By completing this form for Justin Cheramie’s Karate Academy you are agreeing to the following terms and conditions. I (or the student that I am signing up) is in good physical condition and is able to perform martial arts, including sparring/fighting, with no medical risk. I have consulted a physician and have received approval to undertake a martial arts training program. I recognize the risks associated with the martial arts and release Justin Cheramie’s Karate Academy and Justin Cheramie from any and all claims or liability for physical injury or damage to my person or property that may occur while I am on Justin Cheramie’s Karate Academy premises or result from such activity. I agree that I Justin Cheramie’s Karate Academy’s services, equipment and facilities at my own risk, and I accept full responsibility for all injuries or damages, notably, but without limitation, due to my negligence, and, by the present, discharge Justin Cheramie’s Karate Academy from all claims and legal procedures, present or future, known or unknown, resulting from the use of Justin Cheramie’s Karate Academy s services, equipment and facilities. This contract and its’ privileges are not transferable and cannot be assigned, bartered, or loaned to a third party at any time. I accept responsibility for any damage that I cause to any of Justin Cheramie’s Karate Academy’s property or equipment, either willfully, involuntarily or through negligence, and I agree to compensate Justin Cheramie’s Karate Academy for the full cost of repairs or replacement that result from said damage. I recognize that any and all solicitation whatsoever, or sale or rendering of services on Justin Cheramie’s Karate Academy’s premises is strictly forbidden without the prior written consent of Justin Cheramie’s Karate Academy. Justin Cheramie’s Karate Academy shall not be responsible for any of my personal property that is lost, damaged or stolen on Justin Cheramie’s Karate Academy ‘s premises. I agree that Justin Cheramie’s Karate Academy reserves the right to temporarily close the facility and/or suspend activities in order to effect repairs or maintenance, or for other reasons deemed necessary by Justin Cheramie’s Karate Academy management. Temporary closure may take place without prior notice. In such cases, I agree that I shall not seek compensation or a refund for the period of closure and/or suspension of activities or services. I agree to make payments to Justin Cheramie’s Karate Academy in the amounts and as per the dates specified in this contract. I agree to compensate Justin Cheramie’s Karate Academy fully for any additional or extraordinary costs it incurs in having to collect said payments. I agree that I am liable to Justin Cheramie’s Karate Academy for said payments regardless of my attendance at Justin Cheramie’s Karate Academy. I agree that I am liable to Justin Cheramie’s Karate Academy for said payments in full, plus any cost incurred in their collection by Justin Cheramie’s Karate Academy, notwithstanding the expiry date of this contract. I agree that Justin Cheramie’s Karate Academy reserves the right to add, remove, or restructure services, such as, but not limited to, the hours of operation and amenities offered without penalty to Justin Cheramie’s Karate Academy. Any addition, removal, or restructuring of said services or amenities may be without notice. I agree that, with good cause, which includes but is not limited to a breach or violation of the terms of this contract, Justin Cheramie’s Karate Academy has the right to suspend indefinitely or to cancel said contract at any point of the term. In the event of cancellation by Justin Cheramie’s Karate Academy, I agree that I will be refunded, within a reasonable amount of time, not more than the remaining portion of the contract for which I have paid in advance. I agree, that payments made to Justin Cheramie’s Karate Academy for monthly membership, specials, trials, or any other term arrangement are final. I agree that Justin Cheramie’s Karate Academy has the right to refuse refunds for reservations of any special offers, trials, monthly memberships, or any other term arrangement. I also agree that a request for refund may be made in writing and Justin Cheramie’s Karate Academy may withhold 50% of reservation fees for trials and special promotions. I have read, understood, agree with and accept ALL the terms conditions of this document, including Justin Cheramie’s Karate Academy’s rules and regulations, and by my initials and signature agree to abide by said rules.
