This Agreement applies to all residential and commercial clients.
1. Scope of Services
Cincy Lawn Care & Landscaping ("Company") agrees to provide lawn care, landscaping, and property maintenance services as approved by the Client. Services are limited to those agreed upon prior to commencement.
2. Estimates & Authorization
All estimates are based on visible conditions. By approving an estimate or allowing work to begin, the Client authorizes services and agrees to these terms. Additional work requires approval.
3. Payment Terms
Payment is due immediately upon completion unless otherwise agreed in writing. Failure to pay constitutes a material breach of contract.
4. Late Fees & Collections
A $25 late fee per day applies to unpaid balances starting the day after the due date. The Client is responsible for all collection costs, including attorney fees and court costs.
5. No Refund Policy
All payments are final and non-refundable. Cancellation after booking or during service results in forfeiture of all payments.
6. Limited Workmanship Guarantee
The Client must report issues within 24 hours. The Company will correct verifiable issues at its discretion. No refunds or credits will be issued.
7. Client Responsibilities
The Client must provide safe access, remove hazards, and secure pets. Failure releases the Company from liability.
8. Limitation of Liability
The Company is not liable for hidden hazards, pre-existing conditions, or indirect damages. Liability is limited to the amount paid for services.
9. Indemnification
The Client agrees to defend and hold the Company harmless from claims arising from unsafe conditions, negligence, or third-party issues.
10. Commercial Property Clause
The Client confirms authority for commercial properties. The Company is not responsible for tenant issues or business interruptions.
11. Cancellations & Access
Same-day cancellations or denied access may result in full charges.
12. Weather & Delays
Services may be delayed due to weather and rescheduled accordingly.
13. Refusal of Service
The Company may refuse service due to unsafe conditions, non-payment, or inappropriate behavior.
14. Service Area
Services are provided throughout the Tri-State area. Travel fees may apply.
15. Dispute Resolution
This Agreement is governed by Ohio law. Disputes are handled within Ohio jurisdiction.
16. Entire Agreement
This document represents the full agreement between the Company and the Client.
17. Acceptance of Terms
By signing or allowing work to begin, the Client agrees to all terms.
