*THIS CONTRACT IS EFFECTIVE UPON DELIVERY OF RECYCLING BINS AND/OR IF YOU ARE A CURRENT HELENA RECYCLING CUSTOMER*

Helena Recycling, LLC Service Contract 

This agreement, made between Helena Recycling, LLC, located at 3 Industry Loop, East Helena, MT 59635, and {yourName} is to state the terms and conditions under which Helena Recycling. LLC will furnish to {yourName} at {serviceAddress} the following curbside recycling service to City of Helena property owners who are assessed for residential solid waste service. 

1. Recycler will pick up every other week unless otherwise specified and agreed upon. Schedule emailed upon registration.
    
2. Payment:
   
   a. {yourName} who owns property at {serviceAddress}, agrees to pay up to $13.20/month. The City of Helena is currently subsidizing this rate at $8.20/month which reduces the monthly charge to $8.00/month. This subsidy may expire or be extended when so determined by the Helena City Commission.
   
   b. {yourName} agrees to render such monthly payments to the City of Helena on behalf of Helena Recycling, LLC. This monthly charge will be added to the water/sewer bill for this address and will be subject to terms and conditions for collection as specified by the City of Helena.
   
   c. Helena Recycling, LLC reserves the right to terminate services in the event that {yourName} does not comply with the terms and conditions.
   
   
3. Recycling Bins: Helena Recycling, LLC will initially provide 4-18 gallon bins with lids. Under the current agreement, the City of Helena will provide these containers to qualified customers at no charge. Bins and lids provided are the property of the City of Helena. If they are lost, stolen, damaged or mistreated due to customer negligence, there is a $15 replacement fee per bin and $8 replacement fee per lid. 
   
   
4. Instructions regarding recycling procedures and standards are available for review at www.helenarecycling.com under the “What’s Recyclable” link. {yourName} has reviewed these procedures and standards and agrees to comply with them and any subsequent written changes to these procedures and standards which Helena Recycling, LLC may reasonable deem necessary and make available. For materials that are not separated, not cleaned properly, or not broken down as instructed, Helena Recycling, LLC may choose not to pick up those recyclables. Customers are encouraged to comment on curbside recycling services at www.helenarecycling.com.
   
   
5. For any materials placed in bins that are not included in the recyclables list of what we can and cannot recycle, Helena Recycling, LLC will leave those non-recyclables in the bins.
   
   
6. If {yourName} chooses to terminate services with Helena Recycling, LLC she/he agrees to return bins to Helena Recycling, LLC.
   
   
7. There is absolutely NO sharing of the recycling bins. For example, employees cannot bring their recyclables from home to put into the business bins and/or residential customers may not allow neighbors or friends to deposit recyclables in their bins. If violated, Helena Recycling. LLC has the right to terminate all services.
   
   
8. Term of Agreement: Either party may, at any time during the term of this Agreement, terminate this Agreement upon thirty (30) days prior written notice.
   
   
9. Change of Terms: Rates and conditions of this Agreement are subject to change with (30) day notice.
   
   
10. {yourName} shall indemnify, defend and hold Helena Recycling, LLC harmless against any and all claims, suits, actions, liabilities, judgments or damages arising from Customer’s provision of materials for pick up by Helena Recycling, LLC which are not authorized by Helena Recycling, LLC.  

{yourName} agrees to Helena Recycling, LLC Service Contract and conditions stated in this document. This electronic confirmation email will be considered approval of the terms and conditions herein.
