- Lash Lift and Tint - WAIVER, RELEASE, ASSUMPTION OF RISK, INDEMNITY AND CONSENT AGREEMENT

WAIVER, RELEASE, ASSUMPTION OF RISK, INDEMNITY AND CONSENT AGREEMENT WARNING: Read carefully. This Agreement includes a Release of Liability and Waiver of legal rights and deprives you of the right to sue Marveleyes Inc., its management and employees and/or contractors. Do not sign this agreement unless you have read it in its entirety.
I, First Name* Last Name*, understand and acknowledge that I am of the full age of 18 years or older. If below 18 years of age a parent or guardian must also sign this form.
1. RISKS AND TERMS OF TREATMENT*

I fully understand the procedure and risks associated with Lash Lift and Tint where my eyelashes will be permed to be semi-permanently curled and Tinted for approximately 6-8 weeks. I further hereby save harmless and indemnify Marveleyes Inc. for any damages whatsoever resulting from me not complying with the request Marveleyes Inc. has stated herein.I understand that it is my responsibility to remain still in a reclined position throughout the application and to keep my eyes closed during the entire process until otherwise advised. Any medical conditions that might be aggravated by lying still for a prolonged period of time may mean that Marveleyes Inc. will not be able to have the procedure performed on my eyes.I have revealed or disclosed conditions and circumstances regarding my health and health history, medication being taken and any past reactions to products used or medication taken. I understand, additional conditions could occur to be discovered during or after the procedure, which could affect my ability to tolerate the procedure. I confirm that I do not have any medical, skin or eye condition that may interfere with the procedure, application mentioned herein.I understand that eyes and skin around the eyelashes are extremely delicate, and can incur damage, including irritation, burning, and allergic reaction to the products used to lift/tint the lashes and/or tape, anti-wrinkle gel patches, or latex gloves. These reactions can include anything from mild irritation to a full-blown allergic reaction, even blindness. I have been fully informed as to the methods and procedures concerning the Lash Lift and/or Tint procedure and the risks of the cosmetice procedure I have chosen have been disclosed to me.I understand and accept the the following potential risk and complication of the following conditions but are not limited to those conditions which are recognized as known contraindications for the Lash Lift and Tint treatment: Eye infections/disorders; recent eye surgery; allergies to lash lift and tint products; very sensitive eyes; hay fever; watery eyes; conjunctivitis; stye; dry eye syndrome; using prescribed medicated eye drops, pregnant (1st trimester); Thyroxine (prevent lashes from curling); contact lensesIf at any time I am uncomfortable with the Lash Lift and/or Tint procedure, I will inform the stylist/artist and she will gladly rectify the problem, including ending the session if I (or the stylist/artist) wish. If the stylist/artist is uncomfortable performing the Lash Lift and Tint on me, the stylist/artist will discuss her concerns with me and may end the session if necessary. It has been represented to me that no guarantees, warranties, promises, commitments or other statement as to the results of this service have been made, and I acknowledge that I have received no particular representation or guarantees, and I am consenting to the procedure at my own risk.I confirm that I am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to agree to the terms of this agreement or safely commence the procedures herein.I understand, this agreement will remain in effect for this procedure and all future procedures conducted by my technician or any other technician conducting business at Marveleyes Inc. I understand that this agreement is binding and that I have read and fully understand all information above.
2. WAIVER, RELEASE OF LIABILITY AND INDEMNITY*

I, inconsideration of Amanda Cheng and Marveleyes Inc. completing the procedure(s) mentioned below, hereby release and further agree not to make any claim or demand, or commence legal action against Marveleyes for damages, compensation, loss or any relief whatsoever in respect of any cause or matter relating to the procedure(s). I further agree that this Agreement shall operate conclusively as an estoppel in the event any such claim, action or proceeding and may be pleaded accordingly.I accept full responsibility for and indemnify and hold Marveleyes Inc., and any of its employees and/or contractors, harmless and without liability of any kind whatsoever for the adhesives, lash lift products, nourishing oils, tint products, lash lift and tint application tools, lash cleanser, eye pads, tapes.I further agree to hold Marveleyes Inc. nameless and harmless from any and all damages. I release Marveleyes Inc. from any responsibility for pre-existing conditions I have not revealed, or any consequential change to those conditions that arises after the procedure. I understand I am responsible for any medical treatment I may need to receive because of getting this procedure. I accept full responsibility for these and any other complications, which may arise or resulting of getting this procedure(s), which are to be performed at my request.Having read the above, I acknowledge that all of procedures contemplated and consented to herein have been fully explained and I fully understand the nature, scope and potential risks of the procedure(s) I am consenting to being performed and accept full responsibility for any and all results of the said procedure.
3. PRIVACY*

I further acknowledge that any information provided by me to Marveleyes Inc. is being provided solely for the purpose of Marveleyes Inc.'s internal records and under no circumstances is it deemed to be given to Marveleyes Inc. for the purpose fo making or giving any medical advice, decisions, opinions, diagnosis, or representation to me or any other third party.
4. CONSENT*

I here by consent to Marveleyes Inc. and their technicians in performing the procedure(s) of Lash Lift and/or Tint on me now and in all future sessions.
5. VIDEOGRAPHY AND PHOTOGRAPHY CONSENT

I hereby consent to Marveleyes Inc. taking photographs of me before and after the procedures undertaken by Marveleyes Inc. at my request.I further acknowledge and authorize Marveleyes Inc. to use these photographs for the following purposes: (a) Marketing and Advertising: To compile an album of current and past clients to show prospective clients, including but not limited to uploads to social media platforms such as Facebook and Instagram. (b) Educational and Training Materials: To be included in Marveleyes Inc. training course material. (c) Business Operations: For any other uses related to the normal course of business operations by Marveleyes Inc.I understand and agree that:The photographs may be used without my further consent or notification. Marveleyes Inc. will retain ownership of the photographs.The photographs may be edited, altered, or modified as deemed necessary by Marveleyes Inc.I will not receive any compensation for the use of these photographs.
I, First Name* Last Name*, hereby warrant that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be waiving certain legal rights by signing it (including the rights of the minor, my spouse, children, parents, guardians, heirs, and next of kin, and any legal personal representatives, executors, administrators, successors, and assigns), acknowledge that I have signed this Agreement freely and voluntarily, without any inducement, assurance or guarantee, and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement shall be deemed to have been made in accordance with the laws of the Province of Ontario. If any provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by
the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Marveleyes Inc. has put in place preventative measures to reduce the spread of COVID-19; however, Marveleyes Inc. cannot guarantee that you or those who you will come in contact with will not become infected with COVID-19. Further, proceeding with your appointment and intended service could increase your risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19
and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by proceeding with receiving services from Marveleyes Inc. and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Marveleyes Inc. may result from the actions, omissions, or negligence of others, and myself including, but not limited to, Marveleyes Inc. employees and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my use of services with Marveleyes Inc. (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Marveleyes Inc., its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Marveleyes Inc., its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after receiving any services from Marveleyes Inc..
