Participant Waiver, Release of Liability, and Assumption of Risk Agreement
In consideration for being allowed to take part in the Bay Area Skating Academy, Skatesational, Skate Better Now, Velocity Blade (the "Hosts) Activities (the “Activity”) organized by the Hosts, including its owners, employees, agents, volunteers, officers, partners, and anyone else acting on its behalf (collectively, the “Released Parties”), I agree to the following terms in this Waiver and Release Agreement (“Agreement”).
1. Understanding the Risks
I acknowledge that roller skating, and related activities naturally involve risks of injury or harm. These may include, but are not limited to:
-Falling, collisions, or loss of balance.
-Physical strain or injury such as sprains, muscle tears, fractures, or concussions.
-Injuries to the head, neck, or back.
-Equipment issues, including broken or malfunctioning skates or gear.
-Hazards within or around the facility, including uneven flooring, debris, or other -participants.
-Actions or negligence by others or by the Released Parties.
I understand that this list does not cover every possible risk, and unexpected events may occur that could result in injury, illness, property damage, or even death.
2. Voluntary Participation and Acceptance of Risk
I understand the nature of this Activity and choose to participate voluntarily. I knowingly and freely assume all risks, both known and unknown, including those that may arise from the negligence or fault of the Released Parties.
3. Release of Liability
To the fullest extent permitted by law, I release and hold harmless the Released Parties from any and all claims, demands, or causes of action arising from or related to my participation in the Activity. This includes claims that may result from the negligence of the Released Parties or others.
4. Agreement Not to Sue
I agree not to file or support any lawsuit or claim against the Released Parties for any loss, damage, or injury I may experience as a result of participating in this Activity.
5. Indemnification
I agree to defend, indemnify, and hold harmless the Released Parties from any liability, costs, damages, or expenses (including attorney’s fees) that result from my actions or participation in the Activity.
6. Health and Medical Authorization
I affirm that I am physically fit and capable of safely taking part in this Activity. Should I become injured or ill, I authorize the Hosts or its representatives to seek emergency medical care on my behalf and agree to assume financial responsibility for any related expenses.
7. Media Release
I grant the Hosts permission to capture and use photos, videos, or recordings of me or my child during the Activity for promotional, educational, or marketing purposes in print or digital form, without compensation or additional approval.
8. Safety Acknowledgment
I agree to follow all safety instructions and guidelines provided by the Hosts and it's staff. I understand that protective gear—such as helmets, wrist guards, knee pads, and elbow pads—is recommended for my safety. If I choose not to wear such gear, I accept all associated risks.
9. Severability Clause
If any part of this Agreement is found invalid or unenforceable, the remainder shall continue to be valid and in full effect.
10. Governing Law and Venue
This Agreement shall be governed by the laws of the State of California. Any legal disputes shall be resolved in the courts of Pleasanton, California.
By electronically signing below, I confirm that I have read this Agreement fully, understand it, and voluntarily agree to all of its terms. I acknowledge that I am giving up certain legal rights, including the right to sue, and that I am signing this Agreement knowingly and willingly.
