LIABILITY WAIVER/INFORMED CONSENT FORM
I desire to voluntarily engage in the Lane Wellness Co. Run The Yard: Homecoming Fun Run presented by Lane Wellness Co., LLC (the "Instructor") at The University of Tennessee at Chattanooga. I understand the activities may be strenuous and subject to risk of serious injury. I understand that I am responsible for monitoring my own condition throughout activity and should any unusual symptoms occur, I will cease my participation and notify the Instructor of the symptoms immediately.
I agree that I am voluntarily participating in these activities and assume all risks of injury, illness, or death. I take full responsibility for my own health and safety in participating in the activity and to the extent I deem advisable, will consult a physician before participating in any of the activities.
In signing this form, I acknowledge that I have carefully read this form and fully understand that it is a release of liability. I expressly agree to release and discharge the Instructor, Lane Wellness Co. LLC, the University of Tennessee at Chattanooga, and the state of Tennessee from any and all claims or causes of action and agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action against the Instructor, Lane Wellness Co. LLC, the University of Chattanooga, and the state of Tennessee for personal injury or property damage. I expressly agree to indemnify and hold the instructor harmless from any and all liabilities or claims made by other individuals or entities as a result of or relating to my participation in the fitness classes.
This release from liability shall be governed by Tennessee law. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence. If any portion of this form shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this form shall remain in full force and effect and the offending provision or provisions severed here from.
By signing this form, I acknowledge that I understand its content and that this form cannot be modified orally.
