Session Fees and Payment
For sessions held with Lindsay Maahs Photography, a $25 retainer is due to reserve your session. Retainers are non refundable, but are transferable once, to a different session, date & time within a 1 year time frame. The remaining session balance is due at or before the scheduled session. Payments can be made by cash, cheque (Lindsay Maahs Photography) or email transfer. Images will not be edited or relased until paid in full.
Exclusivity
It is understood that Lindsay Maahs Photography is the exclusive official photographer retained to perform the photographic services requested on this contract.
Image Minimum
The image minimum is the smallest size of gallery you will be shown. If the expected image minimum (10 images for MINI sessions) cannot be met, due to an unexpected circumstance at the fault of the photographer before, during or after the scheduled session - this may include but not limited to, equipment failure both during the session or post production, sickness or unexpected accident - Lindsay Maahs Photography will agree to a re-shoot of the purchased session. If the expected image minimum, cannot be met due to client’s failure to provide reasonable assistance or cooperation, or if lateness results in a shortened session Lindsay Maahs Photography holds no liability and no further actions shall be taken.
Weather (outdoor sessions)
Sessions may be delayed or rescheduled at the photographers discression, if rain is in the forecast or begins before the scheduled session has started. If rain occurs during the scheduled session and the image minimum can be met, no further action shal be taken and the session will be considered complete. If rain occurs during the scheduled session and the image minimum cannot be met, an additional session will take place at a date agreed upon by the photographer.
Lateness
Lateness will result in a shortened session at the descression of the photographer and according to the days schedule.
Rescheduling
If an illness or situation prevents a photo session from taking place at the request of the client, clients may use any payments made for another session, without penalty, according to the photographers schedule provided 24h notice has been given. MINI sessions are only held on specific dates throughtout the year and rescheduled sessions must adhear to the specific dates and prices may change from the session that was originally booked. Any price differences between MINI sessions will be made up by the client. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee or retainer are forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness or other circumstances beyond their control. Re-shoots are determined at the discretion of the photographer according to the photographers schedule. Re-shoots will not be given for poor choices of clothing, make-up, hair or lack of co-operation by client / family / children.
Studio
It is understood that the home studio of Lindsay Maahs Photography is a pet friendly environment. All animals will be kept on a different floor and will not come into contact with clients. Please advise Lindsay Maahs Photography of any allergy issues.
Gift Certificates
Contract must be signed by clients and invoice will be sent to purchaser. Sessions must be paid in full before session date.
Proofing Gallery / Final Selection
The collection of images within the online proofing gallery will be a selection of the best images from the session. Selections will be made at the photographers discression using professional judgement. Requrests to view every image from the session will not be upheld. Online proofing galleries will be available for 10 days - Final selections must be made within that time. A reloading fee of $25 is required for galleries left to expire before selection has been made. RAW images will not be released and are not available for purchase. Proofs within the online gallery will include basic editing and colour corrections. Final high resolution images delivered will include professional editing, artistic enhancements, basic retouching of blemishes, scars and softening of under eye circles - at the photographers discression according to creative vision. Additional retouching requrests may be discussed with the photographer and may requiere an additional fee for services.
Social Media
Only images with the ‘Lindsay Maahs Photography’ logo may be used on social media sites or if watermarked images are unavailable, credit must be given to Lindsay Maahs Photography.
Digital Media Storage
Client is aware that digital media may deteriorate over time and it is the clients responsibility to create back up copies of final high resolution images delivered. Lindsay Maahs Photography is released from any liability for any claims based on deterioration or loss of files by client. Images will be kept by Lindsay Maahs Photography for 6 months after images are delivered and are not guarenteed to be archived longer. Additional charges will apply for additional copies, retrieval of images once archived, along with reposting of galleries after they have expired.
Products
Product prices will be honoured up to 3 months following the release of images. Product prices are subject to change without notice. Product discount that may be included in sessions cannot be used to purchase additional digital files or digital collections - products only. There is a $50 minimum order required when product discounts are used.
Copyright
Lindsay Maahs Photography retains all copyrights to all images created during client’s session and reserves the right to use all images taken for any lawful purpose - this includes , but is not limited to advertising, marketing, promotion and publishing to social media sites, blogs or websites. Limited permission and print release will be given to the client for personal use only - personal printing of high resolution images and limited use on social media sites (watermarked versions or photo credit to Lindsay Maahs Photography). Editing, cropping, adding filters or using the images for anything outside of personal use - including, business promotion or other - is strictly prohibited.
Liability
The client will release Lindsay Maahs Photography of any liability due to injury caused during the session. It is agreed that all children and pets not be left unattended during session. For studio sessions client is aware that the home studio of Lindsay Maahs Photography is a pet friendly environment. While all pet will be put away during scheduled sessions, client will advise LMP of any allergy issues.
