Waiver of Liability for Champions Food Truck Park Tenants
By participating as a Tenant at Champions Food Truck Park Inc., Mobile Food Units acknowledge and agree to the following:
1. This written rental agreement is exclusively between you, the Food Truck Owner and Champions Food Truck Park Inc. You are NOT entering into a rental agreement with any other party.
2. Assumption of Risk: The Food truck vendor understands that by leasing a parking space at Champions Food Truck Park Inc. and its location is held outdoors, carries an inherent risk, including but not limited to weather-related damage, theft, or accidents. Food Truck Vendors assume full responsibility for their property, their food, their staff, their customers and their person while parked at CFTP.
3. Liability Release: Champions Food Truck Park Inc., its staff, volunteers, and affiliates will not be held responsible or liable for any injury, loss, theft, or damage to personal property or goods that may occur before, during, or after hours of operation.
4. Indemnification: By submitting an application, the vendor agrees to indemnify and hold harmless Champions Food Truck Park Inc. and Church of Champions, its staff, volunteers, and affiliates from any and all claims, liabilities, or damages that may arise from their participation/leasing agreement/daily operations of your food truck while parked at our location.
5. Acknowledgment: By filling out this application, the Food Truck vendor acknowledges that they have read, understood, and agree to the waiver of liability and all of the rules of this leasing application.
6. We DO NOT permit the sale or distribution of alcoholic beverages at Champions Food Truck Park. They are also NOT ALLOWED on the Property.
7. Champions Food Truck Park is a Family-friendly environment. No alcohol or innapropriate content (language, images, or products) is permitted. We are a smoke-free property. No Vaping, Smoking, Illegal Drugs are permitted whatsoever.
8. Mobile Units are not allow to play any music or TV. CFTP Management is in charge of ALL music, live performances/musical bands, and what is televised on the big TV Screens in the dining area.
9. If you park your personal vehicle on the property we are NOT responsible for damage, theft or vandalism.
10. CFTP (CHAMPIONS FOOD TRUCK PARK INC) is only leasing you parking space for your food truck, we do NOT insure your equipment for any damages/vandalism/theft. You are advised to purchase your own insurance, at your own cost, to protect your food truck mobile unit and all of its contents inside.
11. Tenants additional obligations are as follows: take affirmative action to insure that nothing is done which might place landlord in violation of applicable health code regulations. You are to keep your designated parking area clean and remove all garbage and dispose of it daily in the on-site dumpster. You are only allowed to park your Food Truck Mobile Unit, you may NOT store or park anything else on-site. Tenant agrees that himself/herself, their staff, and customers will conduct themselves in a manner which will not disturb others. Tenant agrees to comply with all provisions of this agreement, particularly with respect to paying the rent on time, which is due on the 1st of every month. Tenant warrants that he/she will meet the above conditions in every respect, and acknowledges that failure to perform the obligations herein stipulated will be considered grounds for termination of this lease agreement and loss of ALL deposit.
