Informed Consent/General Release

PLEASE READ CAREFULLY AND SIGN BELOW TO INDICATE YOUR AGREEMENT.

This VOLUNTARY WAIVER & RELEASE AGREEMENT ("Agreement") is executed by the undersigned, or if under the age of 18, by their parent or legal guardian (collectively, "Participant"), for the sole benefit of the Organizers (as defined below). In connection with the Participant’s involvement in any contest, promotional activity, or other event relating to ice skating or similar ice-related activities (individually and collectively, the "Event"), the Participant certifies, warrants, represents, agrees, and covenants to BH Skating Parks LLC d/b/a Chill Entertainment, along with any event sponsors, producers, talent, or promoters (individually and collectively, including their affiliates, officers, employees, partners, shareholders, members, board members, sponsors, volunteers, tenants, contractors, agents, successors, and assigns, collectively the "Organizers"), that they are:

(1) FREE OF ANY MENTAL OR PHYSICAL CONDITION, AILMENT OR INJURY (MEDICAL OR OTHERWISE) WHICH WOULD, IN AND OF ITSELF OR IN CONJUNCTION WITH ANY OTHER CIRCUMSTANCE, INCLUDING, BUT NOT LIMITED TO, THOSE ACTIVITIES ASSOCIATED WITH THE EVENT, (i) IMPAIR, PREVENT OR PROHIBIT PARTICIPANT FROM ENGAGING IN SUCH EVENT ACTIVITIES OR (ii) BE AFFECTED, AGGRAVATED OR WORSEN IN ANY WAY AS A RESULT, DIRECTLY OR INDIRECTLY, OF PARTICIPANT’S INVOLVEMENT IN SUCH EVENT;

(2) OF SOUND MIND AND BODY AND NOT UNDER THE INFLUENCE OF ALCOHOL OR ANY ILLICIT OR PRESCRIPTION DRUG OR MEDICATION WHICH MAY IN ANY WAY IMPAIR PARTICIPANT’S ABILITY TO ENTER INTO THIS AGREEMENT, FULLY UNDERSTAND THE RESPECTIVE INTENT AND MEANING OF ALL OF THE TERMS AND PROVISIONS HEREOF AND TO PARTICIPATE IN THE EVENT; AND

(3) ENTERING INTO THIS AGREEMENT VOLUNTARILY, BY PARTICIPANT’S OWN FREE WILL, ACT AND DEED, WITHOUT ANY UNDUE INFLUENCE FROM THE ORGANIZERS OR ANY OTHER THIRD PARTY.

ASSUMPTION OF RISK. PARTICIPANT AGREES THAT HE/SHE DERIVES A MATERIAL BENEFIT FROM THE EVENT AND/OR PARTICIPANT’S INVOLVEMENT THEREIN. BY EXECUTION OF THIS AGREEMENT, PARTICIPANT AGREES AND ACKNOWLEDGES THAT A STRENUOUS ACTIVITY, SUCH AS ICE AND/OR ROLLER SKATING, IS POTENTIALLY HAZARDOUS, AND PARTICIPANT HEREBY ASSUMES ALL RISKS ASSOCIATED WITH PARTICIPATING IN THE EVENT, INCLUDING, WITHOUT LIMITATION, FALLS, CUTS, CONTACT WITH OTHER PARTICIPANTS, THE EFFECTS OF WEATHER AND THE CONDITION OF EVENT OR PLAYING SURFACES, INCLUDING, WITHOUT LIMITATION. FURTHERMORE, PARTICIPANT EXPRESSLY AND UNCONDITIONALLY ASSUMES ALL RISKS AND DANGERS KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN, AND RELATING OR INCIDENTAL TO PARTICIPANT’S INVOLVEMENT IN THE EVENT AND ANY ACTIVITY ASSOCIATED THEREWITH. PARTICIPANT HEREBY RELEASES, FOREVER DISCHARGES AND HOLDS HARMLESS THE ORGANIZERS FROM AND AGAINST ANY AND ALL CLAIMS (WHETHER SUCH CLAIM IS BASED ON CONTRACT, NEGLIGENCE, TORT, INCLUDING STRICT LIABILITY, OR OTHER LEGAL THEORY), DAMAGES, LIABILITIES, COSTS AND EXPENSES, WHETHER KNOWN OR UNKNOWN, INCLUDING, BUT NOT LIMITED TO, DEATH, PERSONAL INJURY OR PROPERTY DAMAGE OF ANY KIND OR NATURE, ARISING OUT OF OR RELATING TO PARTICIPANT’S INVOLVEMENT IN THE EVENT AND ALL ACTIVITIES ASSOCIATED THEREWITH.

Participant understands that by signing this Agreement, Participant covenants and agrees that Participant, as well as such Participant’s heirs, executors, administrators, successors and assigns, will never institute any suit or action at law, or otherwise, against any of the Organizers, or in any way aid in the institution or prosecution of any claim, demand, action or cause of action for damages, costs, loss of services, expenses or compensation for or on account of any damage, loss or injury either to Participant’s person or property, or both, which may result from the Participant’s participation in the Event or any other event associated therewith. Participant agrees to indemnify, defend and hold the Organizers harmless from any loss or damages (including attorneys’ fees and costs) sustained by the Organizers as a result of Participant’s rescission of this Agreement or breach of its covenants or agreements contained in this Agreement. Participant agrees that during the Event, the Organizers are authorized to secure appropriate medical attention for Participant in the event of an accident, illness or injury. Participant shall be responsible for any and all costs of medical coverage and treatment provided not covered by insurance.

IMAGE RELEASE. Participant further agrees that the Organizers shall have the right to photograph, film, record, broadcast, exhibit, distribute and otherwise exploit in any and all media throughout the world Participant’s activity/performance in the Event and to use Participant’s name, likeness, voice and biographical information in connection therewith without any compensation being paid to Participant. Participant acknowledges that he/she has no expectation of privacy in connection with Participant’s attendance at, or participation in, the Event. Participant covenants not to sue any of the Organizers for any use of Participant’s name, voice or likeness as provided herein.

GOVERNING LAW. The validity, interpretation, construction and enforcement of this Agreement shall be governed and controlled by the laws of the Commonwealth of Massachusetts, without regard to its rules with respect to choice of law. If any provision of this Agreement shall for any reason be held invalid or unenforceable, such invalidity or unenforceability shall not affect any other provision hereof and this Agreement shall be construed as if such provision were omitted.

THE WAIVER AND RELEASE GRANTED BY PARTICIPANT HEREUNDER IS LEGALLY BINDING AND SHALL BE CONSIDERED IRREVOCABLE. PARTICIPANT AGREES THAT THE ORGANIZERS MAY RELY UPON THIS AGREEMENT TO THE FULLEST EXTENT PERMISSIBLE AT LAW OR IN EQUITY.

PARTICIPANT CERTIFIES THAT ALL INFORMATION PROVIDED ON ALL FORMS PROVIDED TO THE ORGANIZERS IN CONNECTION WITH OR RELATING TO THE EVENT IS TRUE, ACCURATE AND COMPLETE IN ALL RESPECTS.

Consentimiento Informado / Liberación General

POR FAVOR LEA CUIDADOSAMENTE Y FIRME A CONTINUACIÓN PARA INDICAR SU ACEPTACIÓN.

Acepto que soy el único responsable financieramente de cualquier pérdida resultante de mis acciones y/o las de mi hijo(a) menor y que indemnizaré y eximiré de responsabilidad a Cross County Center, Brooks Shopping Centers LLC, cada afiliado de los anteriores, y los afiliados, propietarios, administradores, directores, empleados y agentes de cada uno de los anteriores (colectivamente, los “Indemnizados”) por cualquier pérdida, daño o responsabilidad de cualquier tipo y carácter (ya sea basado en negligencia, contrato, agravio, estatuto o de otra manera) (colectivamente, “Pérdidas”) en las que incurra cualquier Indemnizado y que sean causadas directa o indirectamente por mí o por otros durante esta actividad.

Este ACUERDO DE RENUNCIA Y LIBERACIÓN VOLUNTARIA ("Acuerdo") es firmado por la persona abajo firmante o, si es menor de 18 años, por su padre, madre o tutor legal (colectivamente, el "Participante"), para el beneficio exclusivo de los Organizadores (según se define a continuación). En relación con la participación del Participante en cualquier concurso, actividad promocional u otro evento relacionado con el patinaje sobre hielo o actividades similares en hielo (individual y colectivamente, el "Evento"), el Participante certifica, garantiza, declara, acuerda y se compromete con BH Skating Parks LLC d/b/a Chill Entertainment, junto con cualquier patrocinador del evento, productor, talento o promotor (individual y colectivamente, incluidos sus afiliados, oficiales, empleados, socios, accionistas, miembros, miembros de la junta, patrocinadores, voluntarios, inquilinos, contratistas, agentes, sucesores y cesionarios, colectivamente los "Organizadores"), que:

ESTÁ LIBRE DE CUALQUIER CONDICIÓN, DOLENCIA O LESIÓN (MÉDICA O DE OTRO TIPO) QUE, POR SÍ SOLA O EN CONJUNTO CON OTRA CIRCUNSTANCIA, INCLUYENDO, PERO SIN LIMITARSE A, LAS ACTIVIDADES ASOCIADAS AL EVENTO, (i) IMPIDA, PREVENGA O PROHÍBA SU PARTICIPACIÓN EN DICHAS ACTIVIDADES DEL EVENTO O (ii) SE VEA AFECTADA, AGRAVADA O EMPEORADA DE CUALQUIER MANERA COMO RESULTADO, DIRECTA O INDIRECTAMENTE, DE SU PARTICIPACIÓN EN EL EVENTO;
ESTÁ EN PLENAS FACULTADES MENTALES Y FÍSICAS Y NO SE ENCUENTRA BAJO LA INFLUENCIA DE ALCOHOL NI DE NINGUNA DROGA O MEDICAMENTO ILÍCITO O RECETADO QUE PUEDA AFECTAR DE ALGUNA MANERA SU CAPACIDAD PARA CELEBRAR ESTE ACUERDO, COMPRENDE PLENAMENTE LA INTENCIÓN Y SIGNIFICADO DE TODOS SUS TÉRMINOS Y CONDICIONES, Y ESTÁ CAPACITADO PARA PARTICIPAR EN EL EVENTO; y
ESTÁ FIRMADO ESTE ACUERDO DE MANERA VOLUNTARIA, POR SU PROPIA VOLUNTAD Y DECISIÓN, SIN NINGUNA INFLUENCIA INDEBIDA DE LOS ORGANIZADORES NI DE TERCEROS.
ASUNCIÓN DE RIESGO
El Participante acepta que obtiene un beneficio material del Evento y/o de su participación en él. Al firmar este Acuerdo, el Participante acepta y reconoce que una actividad exigente, como el patinaje sobre hielo y/o el patinaje sobre ruedas, es potencialmente peligrosa, y por lo tanto, asume todos los riesgos asociados con la participación en el Evento, incluidos, sin limitación, caídas, cortes, contacto con otros participantes, efectos del clima y el estado de las superficies del evento o de juego. Además, el Participante asume expresamente y sin condiciones todos los riesgos y peligros, conocidos o desconocidos, previstos o imprevistos, relacionados o incidentales con su participación en el Evento y cualquier actividad asociada.

El Participante, por la presente, libera, exonera para siempre y exime de responsabilidad a los Organizadores de cualquier reclamación (ya sea basada en contrato, negligencia, agravio, incluyendo responsabilidad estricta, o cualquier otra teoría legal), daños, responsabilidades, costos y gastos, conocidos o desconocidos, incluyendo, pero sin limitarse a, muerte, lesiones personales o daños a la propiedad de cualquier tipo o naturaleza, que surjan de o estén relacionados con la participación del Participante en el Evento y todas las actividades asociadas.

El Participante entiende que al firmar este Acuerdo, se compromete y acuerda que él/ella, así como sus herederos, albaceas, administradores, sucesores y cesionarios, nunca iniciarán ninguna demanda o acción legal contra los Organizadores, ni ayudarán en la iniciación o el enjuiciamiento de ninguna reclamación, demanda, acción o causa de acción por daños, costos, pérdida de servicios, gastos o compensación por cualquier daño, pérdida o lesión, ya sea a su persona o propiedad, que pueda resultar de su participación en el Evento o cualquier otro evento relacionado.

El Participante acepta indemnizar, defender y eximir de responsabilidad a los Organizadores por cualquier pérdida o daño (incluidos honorarios de abogados y costos) sufridos por los Organizadores como resultado de la rescisión de este Acuerdo o del incumplimiento de sus términos. Además, el Participante acepta que, durante el Evento, los Organizadores están autorizados a obtener atención médica adecuada en caso de accidente, enfermedad o lesión, y será responsable de todos los costos médicos no cubiertos por su seguro.

LIBERACIÓN DE IMAGEN
El Participante acepta que los Organizadores tienen el derecho de fotografiar, filmar, grabar, transmitir, exhibir, distribuir y explotar en cualquier medio, a nivel mundial, su actividad o desempeño en el Evento, y utilizar su nombre, imagen, voz e información biográfica en relación con ello, sin compensación alguna. El Participante reconoce que no tiene expectativas de privacidad en relación con su asistencia o participación en el Evento y se compromete a no demandar a los Organizadores por el uso de su nombre, voz o imagen según lo estipulado en este documento.

LEGISLACIÓN APLICABLE
La validez, interpretación, construcción y cumplimiento de este Acuerdo se regirá y controlará por las leyes del Estado de Nueva York, sin tener en cuenta sus reglas sobre la elección de la ley aplicable. Si alguna disposición de este Acuerdo se considera inválida o inaplicable por cualquier razón, dicha invalidez o inaplicabilidad no afectará ninguna otra disposición de este Acuerdo, y el mismo se interpretará como si dicha disposición no estuviera incluida.

DISPOSICIONES FINALES
LA RENUNCIA Y LIBERACIÓN OTORGADAS POR EL PARTICIPANTE EN ESTE DOCUMENTO SON LEGALMENTE VINCULANTES Y SE CONSIDERARÁN IRREVOCABLES. EL PARTICIPANTE ACEPTA QUE LOS ORGANIZADORES PUEDEN CONFIAR EN ESTE ACUERDO EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY.

EL PARTICIPANTE CERTIFICA QUE TODA LA INFORMACIÓN PROPORCIONADA EN TODOS LOS FORMULARIOS RELACIONADOS CON EL EVENTO ES VERDADERA, PRECISA Y COMPLETA EN TODOS SUS ASPECTOS.
