Please review the following terms and conditions of exhibiting at Studio 23/The Arts Center (hereafter “Studio 23”). The artist selected for Visiting Artist Program (hereafter the “Artist”) will be provided a contract with important dates and deadlines upon acceptance.
Requirements of the Artist:
Membership in Studio 23 is a requirement to have an exhibit. Membership will be granted to the selected Visiting Artist for one calendar year.
Artists warrant that they have created and have unencumbered title to all artwork in the exhibit.
Artist will prepare an inventory list, to include: title, medium, size, date, insurance value, and sale price. The list must be returned at least three weeks before the exhibition opens to allow time to make and edit labels.
Artist will send a recent photograph of self, biography, artist statement, and at least two images of artworks that will be included in the artist’s exhibit. These will be used for marketing and press releases.
Artwork must be delivered to Studio 23 on the date designated on the contract or agreed upon between the Artist and the curator of exhibits. The cost of shipping artwork is at artist’s expense.
Artwork must be ready for the exhibit. Each piece should be identified on the reverse side or bottom. All wall-displayed works of art must be presented framed or gallery-wrapped. A framed work must have a wire on the back, French cleat, or appropriately sized sawtooth hanging hardware. No raw glass edges are acceptable. All other systems must be discussed with the curator of exhibits before a decision is reached.
The gallery space may be temporarily rearranged for community events and/or classes during the invited Artist’s scheduled exhibit.
Insurance for Exhibits:
Artist is responsible for the proper insurance coverage during the period of transportation and exhibition. Studio 23 is not responsible for any loss, theft, or damage to the works of art while in its possession or on display, specifically, from the date of delivery to Studio 23 until the date of delivery to the purchaser or return to the Artist.
All reasonable care will be taken with artwork. We strongly suggest that artists insure their work privately for adequate protection in all potential situations.
Liability:
Studio 23 is acting solely as a representative of the Artist, and neither it nor its members shall be liable for loss or damage to artwork, storage crates, personal belongings, or other related items on the premises (or exhibited elsewhere within the sole discretion and under the control of Studio 23) due to theft, loss, fire, or destruction by any cause.
Reproduction Rights:
The Artist reserves all rights of reproduction of consigned artwork. Studio 23 may publish photographs of all artwork for promotional and/or education purposes, as it may deem appropriate.
Publicity:
Studio 23 will provide online marketing with social media that includes Facebook and Instagram. Our website, blog, and mass emails will also include promotion of the exhibit. Printed materials will be provided in the form of postcards, flyers, and/or posters as funding allows. Press releases will be sent to regional news outlets.
Reception:
An opening reception, with light food and beverages, will be provided. Reception will take place on the first Thursday of the exhibit between 5 and 7 p.m. The Artist is encouraged to attend. Other events, such as artist talks, demonstrations, or tours, can be negotiated.
Sales:
At least seventy-five percent (75%) of the artworks in the exhibit must be for sale. Labels with prices are displayed near the artwork.
If a piece is not for sale, it is marked NFS or designated as being in an owner’s collection. The insurance value is based on the retail price of the NFS item.
All sales are consigned at sixty percent (60%) of sale price to the Artist and forty percent (40%) of sale price to Studio 23. Tax is collected by Studio 23. The Artist should allow a minimum of three weeks after the close of the exhibit (to allow for processing of all sales) before the Artist’s commission will be distributed.
If a collector makes an inquiry to Studio 23 about a work after the close of the exhibit and the work is available for purchase, the Artist will receive a sixty percent (60%) commission and a forty percent (40%) commission will go to Studio 23.
Return of Artwork:
The return date for the artwork will be designated in the signed contract. If that date doesn’t work, the curator of exhibits and the Artist will determine a workable date within a week following the close of exhibit. Artwork shipped to Studio 23 for exhibit must include proper packaging and a return shipping label in order to be returned to the Artist.
Artwork that is left at Studio 23 beyond 30 days will be considered a donation to Studio 23.
Hold Harmless Agreement:
The Artist agrees to hold Studio 23, its board of directors, staff, and volunteers harmless for damage, theft, or loss of artwork. The artist understands the risk of submitting/exhibiting artwork and accepts it through signing acceptance of this contract.
