RELEASE, ASSUMPTION OF RISK, INDEMNIFICATION, AND HOLD HARMLESS AGREEMENT

In consideration of being permitted to participate in wrestling activities and to use the facilities and equipment of Built By Brunson Wrestling LLC, and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged, I agree as follows:
1. Release of Liability for Negligence
I, on behalf of myself and my children, parents, heirs, assigns, personal representatives, and estate, hereby knowingly and voluntarily release and discharge Built By Brunson Wrestling LLC, and its owners, directors, officers, employees, agents, volunteers, participants, and all other persons or entities acting on their behalf (collectively, the “Releasees”), from any and all claims, demands, causes of action, or liabilities of any kind arising out of or related to my participation in wrestling activities or use of the facilities or equipment, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by Illinois law.
This release does not apply to claims arising from willful and wanton misconduct or intentional acts.
2. Acknowledgment of Inherent Risks
I understand and acknowledge that wrestling is a physically demanding contact sport involving inherent risks that cannot be eliminated without changing the fundamental nature of the activity. These risks include, but are not limited to, bodily injury, emotional injury, paralysis, permanent disability, death, skin infections, medical conditions related to physical exertion, and damage to personal property such as clothing or equipment.
3. Assumption of Risk
I knowingly and voluntarily assume all risks, both known and unknown, inherent and non-inherent, associated with participation in wrestling activities, including risks arising from the negligence of the Releasees, to the fullest extent permitted by Illinois law. My participation is entirely voluntary, and I choose to participate despite these risks.
I agree that if I believe conditions are unsafe or that I am physically or medically unable to participate, I will immediately stop participating.
4. Indemnification and Hold Harmless
I agree to indemnify and hold harmless the Releasees from any and all claims, demands, damages, losses, liabilities, or expenses (including reasonable attorney’s fees and costs) arising out of or related to my participation in the activity, except to the extent caused by willful and wanton misconduct or intentional acts of the Releasees.
If the Releasees incur attorney’s fees or costs to enforce this agreement, I agree to reimburse them for all such fees and costs.
5. Insurance and Medical Representation
I represent that I have adequate medical and liability insurance to cover any injury or damage I may suffer or cause while participating, or I agree to personally assume all costs related to such injury or damage.
I further represent that I have no medical or physical condition that would prevent my safe participation, or I knowingly assume all risks and costs associated with any such condition.
6. Governing Law and Venue
This agreement shall be governed by and interpreted in accordance with the laws of the State of Illinois. Any legal action arising out of or relating to this agreement or my participation shall be brought exclusively in the state or federal courts located within the State of Illinois.
7. Severability
If any provision of this agreement is held to be invalid or unenforceable under Illinois law, the remaining provisions shall continue in full force and effect.
8. Knowing and Voluntary Execution
I acknowledge that by signing this agreement, I may be waiving important legal rights, including the right to sue for negligence. I confirm that I have had sufficient time to read and understand this agreement, have had the opportunity to consult with legal counsel if I chose to do so, and understand that participation may not be permitted or may cost more if I decline to sign this release.
I knowingly and voluntarily agree to be bound by the terms of this agreement.
PARENT OR GUARDIAN AGREEMENT
(Required for Participants Under 18 Years of Age)
I am the parent or legal guardian of the minor participant listed above. I consent to the minor’s participation in wrestling activities and agree to indemnify and hold harmless the Releasees from any and all claims, demands, damages, or causes of action arising out of or related to the minor’s participation, including claims alleging negligence, to the fullest extent permitted by Illinois law.
I understand that Illinois law may limit the enforceability of liability waivers signed on behalf of minors, and this agreement is intended to provide the maximum protection permitted by law.
