EMPLOYEE CELL PHONE STIPEND AGREEMENT
Recipients of a cell phone stipend have the following responsibilities:
• Employee acknowledges that the cell phone stipend will be paid a month in arrears (i.e. January's stipend paid in February) for full months of employment only. (If the employee fails to return the completed form annually by the due date or timely upon hire, the employee will be eligible for the stipend starting with the subsequent/next stipend payment date after the form is returned.)
• Employees on a leave of absence for any part of a month (i.e, FMLA, Noble Leave of Absence, etc.) will not receive cell phone stipend for any part of that month.
• Employees are responsible for purchasing cellular phone service and equipment and assume responsibility for vendor terms and conditions. The employee is responsible for plan choices, service features, and calling areas that meet the requirements of the job and the area of service the stipend is intended to cover. This includes termination clauses, and paying all charges associated with the cellular service and device.
• Employee agrees that they are responsible for the purchase, loss, damage, insurance, and/or replacement of phone equipment.
• Employee will promptly report to Human Resources any updates or changes regarding cell phone numbers or plan changes that could impact the access to cellular services.
• Employee agrees to carry the cell phone with them, keep it charged and in operational condition, use it appropriately, and be accessible for business use of the cell phone as required by department needs.
• Employee hereby acknowledges and agrees Noble is not liable for any illegal or prohibited uses of the cell phone.
• Employee acknowledges they will comply with all Federal and State data maintenance and protection laws (e.g., HIPAA, record retention requirements, etc.), as well as all Noble, Inc. procedures, including those pertaining to cell phone guidelines, data security, and acceptable internet and email use.
• Employee will delete any and all Noble, Inc. data from the cell phone when their employment with Noble, Inc. is ended.
