During the course of litigation, many probate complications occur that can impact the standing to file of a lawsuit or the ability to resolve of a lawsuit. These probate complications include deceased plaintiffs, deceased defendants, deceased beneficiaries, minors, persons with developmental disabilities, incarcerated persons, beneficiaries with special needs planning, and legally incapacitated adults. As part of its probate coordination services, The Probate Pro refers Clients to attorneys.

    Terms and Conditions for Probate Coordination

    This is an agreement between you and The Probate Pro. Please read these Terms and Conditions before using The Probate Pro’s probate coordination services. By using The Probate Pro’s probate coordination services, you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use The Probate Pro’s probate coordination services.

    Contacting us or communicating with us does not create an attorney-client relationship.

    The probate coordination service is not legal advice and is not performing any legal services.  The Probate Pro is not performing any legal services in regard to the probate coordination and the referral to a local probate attorney. The Probate Pro is not entering into an “Attorney/Client” relationship with the you. You should consult an attorney for legal advice regarding your particular situation.

    Your probate matter is being referred by The Probate Pro to the Cary Estate Planning Firm.

    The Probate Pro charges $1,500.00 as a probate coordination fee, and the Cary Estate Planning Firm charges $3,000.00 as the local probate legal fee. The total fee shall be $4,500.00. The probate coordination fee to The Probate Pro and the local probate fee to Cary Estate Planning are deferred until the conclusion of the underlying matter and are contingent upon a successful recovery.

    The Probate Pro makes no guarantee as to the outcome of any matter and the success of each person’s claim is speculative. Furthermore, The Probate Pro does not guarantee that your probate estate will be open prior to a statute of limitations or another deadline, if applicable. The Probate Pro shall not be liable if a statute of limitations or other law bars the underlying cause of action due to a probate estate not being timely opened.

    We hope that you are fully satisfied with all our probate coordination services. If there are any issues or concerns, please let us know. In the event of a dispute, controversy, or claim, in any way related to or arising out of this Agreement, the party and the The Probate Pro agree that it will be resolved through binding arbitration in Oakland County, Michigan. By expressly agreeing to binding arbitration, the Party is (a) waiving the right to a jury trial, (b) waiving the right to take discovery to the same extent as is available in a case litigated in a court, (c) waiving or limiting the right to appeal the result of the arbitration proceeding to specific circumstances established by law, and (d) agreeing to be financially responsible for at least a share of the arbitrator’s compensation and the administrative fees associated with the arbitration. (e) This Agreement includes arbitration of any and all legal malpractice claims against the lawyer. (f) A single arbitrator mutually acceptable to both the Party and The Probate Pro and will be utilized for the arbitration. The Party acknowledges that (1) if the Party declines to agree to arbitration at the onset of the relationship, there is no prohibition against The Probate Pro and the Party agreeing to arbitrate the matter at a later date. (2) Arbitration may be conducted as a private proceeding, unlike litigation in a court. (3) The parties can select an arbitrator who is experienced in the subject matter of the dispute. (4) Depending on the circumstances, arbitration can be more efficient, expeditious and inexpensive than litigation in a court. (5) the Party’s ability to report unethical conduct by The Probate Pro is not restricted.
