    Our Participant Service Agreement and Intake Pack is here to help you understand how we work together. It sets out the support and services available through The DARE Project, an initiative of The Solution Network Australia Foundation.

    This pack includes the Service Agreement, Client Intake Form, and Consent Forms. It gives you important information about our services, what to expect, and how we can support you. By completing the pack, you can tell us about your needs, preferences, and goals so we can provide support that suits you and aligns with your NDIS requirements.

    • Service Provider: The DARE Project, trading as The Solution Network Australia Foundation.

      AND

    • Purpose of Agreement:

    • This agreement sets out the responsibilities, supports, and rights of both the participant and The DARE Project, an initiative of The Solution Network Australia Foundation. It is designed to make sure the supports provided align with the participant’s NDIS plan and comply with NDIS requirements and relevant legislation.

      The purpose of this agreement is to ensure that the supports delivered by The DARE Project:

      • support the goals outlined in the participant’s NDIS plan
      • enable the participant to exercise choice and control in working towards those goals
      • assist the participant to build independence and take an active part in social and employment opportunities
      • comply with all relevant legislation, including the NDIS Act 2013, the Privacy Act 1988, and any other applicable laws and regulations

      This agreement will remain in effect for two years and will be reviewed every 12 months.

      These reviews will consider the participant’s progress towards their NDIS goals and any changes to their needs. Changes to this agreement may be made during a review or at any other time with the mutual agreement of both parties.

    • Support Services:

      The Support Services will be detailed in the Participant Intake Form. 

      Cost and Payments:

        Costs

      The following costs apply to supports provided by the DARE Project:

      • NDIS Price Guide: Costs for supports are aligned with the NDIS Price Guide and are subject to any changes according to NDIS guidelines.
      • Additional Costs: Any additional costs, including travel expenses, materials, or other incidental costs, will be communicated to the participant in advance.

      GST does not apply to these supports as they are exempt under the NDIS.

        Overdue Payments

      In the event of overdue payments, Solutions reserves the right to suspend supports or pursue debt recovery actions, in accordance with NDIA Terms of Business.

        GST Exemption

      For the purposes of GST legislation, the parties confirm that a supply of supports under this service agreement is a supply of one or more of the reasonable and necessary supports specified in the statement of supports included under subsection 33(2) of the National Disability Insurance Scheme Act 2013 (NDIS Act), in the participant’s plan currently in effect under section 37 of the NDIS Act.

    • The Solution Network Australia is an unregistered NDIS provider and as such are unable to support NDIA Managed participants.

      By accepting the delivery of support services in accordance with this Agreement, you acknowledge and agree to the terms and conditions outlined within this Agreement, as if you had signed it.

      You acknowledge that:

      • We have provided you a copy of our Client Service Charter, which outlines your rights, responsibilities, and expectations when engaging with our services, including information on:
        • The services we provide and how you can access them.
        • Your rights, including respect, privacy, and safety.
        • Your responsibilities, including providing accurate information and respecting staff and other clients.
        • Our commitment to providing a high standard of service, including how we will treat you with fairness, dignity, and professionalism.
        • How you can provide feedback or make a complaint about any aspect of our service, and how we will manage complaints.
        • Information on how we handle your personal information to ensure privacy and confidentiality in line with our Privacy Policy.
      • We have assisted you to understand the Charter.
      • We have provided you with information on how to access further details about these topics through the Client Service Charter, available in hard copy or online, and that you can request assistance if you need further clarification.

      Opportunity to ask questions and obtain independent advice

      • You have had the opportunity to have this Agreement explained to you.

      Introduction

      This Participant Service Charter outlines your rights, responsibilities, and what you can expect from us as your service provider. It also explains how you can provide feedback or make a complaint, and how we will handle your personal information. You will be made aware of this Charter when you engage our services, either in hard copy or online.

      About Us

      The DARE Project provides Community Participation, Capacity Building, and Group Activities as a project of The Solution Network Australia Foundation to support people living with a disability. You can find more information about our services on our website www.thegreatest.me and Solutions website www.solutions.org.au.

      Our Commitment to You

      We are committed to delivering high-quality services that respect your rights, safety and individual needs. You can expect that we will:

      • Treat you with respect, dignity, and fairness at all times.
      • Provide services in a safe, inclusive, and supportive environment.
      • Ensure your personal information is kept confidential and used appropriately in line with our Privacy Policy.
      • Inform you of your rights, responsibilities, and the terms of your services.
      • Address your feedback or complaints fairly and promptly.
      • Involve you in decisions about your care and services, including regular reviews to ensure your needs are met.
      • Provide services that align with your NDIS plan and represent value for money, adhering to any applicable price caps.
      • Communicate openly, honestly, and in a timely manner.
      • Respect the role of family, carers, and advocates where applicable.
      • Provide information about independent advocacy services upon request.

      Your Rights as a Participant

      As a participant receiving supports from Solutions, you have the right to:

      • Be treated with dignity and respect.
      • The dignity of risk—your choices and aspirations will be upheld as far as reasonably possible.
      • Nominate an advocate to act in your interests and accept the responsibilities outlined in this Agreement.
      • Request services that align with your NDIS plan, provided they comply with relevant laws and guidelines.
      • Participate in the development of this Service Agreement and eliminate supports you do not wish to participate in.
      • Privacy and confidentiality in accordance with relevant legislation.
      • Receive this Service Agreement and other communications in an accessible format (e.g., visual aids, different languages, or plain English) as required.

      Additional Right (if applicable): If you live alone and receive support from only one support worker, you have the right to participate in the selection of that support worker.

      Your Responsibilities as a Participant

      As a participant receiving supports from Solutions, you agree to:

      • Treat staff and other clients with respect and consideration at all times.
      • Provide accurate and up-to-date information about your needs.
      • Provide at least 24 hours' notice if you need to cancel or reschedule a booking or appointment.
      • Pay all fees by the due date as outlined in the invoice.
      • Communicate openly and cooperate with us to resolve any issues that arise during service delivery.

      Our Responsibilities as a Provider

      As your provider, Solutions agrees to:

      • Provide the supports detailed in your NDIS plan in a safe, respectful, and compliant manner.
      • Communicate openly and honestly in a timely manner.
      • Inform you of any organisational or sector-wide developments that may affect the provision of your services.
      • Provide at least 24 hours' notice if an appointment needs to be reschedule or cancel an appointment.
      • Respect the role of family, carers, and advocates where applicable.
      • Ensure the services provided are beneficial to your goals and represent value for money.
      • Regularly review your Service Agreement to reflect changes in your needs or NDIS guidelines.
      • Issue invoices and statements for supports delivered, following NDIA Terms of Business.
      • Comply with the NDIS Code of Conduct.

      Provide information on how to access independent advocacy services upon request.

      Our Rights as a Provider

      Solutions has the right to receive payment for supports rendered in accordance with the terms of this agreement. We also have the right to be informed of any changes to your circumstances that may affect the supports provided.

      Feedback and Complaints

      We welcome your feedback, whether it's positive or if you have concerns. You can provide feedback or lodge complaints through:

      1. Speaking directly with our staff.

      Privacy and Confidentiality

      We respect your privacy and will handle your personal information according to the Privacy Act 1988 and the NDIS guidelines. Your personal information will only be shared with third parties when necessary to deliver your supports or as required by law.

      Part B: Description of Supports (Schedule 1)

      Schedule 1 to this Agreement sets out all of the supports to be provided by Solutions to the Participant upon request. For each support, Schedule 1 includes;

      1. The name of the support to be provided       
      2. A description of the support
      3. Pricing and payment terms; and
      4. Details regarding when, where, and how the support will be provided, for how long, and by whom.

      Part C: Service Delivery Principles

      Solutions is committed to delivering services that meet the highest standards of quality and safety. Our service delivery is guided by the following principles:

      • Respect and Dignity: We will treat you with respect, dignity, and fairness in all interactions.
      • Inclusivity and Safety: We provide services in an inclusive, supportive, and safe environment, ensuring your rights are respected.
      • Person-Centred Approach: Our services are designed around your needs, preferences, and goals, as outlined in your NDIS plan.
      • Collaboration: We work with you, your family, carers, and other stakeholders to ensure that supports are aligned with your goals and delivered in the best way possible.

      We are committed to ensuring that your supports are delivered with integrity, transparency, and in a manner that promotes your independence and participation in the community.

      Quality Assurance and Improvement

      • Regular Feedback: Participants (or their family/advocate) will provide feedback on services through regular satisfaction surveys;       
      • Performance Evaluations: We will conduct evaluations to ensure services meet expectations;
      • Quality Reviews: An annual quality evaluation will be held with the Participant and relevant parties to discuss outcomes;
      • Continuous Improvement: Feedback will be used to improve services and align them with the Participant’s goals.

      Compliance with Legislation

      All services provided will comply with NDIS guidelines, the NDIS Act 2013, and any other applicable laws.

      Continuity of Supports
      In the event of unforeseen circumstances that may affect the provision of supports, Solutions will take all reasonable steps to ensure the participant continues to receive supports without interruption. This may include alternative support arrangements or coordination with other service providers as necessary.

      Part D: Costs & Payments

      Please refer to the Service Agreement Details section for all information regarding costs, payments and how your support services will be funded, including options for self-management, and plan management.

      Part E: Rights and Responsibilities 

      This Agreement follows the principles set out in the Client Service Charter, which provides a framework for:

      • The Participant's rights, including the right to dignity, privacy, and respect;
      • The Participant's responsibilities, including providing notice of cancellations and treating staff with respect;
      • The Provider’s rights and responsibilities, including the commitment to delivering safe and high-quality services in compliance with NDIS legislation and guidelines.

      For full details of the Participant’s rights and responsibilities, and the Provider’s responsibilities, please refer to the Client Service Charter, which complements this Agreement.

      Part F: Privacy and Data Protection

      Confidentiality

      Both parties agree to maintain the confidentiality of personal information in accordance with the Privacy Act 1988 and NDIS guidelines. Personal information will only be shared with third parties as required by law or with the consent of the Participant.

      Consent to Share Information

      By signing this Agreement, the Participant agrees to allow Solutions to share necessary information with third parties, including other service providers or professionals, as required to deliver supports in accordance with their NDIS plan.

      Data Protection

      Solutions will take all reasonable steps to protect the Participant’s personal information and data in compliance with Australian data protection laws. This includes securing electronic and physical records from unauthorised access.

      Part G: Feedback and Complaints 

      The process for providing feedback or lodging complaints is detailed in the Participant Service Charter, including the option to escalate any unresolved complaints to the NDIS Quality and Safeguards Commission.

      Part H: Definitions and General Provisions

      Glossary of Terms

      Advocacy: Supporting and representing the concerns and interests of Participants and their carers in interactions with service providers, government agencies, or other relevant entities.

      Agency: Refers to the National Disability Insurance Agency (NDIA), which administers the National Disability Insurance Scheme (NDIS).

      Assessment: An ongoing process of evaluating the Participant's needs, abilities, and goals to determine appropriate supports and services.

      Assistive Technology: Any device or system that helps a Participant perform tasks they would otherwise find difficult, supporting daily independence and participation.

      Carer: A person, such as a family member or friend, who provides informal, ongoing support to a Participant but is not paid as a formal support worker.

      The DARE Project: An initiative of The Solution Network Australia Foundation - the entity delivering the agreed supports under this Agreement.

      Participant: The individual receiving supports under the NDIS plan.

      Provider: The DARE Project, trading as The Solutions Network Australia Foundation - the entity delivering the agreed supports under this Agreement.

      Solutions: Meaning The Solution Network Australia Foundation

      Ending the Agreement

      This Agreement can be terminated by either party with 30 days' written notice. Notice must be provided in writing via dare@solutions.org.au.

      Upon termination:

      • Any outstanding payments must be settled by the Participant within 30 days of termination;
      • The Provider will ensure a smooth transition of supports or referrals to other providers, if necessary;
      • The Agreement may be terminated immediately if either party fails to uphold their responsibilities or commits a serious breach of the Agreement.

      Changing the Agreement

      Any changes to this Agreement must be:

      • Discussed and agreed upon by both parties;
      • Recorded in writing, including a timeframe for when the changes will take effect
      • Attached to this Agreement and signed by both the Provider and the Participant.

      Jurisdiction

      This Agreement is governed by the laws of Queensland. Any disputes arising from this Agreement will be subject to the jurisdiction of the courts of Queensland.

      Part I: Cancellation Policy

      To cancel a support session, the Participant must provide at least 24 hours' notice. If less than 24 hours' notice is given, up to 90% of the agreed cost of the support session will be charged, unless the cancellation is due to unforeseen or unavoidable circumstances, in line with the NDIS Price Guide.

      This cancellation policy is aligned with the responsibilities outlined in the Participant Service Charter, where Participants are expected to communicate openly and provide adequate notice for any changes.

    • What is Individual Service Planning?

      Individual service planning is a collaborative process where your supports service provider will discuss your future with you and assist you in identifying what you want to achieve while with the DARE Project, trading as The Solution Network Australia Foundation.

      The process helps you to:

      • Identify and prioritise your needs.
      • Decide how these needs can best be met, either through our services or others nearby. - Identify your long-term goals and how to work towards achieving them.

      What Will Your Individual Service Plan Include?

      During your service planning session, we will discuss your needs and goals and write these down in your plan. Your plan will outline:

      • Your strengths.
      • Your needs.
      • Your goals.
      • How these goals can best be met.
      • Who can support you in achieving these goals.

      We will sign the plan to show our commitment to carrying out the tasks identified during the session. We will also set a date for a follow-up meeting to review your plan's progress. If changes are needed at any time, please let us know, and we can adjust the plan before or during the next session.

      Note: This is your plan, and you will receive a copy to keep in a safe place.

      Can Someone Join You During the Planning Process?

      Yes, if you would like a friend, relative, or another support person to join you during planning sessions, please inform your case or support worker. We can also arrange for an interpreter if needed or provide other cultural or language support services.

      Privacy and Confidentiality

      Your personal information shared during the service planning process will be kept confidential and managed in accordance with our Privacy Policy and the Privacy Act 1988. Your information will only be used to deliver services and will not be shared without your consent unless required by law.

      You have the right to:

      • Ask questions about how your information will be used and shared.
      • Request clarification about our privacy practices at any time.
      • Access your personal information and request corrections to ensure its accuracy.

      We can provide this document or your individual service plan in alternative formats, such as large print, braille, or audio formats. Please let us know what works best for you, and we will make the necessary arrangements.

      Advocacy and Support Services

      If you need additional support, we can connect you with independent advocacy services to ensure your rights are upheld and you can make informed decisions about your care.

    • ACTIVITY RELEASE WAIVER

      The Participant agrees that by accepting an offer to participate in some or all of the recreational activities provided by the DARE Project, trading as The Solution Network Australia Foundation, the Participant has read, understood, approved and agrees to the following provisions: -

      In this Activity Waiver & Release, the expression ‘recreational services’ may include, but are not limited to, and are not required to, include activities such as:

      • Hiking
      • Surfing
      • Swimming
      • Woodworking
      • Sewing
      • Rope activities
      • Rock climbing
      • Bowling
      • Dancing
      • Exercise / fitness classes or activities
      • And other other recreational services, including but not limited to, dangerous recreational activity, offered by the Provider from time to time. 

      References to the Provider include the officers, employees, agents, representatives and contractors of the Provider.

      References to the Participant include the participant and the participant’s representative/parent/caregiver.
       
      References to “dangerous recreational activity” have the same meaning as that provided in the Civil Liability Act 2003 (Qld) s.18 that is “an activity engaged in for enjoyment, relaxation or leisure that involves a significant degree of risk of physical harm to a person.”
       
      This Activity Waiver & Release applies to all recreational services the participant has partaken in, is participating in and will be participating in, at any time of being a Participant of the Provider’s.
       
      At all times, the Participant:

      1. Accepts that all recreational services contain a degree of risk, and dangerous recreational activities contain a high degree of risk, and acknowledges that under the Civil Liability Act 2003 (Qld) s19(1): “a person is not liable in negligence for harm suffered by another person as a result of the materialisation on an obvious risk of a dangerous recreational activity engaged in by the person suffering harm”.  
      2. Expressly agrees to assume the risk of personal injury to their own person and to a person for whom they are responsible for supervision and care, while participating in recreational services offered by the Provider.
      3. Agrees to follow the directions of the Provider at all times to ensure the safety of not only the Participant, but also other participants and/or the Provider, and agrees to listen to instructions and briefings and to seek advice or clarification if any instruction or brief is not understood.
      4. Confirms that the Participant has no condition or injury that could be worsened or affected be the recreational services in a detrimental way to the Participant's health.
      5. Confirms that the Provider is not responsible for aggravation to any existing condition or injury whether disclosed to the Provider or not.
      6. Agrees, acknowledges and understands that some or all of the recreational services are physically strenuous activities, and that physical exertion is to be expected.
      7. Agrees, acknowledges and understands that if the Participant is injured in any way, no matter how severely, including but not limited to death, the Participant expressly accepts the risk of participating in the recreational services and will not hold the Provider responsible for any such injury or death.
      8. Confirms that the Participant is either: -
        a.    Over the age of 18 years of age and capable of giving consent; or
        b.    Is permitted to participate in the recreational services by the Participant's representative who has signed this Activity Waiver & Release.
      9. Agrees, acknowledges and understands that pursuant to Competition and Consumer Act 2010 (Cth) s139A, the guarantee given (under Competition and Consumer Act 2010 (Cth) s64) is excluded with respect to the supply of recreational services, but the exclusion, restriction or modification is limited to liability for: -
        a.    Death; or
        b.    A physical or mental injury of an individual (including the aggravation, acceleration or recurrence of such an injury of the individual); or
        c.     The contraction, aggravation or acceleration of a disease of an individual; or
        d.    The coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity , form of behaviour, course of conduct or state of affairs in relation to an individual:
             i.  That is or may be harmful or disadvantageous to the individual or community; or
             ii.     That may result in harm or disadvantage to the individual or community.
      10. Indemnifies the Provider against all claims, losses or expenses that may be made by any person by, or on on behalf of, the Participant.
      11. Consents to any medical treatment which may be considered necessary by the Provider in the event of injury or illness during the recreational services and indemnifies the Provider in respect of the cost of any such medical aid or treatment.
      12. Agrees, acknowledges and understands that the Provider may cancel or re-schedule any recreational service/s at any time due to weather, participant numbers and/or any other unforeseen reason or event at its absolute discretion.
      13. Agrees, acknowledges and understands that this Activity Waiver & Release is a Deed governed by the laws of Queensland and the Commonwealth of Australia.

    • 5. Service Fees and Payment Terms 
    • The DARE Project, trading as The Solution Network Australia Foundation, provides services in alignment with the National Disability Insurance Scheme (NDIS) price guide to ensure fair and transparent pricing for all participants. The fees outlined in this agreement cover the cost of services you receive, which are tailored to your individual needs and goals. All service rates are determined in accordance with NDIS guidelines and are subject to change if the NDIS price guide is updated. Participants will be notified in advance of any such changes.

    • Service Fees

    • Participants who are registered for support with the DARE Project, trading as The Solution Network Australia Foundation, will be charged only for the services booked and received by the Participant, in accordance with our payment terms. These fees are in line with the NDIS price guide, and you will only be invoiced for the supports you actively participate in.

      Please note: A minimum booking of 1-3 hours applies, depending on the Social Session the participant is attending.

      NOTE:

      • Provider travel labour may be charged at the applicable NDIS hourly rate where permitted by the NDIS Pricing Arrangements and agreed in advance.
      • Provider travel non-labour costs may be charged for reasonable vehicle running costs, parking, tolls or other agreed travel expenses where permitted by the NDIS Pricing Arrangements and agreed in advance.
      • Participant transport may be charged separately where the participant is transported as part of a support.
    • Core Funding (Support Category 4 – Assistance with Social & Community Participation)

      These items will be charged against the participant’s core budget because they relate to group social and recreational activities:

    • 3. Payment Terms

    • Invoicing and Payment:

      All core and capacity-building support services are invoiced fortnightly. Invoices will reflect all services provided within the two-week billing period.
      Payments are due within 14 days from the date of invoice unless alternative arrangements are made in advance.

      Cancellation Policy:

      General Supports

      If you need to cancel or change a scheduled support, please provide at least seven (7) clear calendar days’ notice.

      • If you cancel with less than 7 days’ notice, or do not attend a scheduled support, we may charge up to 100% of the agreed fee for the support, in line with the NDIS Pricing Arrangements and Price Limits.
      • This fee will only be charged if we are unable to find alternative billable work for our staff and are required to pay them for the time scheduled.
