COVID-19 EVENT WAIVER OF LIABILITY AND AGREEMENT TO ASSUME THE RISKS OF PARTICIPATION
This waiver and agreement is intended to shift the risk of participating in an event at the Fayetteville Kennel Club, Inc. or sponsored by the Fayetteville Kennel Club, Inc. to me, the person participating in or attending the event and signing this document. Signing this document expresses my agreement to assume all risks of participating inthe event, including, but not limited to the risk of bodily injury, death, injury or death of a dog, and damage to property, as well as my agreement to waive all claims against the Fayetteville Kennel Club, Inc., its members, officers, Board of Directors, persons involved in putting on this event, sponsors of the event, and any provider of services involved in holding this event. I acknowledge and agree that the organization and persons conducting this event have the right to refuse me entry or tell me to leave the property where the event is being conducted for any reason that is not based on prohibited discrimination, and I agree to leave the property if I am told to do so.
I attest that I do not have COVID-19 at the time of attending this event. I also attest that I have not been in contact with or exposed to any known carrier of COVID-19 within the past fifteen days. I agree that I am attending this event entirely at my own risk and take full responsibility for my own health and safety during this event. I understand the risks of unknowing exposure to this and other illnesses by or to myself, my family, other participants, and third parties. I have not been tested and found positive; am not waiting for test results; and do not have symptoms. I agree that I will not knowingly expose others to any illness I may have or be at risk to have I will follow all rules and requirements to reduce any exposure and possibility of contracting or spreading the virus I will also fully cooperate with any City, County or State guidelines that apply in the area where the event is taking place. I agree that the Fayetteville Kennel Club, Inc., its members, officers, Board of Directors, persons involved in putting on this event, sponsors of the event, and any provider of services involved in holding this event are in no way liable for any present or future COVID-19 exposure or illness incurred at any time by any person, in attendance or not in attendance, during or after this Event.
In consideration of allowing me to participate in this event, I agree to hold the Fayetteville Kennel Club, Inc., its members, officers, Board of Directors, persons involved in putting on this event, sponsors of the event, and any provider of services involved in holding this event harmless from any claim for loss, injury, or damage that may be alleged to have been caused directly or indirectly to any person, animal, or thing while in or about the event premises or grounds or near any entrance thereto, and I personally assume all responsibility and liability for any such claim and agree to hold the aforementioned parties harmless from any such claim. Additionally, I agree to assume all risks of injury, death, damage, or loss related to attendance or participation in this event. I agree to assume the sole responsibility for and agree to indemnify, defend, and save the aforementioned parties harmless from any and all loss and expense (including legal fees) by reason of any liability imposed by law upon any of the aforementioned parties for damage because of bodily injuries, including death, at any time resulting therefrom, sustained by any person or persons, including myself, or on account of damage to property, arising out of or in consequence of my participation in or attendance at this event, regardless of how any such injuries, death, or property damage may be caused, and whether or not the same may have been caused or may be alleged to have been caused by the negligence of the aforementioned parties or any of their employees, agents, or any other persons.
I have read and understand this document. I understand that by signing the document, I forever give up, release, and waive any right I may have to bring suit against the Fayetteville Kennel Club, Inc., its members, officers, Board of Directors, persons involved in putting on this event, sponsors of the event, and any provider of services involved in holding this event. I understand that this means I give up my right to bring any claims including but not limited to claims for personal injury, death, disease, property losses, injury to or death of a dog, or any other loss, including but not limited to claims of negligence, and I give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. This agreement is binding on me, my estate, and my heirs.
