members- Member(s) can put up to (2) hold not to exceed 3 months. Holds must be done in person with 30 days written notice.

18 Month Members- Member(s) can put up to (2) holds not to exceed 4 months (in total Holds must be completed in person with 30 days written notice. For all items that a member charges to their account, it will be processed timely and accordingly by staff.

I/We the undersigned, hereby make application for membership to Bay Area Racquet Club. I/We understand and agree to abide by the rules and bylaws. I/We understand that membership is for 12 months (unless otherwise indicated) from enrollment month. Membership dues are payable in advance and are not transferrable or refundable. All memberships will be automatically renewed on the 1st of each renewal month. Any cancellation must be provided in writing 30 days prior to annual renewal date.

NOTICE: THIS IS A LEGALLY BINDING AGREEMENT. Read this document carefully and in entirety. By signing this agreement, you give up your right and the named minor's right to bring a court action to recover compensation or obtain any other remedy for any personal injury or property damage however caused arising out of the named minor's participation in Bay Area Racquet Club Programs or activities, now or at any time in the future.

I, in my legal capacity as the parent/guardian of the minor named below, do hereby acknowledge, and agree that participation in any activities comes with inherent risks. I have full knowledge and understanding of the inherent risks associated with any activity or program participation, including but in no way limited to: (1) slips, trips, and falls, (2) aquatic injuries, (3) athletic injuries, and (4) illness, including exposure to and infection with viruses or bacteria. I further acknowledge that the preceding list is not inclusive of all possible risks associated with any activity or program participation and facility use and that said list in no way limits the operation of this Agreement.

WAIVER, RELEASE, INDEMNIFICATION & COVENANT NOT TO SUE

In consideration of 's participation at Bay Area Racquet Club Summer Programs, I, the parent/guardian of the minor named above, agree to release and on behalf of myself and the minor named above, my heirs, representatives, executors, administrators, and assigns, HEREBY DO RELEASE Bay Area Racquet Club, its officers, directors, employees, volunteers, agents, representatives and insurers ("Releasees") from any causes of action, claims, or demands of any nature whatsoever including, but in no way limited to, claims of negligence, which I, my heirs, representatives, executors, administrators and assigns may have, now or in the future, against Bay Area racquet Club on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to the use of BARC'S facilities/equipment or participation in BARC Tennis programs whether that participation is supervised or unsupervised, however the injury or damage occurs, including, but not limited to the negligence of Releasees.

In consideration of the named minor's participation in BARC Tennis programing or access to facilities, I, the undersigned parent/guardian of the named minor, agree to INDEMNIFY AND HOLD HARMLESS Releasees from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to the named minor's activity and program participation.

I hereby certify on behalf of myself and the named minor that I have full knowledge of the nature and extent of the risks inherent in activity and program participation and that I, on behalf of myself and the named minor, am voluntarily assuming said risks. I understand that I and the named minor will be solely responsible for any loss or damage, including personal injury, property damage, or death, the named minor sustains while participating in any activity or programs and that by signing this agreement I on behalf of myself and the named minor HEREBY RELEASE Releasees from all liability for such loss, damage, or death. I further certify that the named minor is in good health and has no conditions or impairments which would preclude his/her safe participation in activities or programs at BARC.

have the legal capacity to act as the parent/guardian of the named minor. I further understand that the terms of this agreement are legally binding and certify that I am signing this agreement, after having carefully read it, of my own free will.

Automated Charge/EFT Charge Authorization I realize ALL program fees and program guest fees incurred by my family/membership will be automatically charged from my payment on file at Bay Area Racquet Club. I also realize that I may cancel my program by giving a written notice at least 14 days prior to the next session registration date. Program events are on an auto-renewal basis. I have given authorization to the institution listed (Bay Area Racquet Club) to honor precharge transactions drawn by Bay Area Racquet Club. I realize that my account statement will constitute receipt for payment, I also realized that if pre-authorized charges are not honored by said institutions, I am responsible for the total payment by other form of payment. This authority is to remain in effect until revoked by me with a 14 Day written notice for all programs; 30 Day written Notice for all memberships and until BARC receives such notice, I agree that you should be fully protected in honoring such charges,

Participation in Bay Area Racquet Club sponsored classes, activities, or programs, constitutes permission by the club to use any of the photos for the participants for promotional purposes without remuneration.
