    The Photographer is responsible for providing the Client a photographic service as detailed in this Agreement.  The Client undertakes to engage the Photographer for this coverage for the price as detailed below.

    Coverage

    Coverage will be provided by the Photographer as follows:

  • The Client agrees that he/she/they is/are responsible for all parties involved with the agreed upon photo session.  If there is an individual involved in the photo session who does not agree to the terms of this agreement the Client assumes responsibility for any liability.
  • MODEL RELEASE:
    I hereby assign the Photographer the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, advertising, educational, and any other purpose and in any manner and medium; including marilianne.com, mari lianne photography blog, Facebook.com, Instagram.com, Twitter, etc; to alter the same without restriction; and to copyright the same without restriction. The CLIENT releases all claim to profits that may arise from use of images.

    EDITING:
    Please allow up to 10-20 business days for the Photographer to finish the clean-edit (color correction and lighting adjustment) of your portrait session. Additional retouching (skin, hair, body and background) is available for some images depending on the session you choose. You may add on retouching after the session - $100 for 10 images. If prints or products are ordered through the website, those images will be thoroughly edited and retouched at no extra charge.

    INDOOR STUDIO OPTIONS:
    If we plan on doing part or all of your photo session indoors, CLIENTS understand that they are responsible for paying for the for studio rental. The Photographer will give you several options in the Portland Metro area.

    TERMS AND CONDITIONS
    1. It is understood that the Photographer is the exclusive official photographer retained to perform the photographic services requested on this Contract.
    2. The Photographer may substitute another photographer to take the photographs in the event of her illness or of scheduling conflicts. In the event of such substitution, the Photographer warrants that the photographer taking the photographs shall be a competent professional.
    3. Payment is due before the commencement of the portrait session. Session fees and print/product orders may be paid with cash, check or credit card. There is a $30 fee for returned checks.
    4. The Photographer reserves the right to use images created under this contract for advertising, display, publication or other purposes. The Client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Photographer in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of the Photographer.
    5. Upon signature, the Photographer shall reserve the time and date agreed upon. Unless the Photographer is able to fully replace the cancelled reservation, all sitting fees and deposits are non-refundable, even if the portrait session is rescheduled or canceled for any reason other than inclement weather.
    6. If, in the opinion of the Photographer, inclement weather or other adverse conditions prevent the creation of a portrait session meeting the artistic standards of the Photographer, she may elect to use an alternate location or to reschedule the portrait session.
    7. If the Photographer cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to an
    illness or emergency (including COVID), then she shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, she shall not be liable for any amount in excess of the retail value of the Client’s order.
    8. Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client releases the Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.
    9. The charges in this Contract are based on the the Photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
    10. NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs or videos elsewhere without the Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties.
    11. This Contract incorporates the entire understanding of the parties. Any modifications of this Contract must be in writing and signed by both parties.
