QUITCLAIM DISCLOSURE, AUTHORIZATION & LIABILITY RELEASE
1. Scope of Services
KIS CONSULT (“KIS”) is being engaged solely to:
• Prepare a quitclaim deed based on information provided by the Client;
• Notarize the document when applicable;
• Submit the deed for recording with the appropriate County Property Appraiser/Recorder’s Office.
KIS does not perform title searches, ownership verification, legal representation, or any service beyond administrative preparation, notarization, and filing.
2. Client Representations and Warranty of Authority
The Client represents and warrants that:
• The Client is the lawful owner of the property being transferred or has full legal authority to execute the quitclaim deed on behalf of the lawful owner;
• All information provided to KIS is true, accurate, and complete;
• The Client accepts full responsibility for verifying the legal sufficiency of the deed for its intended purpose.
3. No Legal Advice Provided
The Client understands that:
• KIS is not a law firm;
• KIS does not provide legal advice or opinions regarding property rights, ownership, title issues, liens, encumbrances, estate matters, or the legal effect of executing a quitclaim deed;
• The Client is encouraged to seek independent legal counsel if legal guidance is needed.
4. Release of Liability and Indemnification
To the fullest extent permitted by Florida law, the Client releases and holds harmless KIS CONSULT, its owners, employees, contractors, and agents from any and all claims or liabilities related to:
• The preparation, execution, notarization, filing, or recording of the quitclaim deed;
• Errors or omissions in information provided by the Client;
• Title defects, ownership disputes, fraud, or lack of legal authority to sign;
• County recording delays, rejections, or additional requirements;
• Any legal, financial, or tax consequences resulting from the deed.
The Client agrees to indemnify and defend KIS against all claims arising from the Client’s inaccuracies, misrepresentations, or unauthorized execution of the deed.
5. Responsibility for Fees and County Requirements
The Client acknowledges responsibility for:
• All recording fees and documentary stamp taxes;
• Compliance with all county-specific requirements;
• Any additional charges imposed by governmental agencies.
KIS is not responsible for county rejections, statutory taxes, or administrative actions.
6. Acknowledgment
By submitting this form, the Client confirms that they:
• Have read and understood this disclosure;
• Agree to all statements and releases contained herein;
• Accept these terms as a binding condition of receiving services from KIS CONSULT.
