Assumption of the Risk and Waiver of Liability
I recognize and understand the risks of physical injury inherent to tumbling, gymnastics,dance and dance training and I fully assume those risks. I hereby release Mentally Moving Mountains (hereby referred to as MMM) it's affiliates, event sponsors, employees, teachers, and coaches from all liability for injuries sustained or illnesses contracted while attending or participating in any dance classes, rehearsals, workshops, or performances. I agree to indemnify, defend, and hold harmless MMM, its affiliates, event sponsors, employees, teachers and coaches for liabilities, costs and judgments arising from acts of omissions committed by me or my child which result in injury or damage to any person or property.
MMM reserves the right to use photographs and videos taken during classes, workshops, performances, or other affiliated events for the purposes of instruction, advertising and promoting MMM and its programs. Students, or parents of students who are minors, who do not wish to comply with this policy must notify MMM prior to participation in class.
In case of physical injury or medical emergency, I hereby authorize MMM to make necessary arrangements to transport myself or my child to a medical treatment facility as necessary. All such transportation and medical treatment will be at my sole cost and expense. In extreme emergency, or if my child is under 18 years of age, I understand that MMM will attempt to notify the person(s) I have named below as my emergency contact(s) of my condition and how to reach me.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
MMM has put in place preventative measures to reduce the spread of COVID-19; however, MMM cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending MMM events could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending MMM events and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at MMM events may result from the actions, omissions, or negligence of myself and others, including, but not limited to, MMM employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance or participation in MMM events. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless MMM , its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of MMM, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any MMM program, class or event.
