Summary.
Uphaven acts as a coordinator, bringing together volunteers willing to serve families who need transportation to medical treatment and other compelling needs. Due to federal regulations, as well as the fact that volunteers provide such services, Uphaven does not exercise operational control over the actual conduct of any transportation, over the pilots/drivers who fly/drive the missions, or over our volunteers' individual compliance with relevant regulations or laws. The reason for this is simple: the federal regulations already require those with flying privileges to obey all applicable regulations and laws, and the same is true for licensed drivers in each state. Uphaven also does not have the resources to monitor or supervise the conduct of each and every mission at an operational level, nor does it wish to interfere with the authority vested in the pilot in command by the Federal Aviation Regulations.
Therefore, in order to protect passengers, to ensure that Uphaven can continue to offer its coordinating services in the future, and to remind you that as a volunteer you are accepting these obligations every time you generously drive or fly a mission, we require that all volunteers sign this important affirmation acknowledging these duties and responsibilities before you are authorized for the mission requested. We ask all volunteers to agree to these affirmations. Please read the affirmation below carefully and provide your signature to indicate agreement to the statements. Affiliation with Uphaven is a privilege, and I understand it is subject to revocation.
I have read and understand Uphaven's Volunteer Communications, Internet & Social Media Policy, and I agree to abide by its terms and conditions.
I agree to HOLD HARMLESS Uphaven, its officers, directors, agents, employees, sponsors, donors, mission assistants, referring agencies, and all other entities or persons who may have assisted in arranging or participating in Uphaven-coordinated transportation, from any and all claims, liability, losses or damages incurred as a result of any activity associated with Uphaven.
I promise NOT to act as an Uphaven Command Pilot UNLESS I meet the following criteria:
- I hold a valid and current pilot certificate for the class and type of aircraft (if a type rating is required) in which I will be acting as pilot-in-command, and I am not aware of any active investigation involving the reasonable potential of action being taken against my airman privileges, including but not limited to investigations conducted by the FAA and/or the NTSB.
- I am in compliance with the medical requirements of FAR 61.53 for each flight.
- I and the aircraft I use as Command Pilot are in compliance with all applicable Federal Aviation Regulations, including but not limited to those regulations relating to flight reviews, day and night currency, fuel reserves, conduct of flight under instrument flight rules, annual (or 100-hour) inspections, IFR and pitot-static certifications, and documentation of all repairs and alterations, as well as any other inspections, records retention, certifications, authorizations, reports, and/or endorsements required by law.
- I will fully comply with all applicable regulations and laws when acting as a Command Pilot and whenever I cause or allow my aircraft to be identified with an Uphaven callsign.
- As appropriate for the pilot, aircraft and flight to be made, I meet the currency requirements (FAR 61.57) for:
- Day flights (FAR 61.57(a)(1));
- Night flights (FAR 61.57(b)(1)); and
- Instrument experience, if I am instrument-rated (FAR 61.57(c)).
- I am in compliance with all Federal Aviation Regulations relating to use of alcohol and drugs, including reporting requirements specified in the regulations.
- Whether flying rented or owned aircraft, I have in force liability insurance applicable to the flight providing minimum coverage of $1,000,000 per occurrence and $100,000 per seat.
- I am flying an aircraft with a valid standard airworthiness certificate (normal, utility, acrobatic, commuter or transport category) for flights carrying passengers, and I am aware of no condition of the aircraft, its engine(s), or its components that would result in noncompliance with legally required airworthiness standards, as defined in FAR Part 23.
- If I am renting an aircraft, I have met the requirements of the renting entity for currency, insurance, and any checkouts the entity may require. If I belong to a flying club, I am a member in good standing and I have met all requirements to fly club aircraft for which I am qualified. If I fly for hire, my employer(s) or contractor(s) have not currently suspended my flying privileges for any reason, other than legitimate business needs relating to demand for flights or unavailability of aircraft (such as being grounded for maintenance).
- I have completed one of the following within the last 12 months:
- Flight Review (per FAR 61.56), or
- Insurance-approved recurrent training program at an approved facility, or
- Part 121 or 135 line check, or
- New FAA certificate or rating check ride, or
- Instrument Proficiency Check (IPC) (per FAR 61.57(d)), or
- One phase of the FAA Wings Pilot Proficiency Program.
- I have met one of the following criteria within the last 90 days:
- Logged at least 12 hours as pilot-in-command in the applicable aircraft make/model, or
- Completed 2 hours of dual flight training with a certified flight instructor in the applicable aircraft make/model.
- I have retained all necessary records to confirm the completion of any of these requirements for Command Pilot qualifications.
- I have logged at least 250 hours total time as pilot-in-command and at least 75 hours cross-country as pilot-in-command; or I hold a valid Commercial certificate and at least 75 hours cross-country as pilot-in-command; or I hold a valid Airline Transport Pilot certificate.
- I will file a VFR or IFR flight plan for that portion of the flight when Uphaven passengers are on board. When flying VFR, I will use Flight Following where available.
- I will not conduct any mission as Command Pilot in night conditions (as defined in FAR 61.57(b)) unless I am both instrument-rated and current in instrument experience.
- I am 18 years of age or older at the time of the trip.
- I understand that I must be completely illness/symptom free (cold, flu, fever, stomach virus, etc.) for at least 72 hours prior to volunteering.
- I agree to make best efforts to keep private the information about passengers that the organization has provided to me, as well as any additional information provided by the passenger directly. I will not share photos of passengers or their personal information without their permission.
