GEAR RENTAL WAIVER AND RELEASE OF LIABILITY
1. Acknowledgment of Risk
I acknowledge that outdoor activities, including the use of via ferrata, climbing, and other technical equipment, involve inherent risks that may result in injury, illness, disability, property damage, or death. These risks may arise from natural terrain, weather, improper use of gear, or other unforeseen hazards. I voluntarily assume full responsibility for all risks associated with the use of rented equipment from Dyno Outfitters.
2. Equipment Use, Experience, and Responsibility
I certify that I have the necessary experience, skills, and physical ability to safely use the equipment I am renting. I understand how to properly wear a harness and helmet, clip and unclip lanyards or carabiners, and use any other rented gear in accordance with standard safety practices. If I am unsure how to use any equipment, I will ask Dyno Outfitters staff before leaving the premises.
I further certify that I am within the manufacturer’s recommended weight limits for the gear I am renting (typically 90–265 lbs for via ferrata systems, including clothing and gear), and I accept sole responsibility for ensuring my compliance with these safety specifications.
3. Equipment Condition and Return Policy
I agree to inspect all rented gear prior to use and will immediately notify Dyno Outfitters of any damage or defect. I am fully responsible for the care and safekeeping of the equipment during the rental period.
I agree to return the equipment by the specified time and date as indicated in the rental agreement. I understand that late returns may incur additional charges, and that I will be held financially responsible for lost, stolen, or damaged equipment, up to the full replacement value. If anything happens to the gear, I agree to disclose all details of the event to Dyno Outfitters.
4. Release of Liability
In consideration for renting equipment from Dyno Outfitters, I release and discharge Dyno Outfitters, its owners, employees, contractors, agents, and affiliates from any and all claims, liabilities, or causes of action arising from my use of the rented equipment, including those caused by negligence or omission on the part of Dyno Outfitters.
5. Indemnification
I agree to indemnify and hold harmless Dyno Outfitters and its representatives from any claims, damages, or expenses (including attorney’s fees) arising from my actions or failure to follow proper use and safety guidelines while using the rented equipment.
6. Governing Law
This agreement shall be governed by the laws of the State of Utah. Any disputes arising under this agreement shall be resolved in the appropriate courts within the state.
7. Acknowledgment of Understanding
I have read this Gear Rental Waiver and Release of Liability in full. I understand its terms and acknowledge that I am giving up substantial legal rights, including the right to sue. I sign this agreement freely and voluntarily.
