AGREEMENT/JURISDICTION
The person(s) whose signature(s) appear on this contract, known as "Client", agrees that Natalia Hajnold, known as "Photographer", shall provide services to photograph their photo session to the best of her/his abilities, in the manner described in this document. This is a binding contract that incorporates the entire understanding of the parties, and any modifications must be in writing, signed by both parties, and physically attached to the original agreement.

PAYMENT
Client shall reserve the time and date of services by signing and returning this contract along with a non-refundable, non-transferable session fee. No date is reserved until the contract and retainer are received.

Payment for digital packages, and products must be paid immediately after placing the order by CARD via link provided by the photographer.

NO images will be released to Client until Client's account has a zero balance.

CANCELLATION
IF for any reason the session is canceled by the client, the full amount of the deposit is non-refundable.

RESCHEDULE
a) Rescheduling by client: If an illness or situation prevents a photo session from taking place, Client may reschedule their session at least 72 hours prior to their shoot without penalty. Should Client fail to give 72 hours notice, or decide to completely cancel the shoot, the full retainer fee is forfeited and will not be refunded.

b) Rescheduling by Photographer: Photographer reserves the right to reschedule due to illness, equipment malfunction, or other circumstances beyond their control at any time. Booking fee will be fully refunded if Client does not want to reschedule the shoot.

LIABILITY
If the photographer is unable to perform any or all the duties herein for any reason, including but not limited to, fire, transportation problems, acts of God, accidents, illness, or technical problems, and if she cannot provide another competent professional, all money received by the photographer, minus the expenses, will be returned to Client, and Photographer shall have no further liability with respect to this agreement.

TRAVEL FEES
Travel within 25 mile of Aberdeen City is completely free of charge. A Mileage fee (£0.45/mile both ways) will be charged for locations outside of the 25-mile radius of Aberdeen City.

IMAGE ARCHIVE
All images will be available for download from online private gallery for minimum of 7 days. Client is responsible for downloading their images in a timely manner. The Photographer cannot guarantee the images and products will be kept beyong 3 month.

COPYRIGHT
The Photographer shall own the copyright in all the images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, of for display within or on the Photographer's website and / or studio.

PRODUCTS
Any products ordered by the client (USB, PRINTS, WALL ART, ANY OTHER PHOTOGRAPHY PRODUCTS), will be only available for collection up to 30 days from the date of notifying the client the product is ready for collection, after this time any products will be recycled. The photographer shall not be responsible for any refunds or reproduction of the products after the time frame has passed.

DIGITAL FILE RELEASE
Photographer will only provide Client with the number of high-resolution edited digital images as described in the package purchased. Digitals purchased within the package will be delivered up to 8 weeks from the date of Favourite list submitted to Photographer.

REQUESTED POSES
Photographer and Client agree that Photographer is under no obligation to capture any specific moment, pose, or person(s) during the session. Client is encouraged to provide a suggested list to Photographer no less than 48 hours prior to the session to include photos Client would like Photographer to shoot. While Photographer will try her best to accomodate Client's request, Photographer has no liability for not capturing any photos on the list.

SUBJECT COOPERATION
It is very important to have the cooperation of all subjects during a photo session; Photographer is not responsible for uncooperative or disruptive subjects. She will work to the best of her abilities to redirect uncooperative or disruptive behavior, but retains the right to end the session even if the time frame has not been met if the subjects continue to be uncooperative or disruptive. Client understands it is their responsibility to manage the behavior of the subjects at the photo session and will not hold Photographer liable for shots or missed poses due to a session ending early.

SESSION REQUESTS
No cameras/camcorders/any type of recording device (this includes mobile phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer, including a written agreement. The photographer will not continue if there are other cameras or video taping during the session.

Session starts at the agreed upon time. It is strongly encouraged that client arrives 10 minutes prior to the start of session. This allows for any last-minute feeding, changing, and relaxing before session begins.

Please do not bring any children not being photographed to the session unless otherwise agreed with the Photographer.

ARTISTIC SUBJECTIVENESS
Client agrees and understands that the quality of a photograph is entirely subjective. Photographer will strive to present photos in a workmanlike manner, but is not required to cater to specific aesthetic preferences of Client. Client understands and agrees that Client is responsible for determining if a post or location is safe.

MODEL RELEASE
For valuable consideration received, the client grants Magic Moment Photgoraphy (Natalia Hajnold) full permission concerning any images that she has taken or may take to use, publish, and republish the photographs and grants the Photographer the right to use the images for advertising including any form of social media, competition, print or website unless discussed otherwise during the session.

The creation of your images involves experience, vision, skill, effort and artistry to the highest possible level.

Under no circumstances should any of these images be used comercially without Magic Moment Photography written consent. The photographs are NOT ALLOWED to be edited in ANY way, shape or form (this includes socal media filters or turning into black and white).
