2. RECONFIRMATION – Reconfirm the use and time of flights at least 24 hours for domestic and 72 hours for international. Failure to use any reservations may result in automatic cancellation of all continuing and return reservations.
3. From this point forward I understand and agree that monitoring International and Domestic flights will be my own responsibility, making use of the booking codes and websites I have been provided with. I understand and agree that I will have to notify either Luxury Travel Curators LLC or the supplier, of any cancelations or delays via email or phone, in order for them to amend bookings accordingly. Nor Luxury Travel Curators LLC or suppliers will be held responsible for airline cancelations or delays. Both parties will do their best to assist with rebooting your services and offer the available options. Cancellation fees, penalties may apply subject to each service and/or supplier.
4. CHECK-IN – Minimum check-in for domestic flights is 90 minutes and for international flights, 2 hours. BE PREPARED TO PRESENT A GOVERNMENT ISSUED PHOTO I.D. AT TICKET COUNTER.
5. If your plans change en-route, contact the travel agency or call the phone numbers provided on this document for assistance. Additional charges may apply. It is not necessary to purchase a new ticket if a refund is due. Please cancel your reservation prior to flight time or ticket will have no value.
6. Times, flights, and fares are based on current tariffs that are subject to change without notice.
7. TICKETS – Most tickets have value. Any unused flight coupons must be returned in order to determine refund value. Lost, stolen or destroyed tickets must be paid for until refund is received from the issuing carrier, subject to an airline imposed service charge.
8. HOTELS – are usually confirmed on a guaranteed payment basis. If you cancel or change plans, please notify your hotel(s) within the time period specified by that hotel. Rules may vary by property.
9. GROUP TRAVEL TOUR / PACKAGE – Prices are subject to change without notice due to currency fluctuations, tariff changes or increase in operational costs. In addition, group travel tours/packages are based on a minimum number of passengers traveling: if the number of passengers falls below the minimum required, a surcharge may be imposed on all passengers.
10. VISAS, PERMITS & PASSPORTS – Some countries we service require visas for most visitors, including citizens of the United States, Mexico, Canada and Australia. Each traveler will be responsible for all required documentation. This varies by country but generally includes a passport photo, a completed visa form, photo copy of the information pages of his/her passport and the visa processing fee. If the traveler would request, Luxury Travel Curators LLC will obtain all visas at additional cost. Each traveler is responsible for his/her own passport, permits and visas. Passports, in most cases, must be valid for at least six (6) month after completion of the partisipant's tour. The passport must also have at least two completely empty pages. Luxury Travel Curators LLC is not responsible for the refusal of a visa/permit to any traveller by any consulate. In the event of visa/permit refusal, and all expenses/cancellation fess shall be borne by the traveler. Check with your airline in case you have connecting flights overseas as part of your journey. It may be the case that countries you pass through en route to your destination may require a separate transit visa. This is just general information subject to changes at any time, therefore we encourage you to contact each embassy/consulate to confirm this information. Luxury Travel Curators LLC will not be responsible to update this information nor will be held liable in the event of changes.
11. IMPORTANT! – If you are at an airline ticket or passenger check-in counter with your confirmed ticket and find that the airline shows no reservations for you do not leave the counter. Check your ticket. If the status box shows “OK” for the flight in question, the airline must accommodate you on that flight, or if that is not possible, they must either find a substitute flight or pay you denied boarding compensation. If necessary ask to speak to a supervisor.
12. CANCELLATIONS AND REFUNDS – We reserve the right to charge processing fees in the event of refunds, cancellations and other services.
13. DISCLAIMER OF LIABILITY – This travel agency is acting as a mere agent for suppliers in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by this travel agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). This agency, therefore, shall not be responsible for breach of contract of any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, or injury to you or your travel companions or group members. Unless the term “guaranteed” is specifically stated in writing on your tickets, invoice, or reservation itinerary, we do not guarantee any of such suppliers’ rates, bookings, reservations, connections, scheduling, or handling of personal effects. Travel agent shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agent’s control. Traveler assumes complete and full responsibility for, and hereby releases the agent from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safely or security conditions at such destinations, during the length of the proposed travel. For medical information, call the Public Health Service (404) 332-4559. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. A traveler is hereby warned of such risks and is advised to obtain appropriate insurance coverage against them. Traveler’s retention of tickets, reservations, or bookings after issuance shall constitute a consent to the above, and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members.
14. Proof of identity is required for all travel – Without proper identification, or passport and necessary visas, you will not be permitted to depart. It is your responsibility to verify your necessary travel documents.
15. WE STRONGLY RECOMMEND TRAVEL INSURANCE – There are different types of medical, baggage or trip cancellations insurance from the supplier or the agencies. Note: Insurance coverage may not cover pre-existing conditions and may have other restrictions and exclusions. Consult the insurance carriers direct for details. Trip insurance or waivers provided by the supplier may not offer insolvency coverage.
YOUR AGREEMENT WITH YOUR TRAVEL ADVISOR
Your Travel Advisor is an experienced professionals who operates as INDEPENDENT CONTRACTORS. They are not acting on behalf of the agency, nor do they have the authority to bind the agency. What they do have is the travel expertise needed to enable them to work independently. What this means to you, the customer, is the best possible service and attention because it is in their best interest to have you as a satisfied client.
Your INDEPENDENT CONTRACTOR as well as Luxury Travel Curators LLC, act only as an agent for the various transportation companies, hotels, tour operators, cruise lines and other travel suppliers named in your itinerary and is not responsible for any act, failure, delay, injury, loss or omission in providing their services. Neither your INDEPENDENT CONTRACTOR nor Luxury Travel Curators LLC, maintains control over the operations, equipment or personnel of any supplier used in conjunction with your travel arrangements.
Neither Luxury Travel Curators LLC nor your INDEPENDENT CONTRACTOR shall be liable for any loss, injury, or damage resulting directly or indirectly from any acts of God, acts of governments or other authorities, or from any cause beyond the control of this travel agency and your INDEPENDENT CONTRACTOR nor liable for defaults of suppliers or any other person, company or entity not under its control.
Neither Luxury Travel Curators LLC nor your INDEPENDENT CONTRACTOR has any special knowledge regarding the financial condition of the suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). For information concerning such requirements and possible dangers at destinations, we recommend contacting the Travel Warnings Section of the U.S. State Department at www.travel.state.gov. For medical information, we recommend contacting the Centers for Disease Control at www.cdc.gov/travel. You hereby release Luxury Travel Curators LLC and your INDEPENDENT CONTRACTOR from all claims arising out of any problem covered in this the foregoing paragraphs. You agree that the courts in Miami, Florida, will be the exclusive jurisdiction for all claims brought by you or Luxury Travel Curators LLC, and you hereby submit to the personal jurisdiction of those courts.
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by us constitutes a binding assurance or promise about the insurance. We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.
WHAT YOU SHOULD KNOW ABOUT THE POSSIBILITY OF AIRLINE BANKRUPTCIES
Hopefully there will not be any more airline bankruptcies, but it has to be recognized that they might occur. You should know how they might affect you.
1. If an airline declares bankruptcy, it is not obligated to carry you or to refund tickets issued before the bankruptcy. Travel agents are not allowed to refund tickets on airlines which have declared bankruptcy. Money given to a travel agent immediately becomes to property of the airlines, and we are required by laws to comply with airlines’ orders.
2. If an airline declares bankruptcy, it might continue service, limit service, or stop completely. Other airlines might accept passengers under limited circumstances or may refuse to accept any passengers from the defaulted carrier. Meanwhile there are fine travel insurance plans available for passengers to protect themselves in case of airline bankruptcies.

This agency cannot guarantee, in view of the deregulation of airline fares, that the fare indicated on the ticket will be the lowest possible fare at departure date.
