Please read carefully. By signing this document, you waive certain legal rights, including the right to sue.

1. Acknowledgment of Physical Fitness and Good Health: By signing below, I attest that:

1. I am in good health and physically fit to participate in the Canberra E-Scooter Tours.
2. I have no medical conditions, impairments, or injuries that would make it unsafe for me to ride an electric scooter.
3. I have not been advised by any medical professional to avoid such activities. I am capable of standing and balancing on the e-scooter for the duration of the tour.
4. I am not under the influence of any substance which could impair my ability to safely participate.

2. Age, Height, and Minor Participation: I certify that I meet the minimum participation requirements. In particular, I am at least 18 years old and at least 120 cm (4 feet) tall. If I am signing on behalf of a minor: I am the minor’s parent or legal guardian and I consent to their participation. All participants under 18 years of age must be accompanied on the tour by a parent, legal guardian, or a responsible adult authorized by a guardian.

3. Participation and Safety Rules: I agree to observe all safety rules and instructions provided by Canberra E-Scooter Tours. This includes wearing a helmet and any required safety gear, following directions during the tour, and using the equipment only as instructed. I understand that the operator has the right to terminate my participation (without refund) if I fail to follow safety rules.

4. Assumption of Inherent Risks: I acknowledge that riding an electric scooter involves inherent risks and dangers, including but not limited to: losing control or falling; collisions with vehicles, bicycles, pedestrians, or objects; road hazards; weather conditions; and the acts of other participants. Such risks can result in serious injury, paralysis, death, or property damage. I freely and voluntarily assume all risks associated with participation.

5. Release and Waiver of Liability: To the fullest extent permitted by law, I waive, release, and discharge Canberra E-Scooter Tours and its affiliates from any and all liability for injury, death, or loss arising out of my participation, including any negligence by the Released Parties.

6. Indemnification and Hold Harmless: I agree to indemnify and hold harmless the Released Parties from any claims, losses, or expenses arising out of my participation. If signing for a minor, I indemnify the Released Parties for claims relating to the minor.

7. Medical Treatment and Insurance: I acknowledge that the operator does not provide medical insurance. I consent to emergency medical treatment if needed and accept responsibility for related costs.

8. Responsibility for Equipment and Property: I agree to care for the equipment provided and will be responsible for damage or loss caused by misuse. The Released Parties are not responsible for loss or damage to my personal property.

9. Applicable Law and Severability: This agreement is governed by the laws of the Australian Capital Territory. If any provision is found unenforceable, the remainder shall remain in effect.

10. Acknowledgment of Understanding: I have carefully read and understood this waiver. I sign freely and voluntarily, aware that I am giving up legal rights, including the right to sue.
