TERMS & CONDITIONS / STATEMENT OF UNDERSTANDING
- Enrollment: You may enroll at any time during the month. When entering a class, the Rider remains in that class until such time as they are ready to move up a level. When the Rider is ready to move up a level, we will work with you to find an appropriate class that fits your schedule. If your schedule changes, we will work with you to find a different class that meets your needs. Classes begin promptly at their designated time to maximize every student’s lesson time. There will be no refunds for missed classes or late arrivals. If a student is more than 15 minutes late for a class, the class will be forfeited.
- Tuition: Tuition is charged in advance based upon your choice of package from our price list. Invoices will be sent out on the 20th of the month and are due by the last business day of the month prior to the commencement of classes for the new month. No payment, no class. Time slots not secured by payment will be forfeited. Payments are to be made via EFT to the account number on your Invoice.
- Public Holidays: Legacy Equestrian Centre is CLOSED on public holidays and the Easter Weekend. These days have been calculated into our rates. If your lesson day falls on a Public Holiday, you simply miss that lesson and move on to the next lesson date.
- December Holidays: We close with the factories in December and reopen on the 2nd Monday of January. These days are made up between October and mid December. It remains the parents responsibility to schedule these classes. No outstanding classes are carried over to January.
- Notice: Enrollment is on a month to month basis. Cancellation needs to be given at least two calendar months in advance. No cancellations are accepted between September and November. Any cancellations received during this period will only be effected from 1 January and all months in this period will remain payable.
- Waivers: A signed waiver form is required for each Rider before being allowed to ride for the first time.
- Adverse Weather and Safety Precautions: The Instructor reserves the right to cancel or postpone the lesson in bad weather conditions for safety reasons. If not yet started, these lessons can be rescheduled for a make-up day. Where a lesson has already commenced and has to be called off, theroy exercises, tack classes or a Q&A session may be conducted in replacement of the usual practical lessons.
LESSONS WILL ONLY BE CANCELLED IN THE EVENT OF LIGHTNING.
- Make-ups: Make-up lessons will be available on the presentation of a certificate from a doctor, dentist or other healthcare practitioner. A maximum of 1 make-up lessons per month will be allowed. This make-up lesson must be scheduled and arranged with the Instructor before the end of the current month. There will be no refunds or make-up lessons for any absenteeism, late coming or cancellations of any kind other than listed above unless a confirmed arrangement has been made with the Instructor at least 24 hours in advance. Make-ups will be assigned on a first come, first served basis. To take advantage of a make-up, you must be available during our scheduled make-up classes. In the event a class is cancelled as a result of poor weather, a make-up class can be rescheduled at no cost. Make-up lessons are to be arranged directly with the Instructor and the parent will be responsible for getting the child to the make-up lesson.
- School and Club Sports/Activities: Rider that partake in school/club and other extra mural sports and cultural activities and identify a conflict in riding lessons are to discuss these conflicts with the Instructor at least 24 hours in advance that an alternative SUITABLE day for lessons can be found. No make-ups will be given for lessons missed due to scheduled school/club activities.
- Helmets: For hygiene purposes, all riders are to own and bring to lessons their own helmet. Riders that do not have helmets at lessons will not be permitted to ride.
- Supervision: Parents are to remain present for the duration of the lessons.
- Arena Access: For safety, only riders are permitted to enter the arena
- Property: Legacy Equestrain Centre is not responsible for any lost or stolen property. Parents are to ensure that all equipment is clearly marked with the riders names to ensure easy identification. All unclaimed property will be handed over to a charitable organization at the end of the Term.
- Disruptive Riders: Riders that are disruptive to their fellow riders and cause continuous disturbances during class will be asked to sit out the lesson. Continuation of such behavior will result in the student being released from the program. Refunds in these instances will not be given.
- Allergies & Medical Conditions: Parents are required to advise Instructors of any and all Allergies and Medical conditions riders may have and ensure that the rider has any medication required with them at all times.
- Special Needs Riders: Please discuss any special needs your rider may have with our Instructors.
WAIVER OF RELEASE
The following waiver is required for anyone participating in horse riding lessons under the instruction of Jayde Coetzee and/or any affiliated Instructors of Legacy Equestrian Centre, (individually and collectively, the “Instructor”) at the premises of Legacy Equestrian Centre or any other premises where classes are been presented or where activities are being taken part in.
Agreement, Waiver, and Release
I, the Participant or Parent, have carefully read the description of Lessons for which I am/we are registering, and, in consideration for being permitted by the Instructor to participate in the activity, I hereby waive, release, and discharge any and all claims for damages for personal injury, death, or property damage which I may have, or which may hereafter inure to me, as a result of participation in Lessons. I hereby acknowledge that participation in Lessons does not guaranty that I/my child will be rider-safe. This release is intended to discharge in advance the Instructor from any and all liability arising out of, or connected in any way, with my participation in the Lessons. It is understood that this Activity involves an element of risk and danger of accidents, and knowing those risks, I hereby assume those risks. It is further agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns. I agree to indemnify and to hold Instructors free and harmless from any loss, liability, damage, cost, or expense which they may incur as the result of my or my child’s death or injury or property damage that I may sustain while participating in the Activity.
Parental Consent (Must be completed and signed by Parent/Guardian if participant is under 18 years of age)
I hereby consent that the rider/s registered in this registration may participate in the Activity, and I hereby execute the above agreement, waiver, and release on his/her behalf. I hereby assert that this rider/s is/are physically able to participate in said activity. I hereby agree to indemnify and hold harmless the Instructor from any loss, liability, damage, cost, or expense, which may occur as a result of death or injury, or property damage, that my child may sustain, while participating in the Activity.
I HAVE CAREFULLY READ THIS AGREEMENT, WAIVER, AND RELEASE AND FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN THE INSTRUCTORS AND MYSELF, AND I SIGN IT OF MY FREE WILL.
