RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY AND PARENTAL CONSENT AGREEMENT
In consideration of being permitted to participate in any way in the D1 Nation tournament, including but not limited to Tackle, 7v7 Skills, 5v5 Lineman Challenge, Girls Flag Football, Tackle Football, personal training, seminars, fitness activities, and sporting events (collectively referred to as the "Activity"), I, the undersigned, for myself, my personal representatives, assigns, heirs, and next of kin, acknowledge, agree, and represent the following:
1. Nature of Activity and Health Status:
I fully understand the nature of the training programs, events, and activities associated with the D1 Nation. I affirm that I am qualified, in good health, and in proper physical condition to participate in these activities. I agree that if, at any time, I feel the conditions become unsafe or that I am unfit to participate, I will immediately cease participation in the activity.
2. Acknowledgment of Risks: I fully understand that participation in the Activity involves inherent risks, including but not limited to physical exercise, sports, and recreational activities that may result in injury. These risks may include, but are not limited to, serious bodily injury, permanent disability, paralysis, and even death.
(a) These risks and dangers may arise from my own actions or inactions, the actions or inactions of others, the condition in which the activity takes place, or the negligence of the "Releasees" named below.
(b) I recognize that there may be other risks, including social and economic losses, either not currently known to me or not foreseeable at this time. I fully accept and assume all such risks and all responsibility for losses, costs, or damages incurred as a result of my participation or that of my child/ward.
3. Release and Waiver of Liability: I hereby release, discharge, and covenant not to sue the D1 Nation, its administrators, officers, directors, agents, members, volunteers, employees, other participants, sponsors, advertisers, and any owners or lessors of the premises on which the Activity takes place (collectively referred to as the "Releasees") from any and all liability, claims, demands, losses, or damages resulting from or related to my participation in the Activity, whether caused by the negligence of the Releasees or otherwise.
4. Indemnification: I agree to indemnify, save, and hold harmless each of the Releasees from any litigation expenses, attorney fees, losses, liability, damage, or costs which may arise from any claim or lawsuit brought against the Releasees due to my participation in the Activity, including claims arising out of my own negligence.
5. Acknowledgment of Parental Consent (for minors): I, the undersigned parent and/or legal guardian of the minor participant, hereby affirm that I understand the nature of the training programs, fitness activities, and sports training programs the minor will be participating in. I acknowledge that the minor is qualified, in good health, and in proper physical condition to engage in these activities. I also understand that participation involves inherent risks, as described above, and I fully accept and assume these risks on behalf of the minor.
6. Minor Release: I, as the parent/legal guardian of the minor participant, agree to indemnify, save, and hold harmless each of the Releasees from any liability claims, demands, losses, or damages related to the minor’s participation in the Activity. I understand that this release includes, but is not limited to, claims arising from the negligence of the Releasees or any negligent rescue operations.
7. Non-Refundable Registration Policy: I acknowledge and agree that the registration fees for participation in the D1 Nation are non-refundable. Once registration is completed and the deposit is paid, no refunds will be issued under any circumstances.
8. Binding Effect: I have read and understand this Agreement. I understand that by signing this document, I am giving up substantial rights, including the right to sue. I have signed it freely and voluntarily without any inducement or assurance of any kind. I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. If any portion of this Agreement is found to be invalid, the remainder of the Agreement will continue in full force and effect.
I affirm that I understand the above terms, and I give my consent to participate or allow my child/ward to participate in the D1 Nation activities.
