1. Scope of Work
The Photographer agrees to photograph the minor athlete during the specified event/session and provide the following:
-Professional photography services during the time specified
-Selection and basic editing of final images
-Delivery of high-resolution digital files via online gallery with Pixieset within 2 weeks from event date.
2. Parental Consent and Model Release
By signing this Agreement, the Client affirms they are the legal parent or guardian of the minor; or if the coach of sporting team, has permission from all parents/guardians involved and assumes responsibility for consent; and grant the Photographer permission to:
-Photograph the minor listed above during the specified event
-Use the minor’s image for purposes agreed to in Section 3 below
-The Client releases the Photographer from all claims and liability relating to the use of these images, as long as the use complies with this Agreement.
3. Image Rights and Usage
The Photographer retains the copyright to all photographs taken.
The Client receives a non-exclusive, non-transferable license to use the delivered images for personal use only, including printing, sharing with family and friends, and posting on personal social media accounts.
4. Marketing Use:
The Client grants permission for the Photographer to use selected photos of the minor (without full name or personal details) for portfolio, website, or promotional purposes, for an unlimited amount of time unless otherwise revoked in writing after signing.
5. Fees and Payment
Total Fee: Individual- $50; Sibling-$90 for 2, $125 for 3; Team-$300
Deposit: Pay in full at signing to book
Payment Method: Invoice will be sent to an email provided via Pixieset. Client knows and understands there is a 3% transaction fee associated with Pixieset Website Payments.
6. Travel, Parking & Additional Venue Fees
Sessions taking place outside a 60-mile radius of Coloma, Michigan may be subject to additional travel fees, which will be discussed and added to the final invoice prior to the session whenever possible.
Client is responsible for informing Photographer of any known parking fees, gate fees, admission costs, venue access charges, permits, or other required expenses associated with the event location before the scheduled shoot date.
If additional fees are known in advance, they will be added to the session invoice. If such fees are discovered upon arrival or during the session and were not previously communicated, Client agrees to reimburse Photographer for the full amount on the day of the shoot.
7. Cancellation and Refund Policy
Cancellations must be made in writing at least 1 day prior to the session for a refund of any prepaid amount.
If the event is postponed due to weather or unforeseen circumstances, the session may be rescheduled at no additional cost.
8. Limitations and Liability
The Photographer is not responsible for missed shots due to restrictions, limited access, game conditions, or playing time.
The Photographer is not liable for injuries sustained before, during, or after the session.
In the unlikely event of equipment failure or loss of images, liability is limited to the return of all fees paid.
9. Privacy and Data Protection
All information about the minor and Client will be kept confidential. Images will be securely stored and not sold or shared beyond the scope agreed upon without written consent from client.
10. Entire Agreement and Acknowledgment
This document reflects the entire agreement between the Photographer and Client. This agreement shall be valid for all future sporting events involving client and minor(s) involved. No other promises or agreements shall be valid unless made in writing and signed by both parties. Client knows and understands that time slots are not considered "booked" until contract is signed and payement is recieved.
