PHOTO SESSION AGREEMENT
1. The payment in full ($250 + taxes) is due at the time of booking. The session date and time is reserved only once the payment is received and the photo session agreement is signed.
2. If the Client cancels for any reason at any time, the total payment retainer is forfeited. The Client may postpone & reschedule their session in the event of an emergency or illness. In that case, 100% of the payment retainer will be applied to a future mini session spot within 12 months of the original booking.
3. If the Client arrives late to their session, the Photographer cannot guarantee that any or all of the planned photos will be taken for the Client. Late arrivals will result in the photo session being shortened or cancelled, and no refunds, reschedules, or credits will be issued.
4. A sneak peek will be posted on Gabrielle Touchette Photography social media, and approximately 25–50 unedited images will be posted in an online proofing gallery 7 days after the session. The Client will have 1 month to order their 6 favourite images from the proofing gallery.
5. The Photographer will edit the selected images and deliver the high-res JPGs via online download to the Client within one week of the order being placed. All photos will receive colour correction & sharpening, as well as basic editing. Basic editing does not include Photoshop work to fix skin, clothing, or facial features.
6. The Client is responsible for the appearance and cooperation of all participants in the photos. This includes the look of clothing, hair, kids' runny noses or dirty faces, cooperation of participants affecting appearances, or other unwanted visual elements.
7. If the Client requests additional Photoshopping beyond the standard included editing, the work will be billed at the rate of $100/hour.
8. The Photographer owns the copyright to all images created and has the exclusive right to use the images for marketing materials, contests, sample products, educational purposes, and for display on the Photographer’s website, blog, and social media. The Client may use the images for personal use only. The Client may not crop, edit, alter the photos, or upload the photos into AI generative or AI editing services.
9. The Photographer is not responsible for any injury, accident, loss, or damage sustained by the Client, members of the Client’s party, children, or guests during the session. The Client is responsible for the supervision and safety of their children and guests at all times and agrees to release the Photographer from any claims arising from such injuries or incidents. The Client is responsible for any damage to the studio, its furnishings, props, or equipment, or for any additional cleaning fees resulting from the actions or negligence of the Client, their children, or their guests. The Client will be responsible for reimbursing the Photographer for any such charges assessed by the studio.
