Legal Age Requirement

The Member shall be at least sixteen (16) years of age, unless otherwise authorized by Hong Kong Parkview.

Usage of Gym During Non-Staffed Hours

I guarantee that I will not allow anyone else to use the gym during non-staffed hours without submitting the waiver. Should there be any violation of this rule by the Member, Hong Kong Parkview reserves the right and discretion to immediately suspend the Membership against the Member. If a registered member is found bringing an unregistered member into the gym during non-staffed hours, one month of non-staffed hour gym access will be suspended. If a registered member is found bringing a guest into the gym during non-staffed hours, one month of gym/full membership will be suspended.

No Supervision

I understand that Parkview Gym will have no supervision or assistance between the hours of 10 pm and 7 am. I am aware that if I get injured, become unconscious, suffer a stroke or heart attack, or any other medical emergency or event, there will likely be no one to respond to my emergency immediately, and that the Gym has no duty to provide assistance to me while I am at the Gym. I understand that even though the Gym is equipped with surveillance cameras, these records are not monitored continuously, and help will not be available during non-staffed hours. However, a first aid station, AED, and emergency alarms are located in the facility.

Acknowledgement of Rules and Regulations

I guarantee that I will abide by the rules and regulations implemented by the Gym. Should there be any violation of this rule by the Member, Hong Kong Parkview reserves the right and discretion to immediately suspend the Membership against the Member.

Acknowledgement of Consequences of Improper Behaviour

Alcohol, drugs (including steroids), and smoking are prohibited within the Facility. The Member agrees not to use the Facility or engage in any activity in Parkview Gym while under the influence of drugs, alcohol, or medication that may impair the Member's ability to operate the equipment. No weapons of any kind are allowed. No photography, videotaping, filming, or audio recording is permitted within the Facility without the express written consent of Hong Kong Parkview’s management. Hong Kong Parkview reserves the right, in its sole discretion, to limit the consumption of food or beverages, or to the use of outside equipment within the Facility. Gambling or gaming is prohibited within the Facility or on the premises. Should there be any violation of this rule by the Member, Hong Kong Parkview reserves the right and discretion to immediately suspend the Membership against the Member.

Acknowledgement of Terms and Conditions of Safety Alarm Service

I am aware that a safety alarm service has been installed and provided together with a panic button in the gym by Hong Kong Parkview. I understand that the service depends on network availability. The location element of the service currently works with all major networks, but the provision and accuracy of location data cannot be guaranteed. This includes (but is not limited to) the fact that accuracy of location information can vary considerably based on your location, with some areas in the gym having particularly low accuracy. Hong Kong Parkview will aim to have the Service available at all times. However, owing to the nature of network telecommunications and electronic communications upon which the Service is based, it is impossible to guarantee that the Service will be uninterrupted or error-free. Hong Kong Parkview will use all reasonable endeavours at all times to provide the Service in a timely manner and with reasonable care and skill. However, Hong Kong Parkview will not be liable if, for any reason, the Service is unavailable at any time or for any period. Hong Kong Parkview reserves the right and discretion to post cost and charge against the Member if there is any damage or loss incurring from the panic button device.

Acknowledgement of Risk and Waiver of Liability

I voluntarily assume the risk of injury, accident, death, loss, cost, or damage to my person or property and my accompanying unregistered member and/or guest which might arise from my use of the Gym, and I agree to hold harmless and release Parkview and all affiliated corporations, its owner, directors, employees, representatives, management, and all others from any and all liability. I also release all of those mentioned and any others acting on their behalf from any responsibility or liability for any injury or damage to myself, including those caused by the negligent act or omission of any of those mentioned or others acting on their behalf, or in any way arising out of or connected with my participation in any activities or the use of any equipment at the gym during staffed or non-staffed hours.
