PORTRAIT AGREEMENT & MODEL RELEASE: I have read and agree to the following statement: I commission Geraldine Ralph Photography, the photographer, to photograph myself and/or my underage children. I hereby grant Geraldine Ralph and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of myself, family, and/or child(ren), or in which myself, family, and/or children will be included for editorial, trade, advertising, and any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. I hereby release Geraldine Ralph Photography and her legal representatives and assigns from all claims and liability relating to said photographs.*

Payment: No part of any order including previews will be delivered until the balance is paid in full. The studio / photographer reserves the right to use the images created under this contact for advertising, display, publication or other purposes. The client signing this contract warrants that he or she has the actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and and defend the studio / photographer in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of this studio / photographer. The studio / photographer may substitute another photographer to take the photographs in the event of studio / photographer's illness or of scheduling conflicts. In the event of such substitution, the photographer warrants that the photographer taking the photographs shall be a competent professional. If the studio / photographer cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the photographer's illness or emergency then the photographer shall return any deposit or sitting fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost though camera or media malfunction, lost in the mail or otherwise lost or damaged without fault on the part of the photographer. In the event the studio/photographer fails to preform for any other reason the studio / photographer shall not be liable for any amount of excess of all monies paid. The client is aware that the color dyes may fade or discolor over time due to the inherent qualities of dyes and client releases photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities. The charges in the contract are based on the studio's standard price list. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed. NOTICE OF COPYRIGHT: IT IS ILLEGAL to copy or reproduce these photographs or videos elsewhere without the studio's / photographer's written permission and violators of this Federal Law will be subject to its civil and criminal penalties. This contract incorporates the entire understanding of the parties and is governed by the laws of the city and state in which they were taken in. Any modifications of this contract must be in writing and signed by both parties.*

By signing below you certify that You are at least 18 years of age. You have read this portrait agreement/contract and fully understand the contents thereof. You agree that you have the legal authority to grant these permissions and accept all responsibility for such.*

A non-refundable session fee is due upon booking in order to reserve your Session. Session All remaining Balances including 6% sales tax is due upon signing. No part of any order will be delivered until the balance is paid in full. Your time and date is not reserved until the deposit is received full and clear. Therefore, the deposit is non-refundable upon cancellation with less than 48 hour notice. If you cancel with less than 48 notice, you forfeit your deposit and may not reschedule without a new deposit. Re-scheduling may occur to save your deposit if you give at least 48 hours notice and the date is rescheduled within 2 weeks of the original reserved date or if there is a family emergency or serious illness. I cannot always guarantee an available date two weeks out but will try my best to accommodate. Re-scheduling of the date due to bad weather may occur at my discretion only.*
